Hitler did NOT "pass" the Enabling Act.

The Reichstag passed the Enabling Act and handed Hitler the powers that he needed to become the dictator that he became.

There's a distinction.
 
The Enabling Act was put forth by the NSDAP, which also bullied the remaining parties into supporting it. Only the SPD (Social Democrats) voted against it, and they got their reward right afterwards. So yes, Hitler pretty much passed the Enabling Act, because by then the Reichstag was thoroughly intimidated into passing whatever the NSDAP wanted to pass.
 
Zoning: The cure is much worse than the disease...

Based on personal experience:

When one peels away the false veneers of "public safety", "energy conservation", "enhancing property values", or other sham justifications, zoning laws and code enforcement are in truth the worst cesspools of waste, fraud, and abuse that exist in administrative law. It is easily and often used to promote hidden agendas.

Anyone who tries to defend these laws on one or more of the standard pretexts, either hasn't thought much about it, or is trying to sell you a bill of goods. :barf:

The Nazi party didn't send out hoards of thugs to force votes for the Enabling Act through intimidation.

The party actively negotiated with the Central Party and its leader, Ludwig Klass, to bring that group's support to the Enabling Act. Klass agreed to support Hitler in exchange for guarantees of civil and political rights for Catholics (the Central party was primarily Catholic).

The combination of votes of the Nazi and Central parties, as well as votes from members of other parties who supported the Nazis, gave Hitler the 2/3rs majority that he needed to win passage of the Act.

It's true that one the day the vote was taken that the Reichstag was flooded with members of the SA, who posed a threatening presence, but by that time it was a moot point.

Hitler, through negotiation, already had the votes that he needed for passage of the act.
