I live in Illinois and i am 20 years old and i do have a FOID card. I am aware that i cannot buy a handgun from a dealer, but is it legal for me to own one? My father wants to buy me one as a Christmas gift. And if so does he need to say that it is for himself while he is buying it or is it okay to say that the gun is for me?

Thanks!
Trevor

Hello. Yes your father can legally buy you a hand gun for Christmas.
You can legally purchace one, just not from an FFL.
He is buying the gun for himself, as a gift to you.
He is not taking money to buy a firearm for a prohibited person, known as a "straw purchace", which would not be legal.

Someone will probably come along and post the regulations for you, but they are here if you can find them.

Oh, Merry Christmas!

I thought you could only own rifles or shotguns until you were 21 in IL. Otherwise, how would you even get a FOID if under 21?

Easy. Have your parent or legal guardian provide a written consent. And you still have to have a FOID card for rifles and shotguns....and ammo.

can't buy rifles or rifle ammo until 21 but can buy shotguns at age 18 i believe or something like that. were in illinois you live at im in central illinois too.

I live in northern illinois and I can buy rifles and shotguns. I did need my parents signature to get my foid card.

I'm going to buy my daughters Chipmunk pistols. They are 8,9 and 11. And I'm also going to get them FOID cards, when I get the time to go get their pictures taken.

The FOID card really doesn't mean much, but I thought it would just be a neat thing for them to have. :)

I don't see the problem.

Are you afraid of getting pulled over on your way to or from a range with the pistol?

No I was just wondering if it was legal. I found a page saying that I could transport it to and from the range but nothing about owning one. I called my local gun shop and they said as long as the gun was sold to my father and then gifted to me after we leave the building then it is perfectly legal. Its going to be kind of a pain in the you know what(don't know if swearing is allowed on this forum) not being able to buy ammunition but I will figure it out!

Thanks everybody!!

Oh and countzero about your daughters foid cards, my local gun shop sends in the foid application for you including the picture for five dollars more. Maybe yours does the same?

$12 to $22 depending on the shop.

I asked at Gat Guns once and I remember it was pretty expensive. I went to the mall and paid $3.00 to get my pictures taken in a photo both and sent that in with my renewal.

In the case of someone who has a driver's license they actually use your DL photo, but I guess for kids they would use the photos you send in.

good grief

You need a special card to buy a gun?

I was in St Louis last week, looked across the river at Illinois and jokingly stated..."enemy territory". Now I'm not smiling.

I agree Illinois has ridiculous gun laws. No open carry or concealed carry for citizens! All that is doing is stopping the law abiding citizens from having guns when they need them. Because the criminals don't care if it is illegal. It used to be Illinois and Wisconsin but i'm pretty sure Wisconsin finally passed their concealed carry bill. Stupid Illinois -.-

I always tell people to wipe their feet real good before crossing the river-they don't want to get any of this Ill-annoy nonsense on their state. :D

I wish somebody would drag the nonsense out of illinois. Another random question about illinois law to tag on to the end of this post. If I am going hunting is it legal for me to open carry while I am hunting for my own protection?

NO. You will get a big ticket and possibly arrested/ confiscated.

No.
Do not do that.
Nobody else wants it.

Have you thought of dumping it all in a big pile in Chicago and telling them to deal with it? It came from there, right?

Excellent idea!! I had heard splitting the state northern & southern. You are correct Chicago is the state capitol I don't care what Springfield says.

My solution is to leave this hole as fast as we can. Illinois has a great exodus people & companies are leaving as quick as they can. On a side note if taxes, welfare, politics and crime is your cup-o-tea, it's a good place to be.

Illinois- it's a great place to take a dump.

A straw purchase is not the same thing as providing a firearm to a prohibited person. They are two separate offenses. A straw purchase is illegal regardless of whether the receiving party can legally own the firearm.

If your statement is taken at face value, it could imply that purchasing a firearm for someone in return for compensation is legal if the buyer believes that the receiving party can legally own it. This is not the case. It's still not legal.

Don't feel bad- I'm not picking on you personally. This is a frequently parroted misconception that I like to correct in hopes of preventing some well-meaning person from inadvertently putting themselves in serious legal jeopardy.
Nobody else wants [the nonsense]... Have you thought of dumping it all in a big pile in Chicago and telling them to deal with it? It came from there, right?
Weigh it down and throw it into Lake Michigan. Duh. ;)
