As to the second question, that's a good one. Let your conscience be your guide I guess. Tx law states that you may use whatever force is necessary to protect life. Interpret that as you will.

I'm pretty sure the law would be on my side here in Fl. I just wonder how long I would hesitate and if I would get involed at all.

He can't represent the family as you say because he will be the star witness - BUT anyone else in his firm can, and any of his buddies can, and you can bet he is motivated to get something going.

If you were a witness, and as said above, saw the guy was in trouble for his life, thief or not, would you draw on the guards and protect the guy, thief or not, from death?

i'd like to think i could do such a thing. but.... i can hear it now in the courtroom. "are you a doctor? how did you determine his life was in danger? what medical training have you had?"


and on and on................... friggin lawyers
 
I don't see drawing in this situation. I think it would have been better to get in there and physically try to move them off of him, and/or to help him to his feet. Then they would have had to confront a much more persuasive thing than mere words. Words are easy to shrug off, but if someone is so convinced that you are doing wrong that they try to manhandle you, that isn't so easy to shrug off.

Imagine drawing on them, and they let him up at gun point, and of course you saved his life. But since he got up and was OK and didn't die, no one would really believe he had been in that much danger to begin with, and you could easily find yourself in some very deep very hot water.

Had one been available, hosing them all down with a garden hose would have been excellent.

As usual, Butch makes the point I was going to make. :p

Also, if this employee has him in a choke hold, and you intervene by trying to remove him physically, you could be the one to cause severe injury.
