4 dead because of stupid security proceedures !! Fox News interviewed a lawyer and former cop who had been in the building at the time.A year ago he wrote a report about the security concluding that unless proceedures were changed there would be a disaster ! His report was ignored !!!
 
Atlanta Courtroom

A lot seems to have changed in Law Enforcement since I left 20 years ago. The account on Yahoo said the law states no handcuffs entering court so it won't influence the jury. If that's the case who do we thank? ACLU? Liberal Judges? Bleeding Hearts? Can't we all just get along!
 
The sad part is that they took him alive. More $ down the drain. He will live to see his birthday for the next 10-15 years (or more) :barf:
 
He wont be alive for another 5 years, not in georgia they fry them quick and fast. He put the most to death each year, more than any other state.

my opinions of this and why he did what he did.
When this loser opened the door and waived a white towel, I would of shot through the door at the point i think. When this loser came out he unarmed and arms up over his head and hands were empty. This loser followed every command given to him from about 30 swat officers with their 223s guns pointed at him.
Trust me when I say one false mover and it would have been lights out, if they could of they would of, with all the news and other things around they would have hun a cop or the killing. Look at the bitching about his civil rights
being violated because he does not have an attorney with him during questioning.
Even if he knew she was gone about the time she got away or with in 2 minuets of that Gwinnett Police was on scene in 2 minuets with one officer and had sever uniform officers 10-60, Then with in under 5 minuets 30 uniform cars and every news and 2 police helicopters and 5 news helicopter was over it, so any black and ever bald male was stopped and searched. This loser knew he had no place to go and every inch was covered and blocked, I wish he killed himself.
Why he choose to come to gwinnett i don't know, some say he ran out of gas and and they found the car off hiway exit so that might be true. Then he walked to a gas station and car jacked her at gun point and said don't scream get in and drive, I have no idea why she tock him to her home, I have no idea what I would of done if i was her. I know what I would of done if that was me, no man i an not getting in the car with you, take the keys and car and money, as i went for my wallet we would had a shoot at at the QT.
Hell I know all QT and gas stations and pump areas are on vidio and people are insides, if he shot me it would of been on video and i know the people inside would of hear it and pushed an alarm botton.
I hope he did not rape her or do somthig worse to her then what he did. I know i would never of gone home if i know iw as all alone.
Now if this loser found out she was gone with in 5 miuets of her getting out, once he looked outside he knew it was over, if he woke up before swat moved in and the other uniformed officers he had to seen about 5 patrol units that blocked the exit that was visible from the window. This pictilar unit was facing the wood and had only one exit and was in a U shape.The had another 20 cars behind the unit closing off the u.
I don’t know if I can get away with taking pictures of the unit or getting near it to show a ground shot of what he was able to see. For all I know she or someone she knows might have a gun in her apartment and other tenets might not like having a strange person close to the apartment for a little while, I am not black but I like my blood in my body.
She might not be anyplace near that apartment after her ordeal. I will see if I feel save getting close or walking around. I get a bullet proof vest I can put on.
 
If he is convicted (i wonder if he will be ;) ) I got rope if they need it. Though I think killing is too good for him. Solitary confinement for life would be a much better punishment. :)
 
Sorry folks. He is in federal custody. The locals only have him for interviews. The federal officer murder means he gets to go to Marion. When the federal sentence is done, the state can have whatever is left. I doubt the death penalty will be involved.
 
Sir William you are nuts if you think he’s not going to be fried.

This is Georgia, A state that puts people to death with out any problems. Georgia puts the most inmates to death each year.

I bet you and any other one the death penalty will be carried out quickly.

Last you have to put him federal custody because the sheriff department runs all the jails in Georgia, he would be dead if he went to any state jail.
 
He is charged with a federal crime. Being in illegal posession of a firearm while under indictment. The state will charge him at an arraignent Monday. The murder of a federal agent takes priority. The state will have their day. I do doubt the death penalty will be imposed.

I have to agree with Sir William. The Feds are going to have first crack at this guy. Whatever happens to this guy it's going to be a long beruracratic nightmare. He won't see the needle or the chair anytime soon !! Chances are this guy will probally take his own life, justice will never be served IMO.
I really think the only reason this guy surrendered is because his last victim convinced him that how precious life is and no one else should die. I do not believe that 30 SWAT guys with riffles had as much influence over him as did his last victim that he held hostage...her story is in the Atlanta Journal and Constitution.
As far as the state goes I think they REALLY should focus on dammage control. I feel that Fulton county's lack of security measures shares EQUAL blame for all of the tragedies that took place this weekend. If any good comes out of this it will be that ALL jurisdictions learn from the incompetency of local,county and state errors in regards to the handling of this matter.

Feds Drop Charge Against Nichols


Federal charges against courthouse shooting suspect Brian Nichols have been dropped while a mistrial has been declared in his rape case.

Three murder warrants have been issued, however, against Nichols, who is being held at a federal penitentiary.

Nichols, who is suspected in the shooting deaths of three people at the Fulton County courthouse Friday, had been expected at the federal courthouse in Atlanta Monday morning.

Federal authorities said they decided to drop their case against Nichols, for now, to clear the way for Fulton County authorities to take the lead in the case against him.

By dropping the charge -- possession of a firearm by a person under indictment for a felony -- without prejudice, the charge can be revived later. Nichols had been on trial for rape and other charges when he grabbed a deputy's weapon Friday morning and started a deadly rampage, authorities said.

"This action allowed Nichols to be returned to the custody of Fulton County, Georgia authorities from the custody of the United States Marshal Service," announced U.S. Attorney David Nahmias.

"This office will continue to confer with the Fulton County District Attorney's Office to determine what federal and state charges should be brought against Nichols and when such charges should be filed."

Nichols surrendered peacefully Saturday after holding a 26-year-old woman hostage inside her Gwinnett County apartment.

Nichols is suspected in the shooting deaths of Judge Rowland Barnes, court reporter Julie Brandau, Sheriff's deputy Hoyt Teasley, and U.S. Customs Agent David Wilhelm.

Nichols had been taken to the courthouse Friday morning for his second rape trial. The first ended in a mistrial due to a hung jury.

On Monday, Fulton County Superior Court Judge Stephanie Manis granted a defense motion and declared a mistrial in the second case against Nichols. Manis took over the case from her slain colleague, Rowland Barnes.

Good call bci, it appears that I could not have been more wrong. I wonder how long this guy will be on death row.
 
Now THAT is interesting! I wonder how much money is going to be spent on this case? There will be a motion for a change of venue. I imagine the jury will be difficult to pick and sequestered when agreed upon. A state appointed defense attorney, a state prosecution, care and feeding of the defendant and the jury, security measures, crowd and media control, transportation costs and Amnesty International or other watchdog groups to deal with. The taxpayers lose again. I am still surprised that the federal authorities gave him up. Odd.

They are mad because a agent was killed. That is bad but you can't charge him with murder of a federal agent if he did not know it.

The state will try him and fry him fast. With in 5 years and be in the millions.
 
Seems to me, a good attorney.................. Lets see here, the state is going to prosecute and the state is going to defend...... hmmmm conflict of intrest here no?

No, they are dead because a vicious criminal stole a police officer's gun and killed them with it. I got tired of statements like this when some people decided we needed to find someone in the US government who we could blame for the 9/11 attack.

(CBS/AP) The suspect in a crime spree that left a judge and three others dead appeared before a magistrate judge Tuesday on a refiled rape charge, which is being used to hold him as he's investigated in a courthouse shooting rampage and the death of a federal agent as he eluded authorities.

The judge informed Brian Nichols that he was being charged, for a third time, with rape, and Assistant District Attorney Michele McCutcheon informed Cobb County Judge Frank Cox that the state will pursue four charges of murder against Nichols.

Nichols was held without bond and no future court hearings were set.

With his hands shackled at his waist and his ankles shackled together, Nichols only spoke once, when the judge asked him if he had any questions.

"Not at this time," he said.

Nineteen officers lined the walls of the cinder block room at the jail for the hearing.

Defense Attorney Chris Adams told reporters after the hearing "this is a time of grief and mourning" for the courthouse community.

Some residents are questioning how local law enforcement let Nichols elude their grasp for 26 hours in what is being called the largest manhunt in state history.

Nichols, a 6-foot-1, 200-pound former college linebacker, is accused of grabbing 51-year-old sheriff's deputy Cynthia Hall's gun in a courthouse and then fatally shooting a judge, a court reporter and a deputy.

Security cameras rolled as Nichols — who had been found in court earlier in the week with two homemade knives in his shoes — overpowered the 5-foot-tall Hall as she escorted him to his rape trial. But no one was monitoring the cameras, giving Nichols the time he needed to storm into the courtroom, reports CBS News Correspondent Jim Acosta.

Local attorney Dennis Scheib said that he has warned Fulton County for years to hire more deputies.

"I've tried cases and we're in the middle of the trial and there's no deputies in there because they are so short-handed," Scheib told CBS News.

Authorities said Nichols escaped the courthouse in a Metropolitan Atlanta Rapid Transit Authority train. They said he took the train north to a pricey neighborhood where he allegedly gunned down a federal agent.

"I don't understand why they didn't have the MARTA staked out," said Maryanne Fry, a neighbor of slain immigration agent David Wilhelm. "I really wish they had."

As Nichols vanished from the courthouse, investigators focused on finding the car they believed he was in. Thirteen hours later, the car was found in the same parking garage where it was carjacked minutes after the shootings.

Once authorities realized Nichols was not in the hijacked car, they admitted they had few other leads as to where Nichols was hiding. The trail had abruptly gone cold.

Nichols was being retried for rape and other charges when he escaped. That case was declared a mistrial Monday at the request of Nichols' attorney, Friedly said. Nichols' first trial was a mistrial as well.

Nichols was only apprehended after he released a woman, Ashley Smith, who he had held hostage for seven hours in her apartment. She immediately called 911 and Nichols surrendered peacefully Saturday to a SWAT team.

If it hadn't been for Smith, who gained Nichols' trust by bonding with him over discussions on family and God, there's no telling how long the rampage would have continued, reports CBS' Acosta.

Investigators' failure to properly search the parking garage where the supposed getaway car sat unnoticed for so long, and the decision not to search the commuter trains leaving the city's downtown, left some people scratching their heads.

Commuter Carla Hill said if MARTA police had been alerted someone might have spotted him. "Someone that dangerous, I would think all precautions would be taken," she said.

Hill questioned whether MARTA's numerous video surveillance cameras were working properly. "There should be some image of him because the cameras are everywhere," she said.

MARTA spokeswoman Jocelyn Baker said investigators are still reviewing surveillance videos for evidence that Nichols was on a commuter train.

Police Chief Richard Pennington said officers had no reason to order the trains to stop running because they had no reason to believe he was not in the stolen car.

The first indication that Nichols had indeed taken the train came 13 hours after the shootings.

Officers received a report of a couple assaulted near the train station at Lenox Square in north Atlanta by a man matching Nichols' description. The man had brandished a gun and demanded money or a vehicle before striking one of them in the head with the gun and fleeing.

A police report shows that Shelton Warren told investigators he was attacked in his apartment, about a half block from the home of Wilhelm, the federal agent, when he opened the door to let his girlfriend inside and discovered a man holding a gun on her. Both Warren and Iman Adan told investigators they believed it was Nichols.

Wilhelm, 40, was working on tile in his new five-bedroom house in the Lenox Square area late Friday when Nichols allegedly shot him. His body was found early Saturday. His blue pickup truck, pistol and badge had been taken.
