Suffolk County NY handgun License holders

It would be political suicide for any politician in Suffolk County to come out in favor of, or push for CCL legislation. Not only is Suffolk County becoming more and more left leaning, but can you imagine the furor that the ultra lefty rag Newsday would cause when they proclaim the dangers in having 29 thousand handgun license holders legally able to carry their handguns? That would be something to see.

Meanwhile it's perfectly legal in nearby CT and PA and many places upstate.

Yea, seems that way. Though I wouldn't be opposed to recommending that they limit unrestricted permits to those who can show proof of training. Not ideal, but better than what we have now. I think there was a case back in the day re: SCPD's proof of training requirements, which is why we don't have any today--but I believe SCPD tightened other areas of the process as a result.

Anyway...I'd love to see Newsday have a fit over it. And I love that CCW works so well (and safely) in other places right next door. As for the letter, again, as vip said, I don't expect any politician to chage his/her mind. But name recognition is never a bad thing, and if we have enough people interested, a letter would be fine.

tomcat now is not the time for complacency Newsday is broke no circulation the left is getting it in spades with their stimulas bill now is time to get politicaly active REAL CHANGE ON THE WAY

Hey I'm in favor of the glass walls. There is (or was) a woman working there that is one of the nastiest, most condescending arrogant humans I have ever come across in my life. Anything that puts a barrier between her and normal humans is ok by me.

EdK, wow sad to hear about the glass walls. I'll never understand why PDs don't get the fact that by and large, CCW holders are on their side of the fence. Ah well. As I said, I don't think a letter could hurt, and if it's more than the 4 of us in this thread, I'd be happy to go along with it :). Maybe I'll post on some other forums and see if anyone is interested.

ETA: Vip, posts crossed, just saw yours. Funny stuff :D. Not sure if we're thinking of the same person, but I may know who you mean.

Folks, sounds like y'all need to get together and start an organization like we have here in Georgia. georgiacarry.org

A few years ago it started with just a handful of like minded folks and now it's approaching 4,000 strong. As members, we have state representatives, lawyers, LEOs, and plenty of common folks like me.

This organization has done more for 2A rights in Georgia than you could imagine and it continues the fight every day. A single voice can be ignored, band together and shout!

(BTW, my oldest daughter lives in NYC so I feel a kinship with you folks)

Letter

Ok, so if we are going to write a letter i guess the first step is who is the best person to send it to, or are there multiple people we should address?

If anyone has any suggestions im all ears.....

This all may turn out to be a waste of time but at least i can say i didnt just sit there let it happen.

My wife and I had our licenses suspended last month. I can't get into all the details but the suspension is related to the arrest of my sixteen year old grandson two years ago (lives with my daughter in a basement apartment in my house with NO common access and absolute NO access to our firearms) and alleged to have some gang affiliation.

We've both been license holders for 20 years. We've raised four kids of our own. Neither of us has every been arrest. There is absolute no evidence of any irresponsible or careless behavior on our part with respect to the use or safeguarding of our firearms but that didn't matter to the officer that pulled the licenses.

From what I've been told they are pulling out all the stops to suspend, revoke or refuse issuing pistol licenses and as others have mentioned the legislation is such that they don't have to give a reason for refusal and the only way to challenge their decision will take months and cost thousands of dollars.

BTW, doesn't anyone know what the restrictions are on a private sale of ammo? Since there are so many Suffolk County license holders viewing this thread ... I've got 700 rounds of 380 ammo available. If you're interest PM me.

Marz: I imagine the best person to write to would be Executive Levy. He is by no means conservative, but he is sometimes more conservative than other democrats in the area. In addition, he is currently involved in a bit of a political spat with the SCPD, so the time is opportune. Again, I certinaly don't expect any result out of this (aside from a possible reply form letter), but I'm with you: just another step towards being able to say I wasn't on the sidelines. Anyone else think of additional addressees?

2edge: yea, that sounds like legal action time to me. Someone here likely knows better. Unfortunately, I imagine it will cost you. Are there any organizations or pro-2A attorneys who do pro bono work in this sort of situation? That decision by the SCPD to pull your licenses seems absolutely ludicrous in light of DC vs Heller. Sure, the SCPD can be capricious about the restrictions that they put on your license, but can they discriminate to this extent, when there is no reasonable difference between 2edge and other law-abiding gun owners? I think that pushes discretion into discrimination.

"Unfortunately, I imagine it will cost you."

I've talked to a couple of lawyers and it will cost a few thousand dollars to take legal action in an attempt to have the suspensions lifted. And while both of the lawyers I've spoken with are confident the appeal would be successful one of them told me to make sure the handguns have been well oiled before turning them in.

Hey all, I live in Nassau County and am currently awaiting approval of my target/hunting permit. But I would gladly jump in on a class action type petition if one would get going somehow.

I'm not sure what they're expecting at pistol licensing but the thick plexiglass barriers were put up sometime after my wife's visit last week (don't try blaming it on my wife, she is a sweetheart :)).

Turned over my handguns and license...just call me bummed out.

I am member of N.R.A. N.Y. , Rifle & Pistol Assn. , S.A.F.E. and several other pro gun clubs. I was on Parker Gun web site there's concern about anti gun laws proposed these {I mean no disrespect] Aristrocrats are I think finnaly seeing the light. All orginazations must get together & collectively to support the sport and Second Admt. rights. I do plan to discuss this at next meetings I attend and I don't miss meetings

There needs to be once again a legal challenge to the Penal code section that allows local issuing authorities the right to add whatever "restrictions" they deem fit onto a handgun license. These restrictions should be shown as being capricious and arbitrary and allow far too much latitude to the issuing authority allowing them to impose their own anti constititional gun control measures far beyong their authority. They do not make the law, they enforce it. The suffolk county legislature passed a law that says they have to abide by NY Penal law but they take full advantage of the restrictions clause. It is the "reasonable restrictions" clause that has to be shown as being far too restrictive and is being enforced differently depending on your county of residence and which is the issuing authority.

The SCPD has to be made answerable to the people.

This would require financial support from national organizations as well as grassroots. If the 29000 licensed Suffolk County pistol holders could speak as one voice I believe we could make some changes. No politician could ignore a voting block of this size. I for one would be happy to aid financially in this effort. In light of the Heller ruling, the huge increase in home invasion incidents etc I think the time is right.

A year ago or so there was a discussion (I don't remember if it was a series of e-mail's or on a forum) with Mr. King of the NYS Rifle and Pistol Associate. He is very knowledgable regarding the obstacles advocates of the 2nd amendment face in this state. The summary of his response was no meaningful change for the better will occur in this state as long as we keep voting in left wing democrats that do not interpret the Constitution or understand the 2nd amendment the way the Supreme Court interpreted it in Heller and as most of those on this forum understand it.

To try and fight this battle one lawsuit at a time would be extremely/prohibitively expensive and unfruitful given the way the penal law is written at this tme. In his opinion the key is electing legislators that will create legislation that is more favorable to firearms owners and second amendment rights advocates.

My situation is a prime example. Even if I had the money to hire a lawyer and won the court case to have the suspension lifted it does nothing to change the language of the legislation or the attitude of the SCPD. They have the vast resource of taxpayer money to spend. So I win my suspension petition and get back a license with draconian restrictions. What has it cost them? Nothing. They will continue to do what they do until there is legislation in place to stop them and that change in legislation can only happen when there are more in the legislature that are pro versus anti 2nd amendment.

Hey all,

My names Dan (yes, my last name is Heller....ironic right?) Anyway, I am 20 years old (21 in the summer) and am getting started on my pistol research. I have been arrested once and charged, but not convicted (it was a misdemeanor, criminal mischief). I have recieved one speeding ticket (78 in a 55). I already am an owner of long rifles, and am applying for a pistol permit when I turn 21. Is it likely I will be denied?

Also, I was reading about the becoming a member at a 24 hour range, so I can have a gun bag in my car at all times. Is that a logical idea, or can that cause trouble for me? I just want to be able to go to the range and target shoot, and have my gun with me at certain times(My girlfriend lives in Brentwood, so I spend a lot of time there.)

Dan,

You're best bet would be to call the local permit issuing office. There are too many variables left up to the issuing authority for anyone to give you a solid answer. In general, only convictions should matter. Speeding tickets make no difference, I had literally a couple dozen back in my youth.

As for you're second question, the very premise makes me nervous. I mean no offense but the way I see it is that you don't even have your permit and you are already trying to find ways to skirt the law. Personally, if I were the issuer I would deny a permit for that reason alone, if it came to my attention.

I've said it before. Regardless of anyones belief of whether or not we should even need a permit, the current law says that we do. As such, they are issued to ostensibly law abiding, upstanding citizens. We should all be inclined to act accordingly.

Not looking to find loopholes in the law, trying to find what my legal limitations are. I don't want to be leaving the range at 9pm, and stopping to get food(while keeping the gun unloaded in my car) and getting pulled over on the way home, and get a **** storm from the officer. I have had people approach the window of my car multiple times, and it has ended fine. But if I have the girl in my car, I don't need anything to happen to her if I can't just drive away.

I'm a very law abiding citizen, especially when it comes to my fire arms. I just don't want to get caught up not knowing my rights.
