NO GUNS ALLOWED signs????

Well tonight I went to the county fair, I went with a couple of my friends who not gun owners, but know I always carry. Anyways there is a sign at the entrance saying no firearms and no alchohol. I didn't see the sign, bu they did. Anyways, I saw it on the way out, and I said oops. They thought I saw it, and carried in anyways. I probably would have left it in the truck if I did see it. I was just wondering, does this sign have any bearing legally. I wouldn't be dumb enough to carry it in when the place was crawling with county sheriffs. It just seems dumb Anyone know????

In indiana. No they do not. Not unless it is on a place that the law specificaly sais you can not carry in. Post office, police station, etc. If you are spotted they can ask you to remove the GUN from the building, if you refuse then they could get you for treaspassing. Same thing goes for Kentucky. Although in Indiana you see almost no signs. I found it interesting.

An interesting note.
I emailed GreenTree Mall about thier policy and they said that you could not carry in the mall. But if you were spotted all they will do is ask you to put the weapon in your car. If you refuse they can then trow you out. I did point out that they have no legal recourse at all. I never got a reply back. But the attitude seemed to be "don't ask, Don't tell"

I am neither an attorney nor an Indiana expert, however, I respectfully suggest the facts in your post be double-checked. In many states, owners have the right to exclude firearms (obviously, they must comply with certain regulations regarding notification, etc.) from their private property. Violation of their properly posted prohibition breaches the state's concealed weapons laws. This is true in Virginia, and it's the precise reason certain quasi-public areas (such as shopping malls and restaurants) can bar concealed weapons even when carried by a licensed individual.
 
We have been thru this before. If your state has some type of notification clause on signs for CCW you have to follow that. If not, then it would be similar to going into a place that posted signs saying you have to wear a shirt and shoes, no pets, no guns, etc. Like Kevinw said they will ask you to leave and tresspassing is the only issue. Tresspassing is a crime. Here's what the Indiana Code states:

IC 35-43-2-2
Sec. 2. (a) A person who:
(1) not having a contractual interest in the property, knowingly or intentionally enters the real property of another person commits criminal trespass, a Class A misdemeanor.
(b) A person has been denied entry under subdivision (a)(1) of this section when the person has been denied entry by means of:
(1) personal communication, oral or written; or
(2) posting or exhibiting a notice at the main entrance in a manner that is either prescribed by law or likely to come to the attention of the public.

To summarize, pursuant to Indiana Code 35-43-2-2, if private property is posted as a firearms exclusion zone and an individual enters the area, the Class A misdemeanor of Criminal Trespass has probably been committed.

Just an opinion, but a lot of the time those signs are political in nature. Of course, your state laws might give them teeth, but otherwise they are just there to give the soccer mom lemmings a false sense of security.

I think they suck, and always call and let the business owners know how I feel. I enjoy telling them that there are almost 100,000 CHL holders in Oregon, and that they all know at least 5 people that they can influence to not shop in a "gun free zone".

In Florida, the signs have no legal standing but if they ask you to leave because you are armed (I don't know how they would know since the weapon is concealed and if it becomes unconcealed or prints, then we're talking about an entirely different situation) and you refuse then you can be charged with armed trespass which would be grounds for revoking your CWL.

But on a different note, I personally feel that if it's your property, then it's your rules above and beyond what the law says. And if a place wants to limit or restrict my ability to defend myself and does not support my second admendment rights, then why should I support them with my business? I would rather spend my money else where.
 
I am surprised that you were able to get in with a gun. I thought that "Gun Free Zone" signs kept all guns out and kept everyone safe and happy.

I guess this just shows that we need more laws and less freedom.

And if you look, many Waffle Houses have taken down their NO FIREARMS signs. They were threatened with a lawsuit they knew they could not win. Don't know who one of the anonymous callers to their hotline could have been :rolleyes:

But Hoosier Boy said we was at a County Fair and was thus on public, not private lands.

Although I am not a lawyer, it sounds as if it was a LEGAL carry.

Frankly, I don't care. If it's just a sign, I carry. If they have metal detectors and the like, if I can, I'll avoid the place like the plague. If I have to go in, I'll leave the slide and magazine in my car, and keep the lower reciever (GLOCK) in my holster.

I practice civil disobedience whenever the restiction goes against what I know is right and I have a very high degree of not being detected.

Here's what to do with malls, etc...

Leave the gun in the car. Go in. Make your purchase. Then ask to be escorted to your auto by an armed security person, explaining that since you are required to leave your firearm in the car, you expect them to provide adequately for your safety.
 
Ok I found out from a local guy who knows ALL the laws. The sign is useless as far as putting me in jail. If they find it, they all they can do is ask me to leave. If I don't then I can be arrested for trespassing.

Funny thing when I mentioned it he was quite surprised and since he is an ex-cop and is very pro-gun, he is going to challenge this to his leo friends. I hope something is done about it, not like I have to follow it anyways.

By the wya I did have fun at the democrat booth. I am young and told them I have never voted and cught there bluff on a lot of things. I had this one guy almost crying. Make sure to vote!!!!!!!!!!

My wife worked with the wife of an Orange County ( CA ) Sheriffs Deputy . According to her when they go to Disneyland he cannot carry . Many clubs tell them not to try to come in carrying . When I questioned this I was told that Disney does not want anyone but their Security to deal with problems .
I think I would want to carry in case I'm on line with my family and I see Mr. " Sent him away for 5 years " a few feet away . If he is familiar with the "no carry " policy I might have a problem . If this is true I would not be happy and would NOT go to Disneyland or any other such place .

Around here, I boycott "Outback Steakhouse" and "City Bites" diner for their No Guns Allowed signs.

Also, on a boycott tangent here, everone needs to be sure to boycott Mark Walberg and his movies, including The Perfect Storm. If you didn't catch it, a few weeks back he went out of his way during an awards show to publicly bad mouth Charlton Heston and the NRA.
 
Old Mexico is the only place I am afraid to bring my guns. Thank God they put a parking lot just on this side of the border so I can leave them in the car and walk.

I am not sure about Oklahoma but in my state, if a sign is posted, then you better leave the piece in the truck. I would suspect, though, that most county mounties would understand the mistake and would do nothing. If it were the full-grown bears, though, you are messing with fire.
By the way, this is my first post on this forum. I was invited by KaMaKaZe from the AccessAtlanta forum on gun controls. I am sure more of us will migrate over to this forum from there since some of the posters were pretty lame.
