I am considering Carrying a gun-No CCW

I too suggest moving. I'm willing to bet there are a lot more gun owners and pro-gun advocates in California than most people think. If they all left California, the economy would take a devastating hit. It would send a message that not only do you alienate general gun owners, you alienate all gun related buisnesses including security, hunting, sporting events like trap shoots, charity funding organizations, and so on. Like it or not, this country would go belly up without gun related buisnesses and contributors. They will find this out when the whole country is Californianized.:cool:
 
I would recommend against concealed carrying of an air pistol in California. It'll get you busted just as fast as a real weapon.

You want to get a CCW in Calfornia? Get a second job as a security guard and get the required hrs necessary to become a licensed private investigator. It's something like 6000 hrs (that's a lotta yrs if only P/T) or less with a college degree, pass a State exam, pay a ton of fees and carry the minimum liability insurance. No training, no statement showing need, no discretion, no nothing (so far as I can see) except the above.
 
If you are sincerely worried about your or family's protection, CCW is not an option, and want to carry for protection.... MOVE. Nobody should live somewhere like that. If you are caught, it means jail time (that would be great for the family) and you will no longer be legally allowed to own firearms of any kind, not to mention you will be probably fired from your job and have trouble getting another one. You're call.

I Got a call today from the Sheriffs office. Was told that they were going to send me an application and wanted to meet with me. The lady was really nice, and asked some questions about why I wanted to carry a gun.She said I most probably meet the critera... but the Sheriff would have to sign off on it. Any ideas on what they might ask. I guess she is in charge of Investigations. She said not to sign up for the CCW course until the sheriff signs the paper. I really hope this works out.

Sounds like the lawful way might work.
What part of the state are you in. You can always apply for arson detail they carry.

It's up to you, do you think that the risk of being caught outweighs the risk of not being armed?

100% ... If you actually use it for the reason you carry it ... If you have no need to use, why carry it ? You have a valid reason, then you expect to use it, and will be made 100% of the time. Seems to me that any 9 year old child could figure that out.
 
I understand your feelings. I believe in the little known concept of jury nullification. I believe in the right of self defense which California is denying you.
You could carry and accept whatever consequences that may come. If you get caught (especially if using it to defend your life or your family) let a jury hear it. I know if I was on the jury, I would nullify the law and find you not guilty.
It would cost you money, it might even cost you some time in prison. But at least you are alive to face the State of Kalifornia after surviving the bad guy's assult.
 
You're assuming that the judge would even permit him to make an argument of his choosing to the jury, and that the jury wouldn't be stacked with people who agreed in advance to act as automatons applying the law precisely as given to them by the judge.

The good news in California is that the first offense carrying a handgun registered to your own name is a misdemeanor, not a felony. I've known people who lived in some of the more sketchy, more anti-gun parts of the state who have carried routinely, unlicensed, for years.

However, California's knife-carry laws are fairly liberal too, so you may consider getting yourself a large folding knife with a thumb stud for self-defense, instead of risking prosecution.

My own solution was to move from San Jose to New Hampshire. Applied for my concealed carry license the day after arriving in the state, and got it two weeks later.
 
It's your choice but another possible penalty is dismissal from the FD should you be arrested and convicted, and that's for just possessing a concealed handgun. So you not only risk incarceration followed by supervised probation but also an end to your current civil service employment and potential difficulties in getting a job later. In the end, if you are NEVER in a position where a LEO might discover your unlawful activity you'll have no worries.
 
I'm suprised that CCW without a permit in the PRC is a misdemeanor. Carrying a concealed firearm in Fl. is a felony, and it is much more gun friendly than the Peoples Republic.
 
What are your risks on carrying a conceal weapon without permit?

Let's face it, I would love a carry conceal weapons permit. But where I am located (Iowa City, IA), the police station isn't as so kind to allow it (because they believe it's not neccessary). Sometimes, I go to bad parts of Iowa (yes, they are) and feel the need of a little sidearm for protection. (I've heard too many stories of people getting caught in situations that could've easily been prevented with a handgun) Should the protection of my loved ones outweight my fear of getting in trouble?

I just only wished the government wouldn't find a way to go around the constitution.

Varies from state to state. Some states it is not much more then a slap on the wrist misdemeaner others it is a throw your rear in jail for a long time offense.

Best bet is probably to look for legal other options. Defense sprays, knives(training), unarmed fighting(training), hairspray and a match...:D
 
I understand your situation and sympathize, but what you're doing here basically is asking us to tell you whether or not to break the law. That, my friend, is something only you can answer ;) .
 
Just carrying a concealed weapon isn't the problem. It is getting caught carrying it. In most states it will bring large fines and jail time. If you are forced to use it in self defense, you will be ok if the shooting was justifiable but will Most likely still be charged with the weapon offense.

Lobby your state politicians to change the law like a growing majority have done already. Tell them it is essential for "National Security";) . Why not get some useful mileage out to the current national mania.
 
I'm a firm believer in the 2nd ammendment, and as much as I sympathize for you -- if you're looking for approval for an illegal act, you're not going to get it. If you're really serious about carrying a handgun, take the class and get the license or move to another state.

It isn't fair, I know. Bad guys don't need a license to be bad guys. But that's the law.

On the other hand, if you're a really sneaky good guy.... (wink wink)
 
I feel for you. I has similar situations in Ohio. The good people of OH finally decided to let us cc. Some sticky points to the rules, but I abide by them, as I did before the law was passed. I don't mean to say I didn't have a gun in the truck, only that it was legally being transported. I would also keep alert, as you can generally see that somethings up. BG's are not as good as they think.

Sirius, . . .1st, . . . I am not a lawyer, but from what I have read, . . . you really don't want to get caught illegally carrying a firearm concealed. In Ohio, I am told, you will never, ever, never, ever, never, or ever, . . . get a CCW license if you are first charged with doing so illegally.

2nd, . . . I am also told that you will get the worst Monopoly card of all: Go directly to jail, . . . do not pass go, . . . pay your lawyer several thousands of dollars, . . . wind up with a criminal record.

Advice, . . . find out what your state laws are and learn how to abide by them, . . . or move to another state.

I hear ya, man. I work in IC and live in Cedar Rapids. Both places are virtually impossible to get a CCW. I don't know what your definition of a rough Iowa neighborhood is, but I live on 16th St. in CR, and I park in a dark alley in the back. Both my girlfriend and I carry pepper spray. A firearm would be better, but you will be royally screwed if you're caught, especially in IC. If you really want to carry, move to Des Moines. I hear the only reason you need there is "Demonstrated Responsibilty".:confused:
