The gun show loop hole is that someone who is not "engaged in the business" of selling firearms (i.e. a private citizen) is not required to perform a NICs check.

I get delayed everytime I try to purchase. I had paid for the gun the first time at a show and everything I made them give me back my money. So after this occured a few times I called the FBI and asked why. She said have you ever been finger printed for a crime? Yes, a DUI 10+ years ago (I was young and stupid once upon a time) she said that is why. The quick check shows that you have/havent been arrested once and nothing further. If you have this delays gives them time to look into it further to decide whether the sale can be done. Here in Louisiana they told me that they have 96 hours to call back and deny me or I automatically get approved. It has never taken more than 24hrs to get cleared to buy.

I am suprised that Cabelas sold it to you. A lot of the chain stores, Academy, Wal-Mart and some others I have heard once you have been delayed that it is their own policy to go ahead and not sale you the firearm.
 
Federal contracts require us to have all new employees fingerprinted. I get the reports from the FBI and State Police. It's amazing how often people are truly surprised when they learn that there's still something from 1973 on their record. If you find yourself having these hassles with NICS check, I would suggest having an attorney look into it for you. It's often not a big deal getting things removed if you've been a good citizen, and it was a relatively minor event.

What he failed to mention is that Federal Law requires a multiple purchase form be filled out and sent to 1.BATFE 2. Local Law Enforcement for any person who purchases two or more guns. That is the surest way to ensure that THE MAN sees all of your purchases. Either he is violating the law or just blowing smoke up your A$$. Let's hope it the latter for his sake.

Unless it is a state requirement, you are correct. NICS only asks the buyer's info and type of firearm, not serial number.

A lot of people get delayed. There is no rhyme or reason. Sometimes it is because of a common name, others for other reasons. The bottom line is that it is no big deal and not worth getting worked up about.

Could be that your age has something to do with the delay. You have no record, but you also have no record, if you get my drift? Be patient and play thier game. Don't be rude or discourteous to the store clerk, as it's probably awkward to them also. Where I live, I give them my drivers license, my concealed permit, fill out all the paperwork, a supervisor at the store double checks the paperwork to make sure nothing is left out, I pay for said firearm, and walk out the door.

Each item NICS puts into thier sysytem can put up a red flag. If someone has very similar info of you than red flags are gonna pop up. I have a pretty common name I guess and I go through as quickly as they recieve the info. No hesitation from NICS at all. My brother who's had a FFL for yars now gets a delay sometimes. Can happen to anyone. I hear ppl complain and yet they never check to see why there wa a delay. Why not see what the red flag was for and try to straighten it out if possible.

Guys I got the gun and my CCW, everything worked out great. It was probaly because my popular name and the fact I had just turned 21 that day
 
Glad things worked out for you, enjoy your new acquisition, I never used to put my SS# on the forms, it's optional, until I was denied. Went into the local PD to speak with the Officer who handled these matters and learned there was an individual with the same first/last name & middle initial as mine and was something of a one-man crime wave with arrests all over the State. Got things straightened out and since then always include SS#.
 
Utah CFP Instant BC and No Brady bill fees

The Utah CFP (ccw) allows instant background check as well as skipping the 5-10 dollar fee that most shops still charge on the BG check! I have saved about 200 bucks since I got my permit just in BG check fees! I was denied onec on a handgun purchase, less than a week after a previous purchase at the same shop! Turns out I had an out of state speeder that I had ignored thinking it would go away if I didn't get stopped in that state again! Flawed thinking on my part! Turned into a FTA warrant and a suspended license. although easy to clear up (about two days) it was considerably more $$ than just paying the ticket. Note to self.... Send Barney fife a check next time you get a 65 in a 55 on a deserted piece of old freeway in Idaho! Oh, and Barney, look at that LEO ID and extend a little #%$@ing professional courtesy huh?

Just get a form from your local FFL and apply to F-troop for a UPIN (Unique Personal Identification Number).
All FFL holders are required to have the UPIN application form available.
You mail the application, a fingerprint card and a small fee to F-troop.
Bada-bing, Bada-bang.
No more delays, ever.
 
Hi Everyone.I'm glad I found this forum.Great info here.

I just went through the same thing yesterday in Pa.I was all set to buy a S.W. semi auto pistol.I submitted my id's for the usual background check,and went outside for a smoke and figured I'd be out of there shortly with my new purchase.

To my suprise I was denied.I couldn't imagine why and I wasn't provided a reason.This has never happened to me before on any of my previous purchases.

Additionally,I have recently successfully completed TWO federal background checks for my job as an interstate trucker.The first was for a Hazardous Materials Endorsement on my CDL,and the second was a for my T.W.I.C card or Transportation workers identification credentials, which gives me access to ports, nuclear facilities,munitions plants and the like..

I have no felonies or domestic assualts on my record.I can't figure out why I was denied, but I will challenge it.It could be because of my very common last name.When knows..

Just as recently as last year I purchased an AR-15 in Connecticut with no problem,and they are notoriously difficult.I had to wait two weeks while they performed thier background check..

Any advise?
 
Yea, we're fortunate in Wyoming. If you have a CCW, they don't do a background check. Nothing. Just fill out the paperwork, give them your money, and walk out the door. Definitely 1 advantage of a concealed carry permit.
