Had Swat Called On Me Today...

I had a funny feeling about shooting today... with everything that was going on on. My friend literally JUST picked up an m&p15 and wanted to try it out...so we loaded up and off to my range.

My range is on private property and is 40+ acres. I've been shooting there for years without incident...my juristiction has no laws against discharge. I've had the police to my range ONCE in all the years becuase they recieved a call. A single officer in a crown vic arrived checked my credientials and left me to my target practice.

Today..didn't go the same.

I'm parked at my range behind the bed of my truck where myself and a friend are loading magazines and i spot two officers approacing approx 75 yards away. I tell my friend and we put down everything we have and step away from the tailgate. The officers motion us to come towards them so we begin walking that way slowly.. I even yelled "hello" to them. They were just walking up in a casual manner.


we get to about 30 yards from them (again us walking casually toward them, and them walking casually toward us) and then they draw down on us and yell "hands up" very shorty after 3 more officers round the corner (about 50 yards from us) and draw down as well as 2 officers in full swat gear sporting m4 carbines. They get to about 10 yards ands tell us to turn around. I informed them this was private property and was told "don't give me any private property" what he meant exactly is still unsure. with hands up and facing away from them they (with guns still on us) ran our pockets and threw my keys, phone, empty pocket holster, as well as a few other belongs on the ground.

We stood that way for about 2 minutes until the prosecuter arrived. At wich point we were instructed to pick up our belongings and follow them over to the tailgate where the guns were.

They asked us for id's and we supplied. at this point they realized the name on m LIC matched that's on the posted signs and their attitudes changed drastically.... from then on they were very nice. They asked us what we were doing and I replied target practice. They said they recieved a call of automatic fire and I assured them all our guns were legal and i told them they could fire them. They removed all the mags (man did they have a hard tim figuring out how to) wrote down all the serial numbers aqnd basically told us to have a nice day and left. The whole ordeal took maybe 30 minutes. They didn't fire any of our guns or check magazine capicity. (all were leagl of course)

They basically blamed it all on the events in CT... guess thats an excuse to violate your rights. All in all the only thing im upset about was them taking down my serial numbers.... thats really none of their busines. but since they were being nice i didn't give them a hard time...but i also didn't give them permission.


having many loaded guns pointed at you at once is not a fun thing... i really must say.
 
I do think things will get worse. A lot of sheeple trying to be do gooders. The cops will start to over react a little too!30 years ago never a problem of shooting all day long. Now days someone will get all worked up if they hear a fart!
 
Yes, you should file a complaint. Them drawing on you for a legal activity occurring on your own property is not acceptable. There was no reasonable articulable suspicion that a crime was in progress and once they knew you were the land owner they should have left immediately. Really they shouldn't have even responded to the call as automatic fire on private land isn't something worth noting.
 
My concern is, I live in a small town in a VERY VERY anti 2nd amendment state (IMHO the worst in the country). If i ruffle feathers several things could happen..

#1. They pass a "no discharge" ordinance which most of the state already has. If that happens I'll be completely screwed and not able to shoot on my land at all

#2. i see these cops every day.. Last thing i need is to be hassled (most concerned with motor vehicle violations) or risk more hassle while out shooting.
 
Makes me wonder if my range will be there next time I go. It's outdoors and actually inside the town limits.

Basically it's been there so long that it was grandfathered into all the ordinances that came after it.

But as 2 others have said, this would not end just because they left and were nice to me - both things I expect on my own property.

auto weapons are illegal in the wonderful state of NJ...

as well as collapsable stocks, flash hiders, bayonet lugs (on semi auto applications) magazines with a capicity more then 15 amd several other things that just plain make me angry when i bring them up:mad:

If you file a complaint, for their wrongful and dangerous actions! Then they continue to harass you have real good case.
What they did was wrong and unreasonable.
 
I had a neighbor start yelling about me shooting, threatened to call the law. I yelled back something about the 2nd amendment and that he wouldn't have to call them because I would.

So i called the local police and explained what was going on. They sent an officer out and she very kindly explained that as long as I am shooting in a safe direction that I am free to shoot whatever I want.

I have heard nothing else from the neighbors.

What happened to you is a bit more extreme, even if they were "just doing their job".
 
My first demand as landowner would have been "Show me your warrant"...

No warrant?...At that moment all conversation and cooperation would have ceased other than "I consent to no searches, I want you off my property immediately, and I wish to talk to my attorney now"...

They are on your posted land illegally with no probable cause...

And it sounds like they knew it...

All just my not so humble opinion, of course...
 
I understand what the OP is saying. You probably could have Demanded a warrant, or push the issue about your legal rights, but sometimes it's better to just stay calm and let the situation die quietly. The old adage win the battle, lose the war comes to mind.
 
Yep, get a hungry mean lawyer. File formal complaints
against each one and the department. Seek damages
and see what kind of settlement you can get. The only
way to stop this kind of mis use of power is to make it
very expensive for them to continue.
 
I would not have let them take the serial numbers down. Since it was your property I would have told them to hit the road unless they had a warrant. Following that I would go to the station and file a complaint how officers came onto your property with their guns drawn on you based on a call from who knows who.
 
I have a really bad feeling things like this are going to happen more and more, and without reprecussion unless you are rather wealthy.
 
I agree if LEOS come onto my property, I am not holding a gun and they draw on me when they leave will not be the end of this. That prosecutor sounds like he was looking for ANYTHING to stick you wish, but he didn't find squat. I would file a complaint and consult a local attorney. This type of stuff shouldn't be happening in America.

Heck dude you are in NJ; you are lucky they didn't cut you down, plant illegal guns on you and make up some stuff about how you "challenged them".

It is very important to protect yourself legally speaking, I suggest you install security cameras around your range to document any future encounters. Before doing that though ask that same attorney about recording laws in NJ.

Oh and lastly...if you have a dog maybe chain him up when you go shooting; just google "SWAT shoots dog" and you will see why I am saying this.

Its sad this is what America is coming to but if you value your safety and freedom it is best to take steps now.

Them writing the serial numbers down bothers me almost as ugh as you saying they drew their firearms on you, on your private property. This is the EXACT reason we as Americans cannot be unarmed. We have lost a lot of our rights (Patriot Act and other ways), I have seen too many times when police and other law enforcement agencies(disarming homeowners during hurricane Katrina) have overstepped their boundaries. Just my $0.02.
 
From the way you worded your story, they were there before you and set up waiting for you???

BTW, I am also in NJ and 609
 
I am not a litigious person but I think a few phone calls to an attorney might be in order. Especially, if it is on private property and the way things were handled.
 
That was quite an experience, and on your property.

Thankfully, our range has many members, and is used monthly by members of city, county, state, and federal LE.
