Defense case Continued:
The Defendant took the witness stand.
*He is a handlsome, slender, light skinned black male dressed in an expensive suit. he has mid back legnth dreadlocks neatly held back in a pony tail. He speaks with an English accent*
He is 34 years of age and was born in London, England, he is a Permanent resident Alien (green card) here in the US. His birth name is Winston Frothingslosh IV, he changed his name when he began his career as a reggae rap star. He is a graduate of Eton and Oxford and has a degree in economics from the London School of Economics, together with a degree in Music Theory from Julliard in NYC. His occupation is reggae-rap entertainer, and he owns his own record production company. He also is self employed as a real estate investor.
He stated that he moved across from the Dr. about 1 year ago. from the beginning, the Dr. "gave him trouble", doing things like calling the Police when he had parties and making "snide" comments to him...one he specifically recalls was right after he moved in and was watching his houseboy wash his mercedes the Dr. came by and said "you people like those fancy cars dont you". He stated further that becasue of his celebrity status and his lifestyle, the Dr.'s teenage children spend a lot of time at his residence at times when the Dr. was not around.
He admitted to smoking pot on a regular basis. He admitted having two criminal convictions, both were "minor" pot posession charges.
He admitted he is bi sexual and said that one one occasion, at a party, about two weeks before the incident, he kissed the Dr.s son.
For about two weeks pror to the incident, whenever he would see the Dr., the Dr. would "look at him". He stated that every time he saw the Dr., the Dr. was armed with a pistol carried conspicuosly on his hip.
On the day in question, the defendant stated that his friend Jamaal Muhammed, who now resides in the UK, pulled up to the house with the Defendants girlfriend. They were there for a party later that day and in additon, Jamaal wanted to show off his new Ferarri Testarossa. When they pulled up, they were smoking pot. The vehicle itself is "loud" and the music from the vehicle was also loud. The defendant went out to greet them and while they were outside chatting, listening to music, the Defendat spied the Dr. coming towards him...
