Massachussetts Gun Laws

DannyO: thanks for your service to country.

In your defense, my understanding of this MASS disaster is that it flew under a LOT of peoples' radar. The AG basically declared this ban by executive fiat, bypassing the legislature and courts entirely. This is a complete abuse of executive privilege imo, and people should be outraged.

Not only did it take effect immediately, giving customers, retailers, and manufacturers NO advance warning, there is no period to come into compliance. In fact, it's retroactive. What an A--hole.

It seems to me that the NRA said too little too late. Anyone disagree? I absolutely would not live in a state run by fascist tyrants like this. I'd like to see their heads on pikes at the city limits. How can people in the cradle of liberty of this great country (albeit confused lately) tolerate this? I am shocked.

If you reside in Massachusetts and are a firearms owner, and the recent court decision which allowed the Bay State Attorney General to implement this horrendous legislation under the guise of "consumer safety," caught you in Condition White, then the original poster, "Masshooter," was most assuredly correct in suggesting that you are part of the problem. And no amount of truculence on your part, or brandishing the honorable trappings of the eagle, arrow and globe (with attendant mindless "Attaboys!" from other tribal members), is going to obscure that fact.

This is not a shot at the Marine Corps, it's a shame on you for your posturing rather than sucking it up and acknowledging "Gee, I guess I might be part of the problem after all… I think I'd better get involved."

I don't live anywhere near The Bay State, but I damned sure know what's going on up there, for things like that have a malodorous way of propagating Westward.

Peter,

I hear what you're saying, tho i don't entirely agree. Some of us (like me) are fortunate to have a computer/internet on the desk at work, and can monitor TFL and RKBA information as we work (ahem!) Some of us are on all the mailing lists, belong to grassroots groups etc. Some of us just don't have the luxury of time, resources, hardware, or disposable income (for me it's worth the sacrifice). So, while I think ALL gun owners need to fight harder, some do more than others. I know that I don't recruit or proselytize as hard as I should, and that's part of the problem.

We are a sleeping giant... I hope we wake up soon enough. We also have a factional problem... skeet shooters who look down at IPSC shooters and won't speak up for them, muzzleloaderss who don't know why anyone needs an AR-15, etc. Guns is guns. We are a tribe, and need to start fighting AS A GROUP for our rights. imho.

Heads up, guys. Yeah, basically the AG has outlawed all -- that's ALL -- handgun sales in Masschusetts, at least for now. Some pistols, like the classic SIGs, will never, ever be able to be sold in Mass. unless the legislature repeals the regulations.

First, for those in Massachusetts, GOAL (Gun Owners Action League, the leading state RKBA ass'n) has been publicizing this since 1997. This was basically a foregone conclusion as of 12/30/99, when the district court held that the AG could implement his regulations effective immediately. This should not be news. If you don't belong to GOAL, join now. Your membership is important. Go to www.goal.org.

Second, for those not in Massachusetts, beware. According to many different media reports (probably all based on the same source), 34 -- 34 -- state AGs have essentially identical regulatory powers. This is the latest wave of attacks on the Bill of Rights and civil rights. Don't smirk -- get active, yesterday.

BTW, folks, this has been all over the radio, the TV and the newspapers in Massachusetts since Monday -- if you only found out about it today, you must really be on radio silence.

I'd sure appreciate an answer to my question. Mass. has a Republican governor...does he have no power over the AG or is he an Anti as well?

DannyO-
Thanks for your service. You wouldn't believe how long it took me to learn of the S&W deal....just got by me. These things happen.

Certain others...
Anyone wanna send this thread over to HCI? They can use it as a "poster child" ad regarding what the shooting community "really" looks like: foul mouthed, angry men and women who don't even respect each other!

Think twice, post once.

Danny O,
HOOOAH! (maybe it's just an ARMY thing) ;) Nothing wrong with learning my friend. Thanx for your service.

Suggestion to everyone who hasn't done so:

You can subscribe the NRA-ILA (Institute for Legislative Action) e-mail alerts AND set up your own "My NRA-ILA" home page (like a Yahoo home page) at:

I get the e-mail alerts daily thru CalNRA. They're very informative, and include breakouts for individual state news.

Now, I gotta go watch BraveHeart, and enjoy my kinsmen kicking some tyrants'tails. :)

I agree with schmit. I also admit to letting my guard down on this one. I should have and now will be spending more time communicating with my elected officials. I can honestly say that all of the gun owners that I know in this state are hard working, pay taxes, contribute to charities and make every attempt to complie with the laws. I guess the bottom line is on the whole we are a good constituency that at this moment in time is not politicaly correct.

Another problem with what is going on in Ma. is that it could set a precedent for other states use to ban handguns.

It is time for Civil disobedience,
When prohibition was passed my greatgrandfather made copper stills in his basement, He was a sheet metal smith for the pullman palace car company.

A mass rally of gun owners in Boston in from of the old customs house with guns worn openly.

Time for a new million man march on the State house. Maybe the media's attention could be attracted to the constitution if the NRA were able to organize protest marches in every state capitol, and the gun owners side of the story could be told.

But this of course won't happen because people who own guns are also sheeple.

Wow I know there was a ruling in 1842 that said a state could regulate the manner of wearing of a firearm but it seems unconstitutional to interfere in its design, or to interfere in interstate commerce.

I think the Mass governor should lead the way and have his personal protection detail get rid of all of their unsafe firearms.

I will email him and suggest they send all their glocks and sigs to me for disposal.

The news is worst than I first anticipated.
I went to my favorite gun store last night and found out some horrible things. They took all of their semi autos out of the cases. The only handguns they can sell are revolvers with barrels over 3 inches long. The only semi auto handguns they can sell are 3rd generation smith and wesson. There was a guy there who had to cancel the sale of his sig because he had to wait a few days for his nics check. When he came back to the store he was told they could no longer sell him the pistol. He was PISSED! I asked the owner what he was going to do with his "newly illegal" semi autos and he told me he is starting to like the taste of metal as he was eating his inventory.

I wonder if a gun dealer can make a "private sale" ? Is this possible?
This is all Reily's fault. That sob is enforcing Harshbarger's 98 ruling.

Its time to unite and appeal this bitch.
I was going to buy a 1911 with my next paycheck. Looks like I'll be driving to Maine.

Well, we don't really have those laws...and incest isn't really that rampant.
We just tell you all that so you won't move here...
Bad enough we got all those Marylanders moving up here. Of course, they may be refugees from Commisar Glendenning and his socialist friends and lackies.

The East and West Coasts are hopeless. Move to the South where freedom reigns. TX,GA,AL,MS,AR,OK-----all favor a person's right to keep and bear arms. I have it first-hand that one State in the South would consider secession if the Marxist Pigs in MD,MA,NY or CA try to shove this crap down our throats. Funny how history repeats itself isn't it? This time, we would be on the right side. I truly feel sorry for you guys in MA but I could care less if I ever go there. Keep pushing Uncle same just keep it up. The law-abiding have taken and taken and taken it on the chin in all aspects of liberty-----not just on guns and we are about to be backed into a corner. I wish they had guts enough to go after the real culprits but they don't instead, they go for easy targets like us. No I don't wear fatigues and I am not in a militia but I'm sick and tired of the courts subverting the rule of law and quite frankly, I'm sick of these sniveling attorneys running around like mad dogs every time an acident happens or a law is passed those scum don't agree with. And while we are on the subject, if I sell a tract of timber or a vehicle and have $10K in my wallet it is NONE OF THEIR BUSINESS-----PERIOD. I hate drugs and those who push them and I refuse to be treated like a criminal by these sap-suckin' son-of-a-guns. I have tried to be civil in my posts since becoming a member but I have had enough of this horse crap. While we are on the subject: BOYCOTT SMITH & WESSON!!!! DID YOU GET THAT RENO,CLINTON and SCHULTZ!!!!

Rich,

Did you read my posting before calling me "foul mouthed"? This Mass. thing has been in the courts for at least 5 years, and a decision was bound to come some time. It should have been no surprise to anyone when it came or that it came the way that it did.

Jim

FYI The governor of MA is a republican (Paul Cellucci)who applauds what the AG has done. Cellucci even said he doesn't care what the affect of the new laws is on gun dealers!!! The republicans have sold out big time to the liberals. Timing is everything and the action of the AG comes at a time when the nation has had it with kids and guns shooting other kids. The average person out there is so angry they can't see straight. To restrict gun sales under consumer safety laws is ludicrous but these guys know that the time is ripe. With respect to the method being used to end gun sales it's absurd, but by the time it's argued in courts the dealers will be out of business. There are virtually no guns out there that are "defective". The reason is they are one of the simplest machines around. You pull the trigger and this action alone fires a cartridge and sends a high speed projectile out in a specific direction and in a fairly straight line. That's the way they have always worked. Still you need judges who can see straight to rule correctly on this.

the problem here is that these anti's know that a direct assualt on the second amendment would fail and they have started using the backdoor. we lost the right to keep full autos without excessive government intervention due to the same process. while many would fight for the 2nd amendment they feel that the government has the right and the obligation to protect us from poorly made or defective products. beware, what industry will they litigate out of existance next? will will have to do without chainsaws, lawnmowers, weed eaters, ladders, powertools, cars, you get the idea. these products mame and kill more people every year than guns do and they are already highly regulated. as all of you know there is a particle of risk in everything you do. even just sitting doing nothing will eventually kill you from obesity and heart disease. personally i will accept a little risk for the freedom that comes with it. soon we will all live in a bastardized society in which we will only be able to get generic, idiotproof products. cars that won't pull a greasy string out of a cat's ass, user safe and useless tools and enviromentally safe and impotent solutions. a "safe" gun is a paperweight and these guys know it. even if they can not get our guns we have now they will basically dry up the supply of new legal guns, make transfer of unsafe guns illegal and dry up the supply of ammo as a inherently unsafe dangerous product. i can only hope the first generation of safe Star Trek phaser type stun guns arrive before or kids get killed by a bad guy carring a good old fashion unsafe pistol.
