Disapproved for firearms purchase

Yesterday I tried to purchase a 22 rifle from
my local gunshop which I have used on 5 previous occasions. I have a concealed weapons permit and no criminal record, not even a parking ticket. I was turned down
for the first time with no explanation as to why. Needles to say I was very
distraught. It was close to 6 pm and the FDLE operator was probably about to go home, so he didn't feel like checking and dissaproved me. I had to send in an appeal with my fingerprints. What a crock of @#$%.
This process takes about three weeks. Has this happened to anybody else out there? What
were you're experiences like? I am very disturbed by this whole affair. This method could be used to discourage others from purchasing firearms who would otherwise be legally allowed to do so but don't want to go through the hassle of appealing. Something needs to be done to refine this National Check! Sorry for the long, unrelated post, I'm just frustrated.

I don't blame you for being ticked.

Here's a suggestion: In addition to filing a written (letter) compliant with Florida's Attorney General, I would send very similar -- and very polite -- letters to your state legislators and the chairman of the applicable legislative committee(s) that oversee the budget for the AG's office and whatever bureau manages the computer checks.

At a minimum, legislative inquires will expedite the process of getting your approval. At the maximum, they may drive some enhancements and reforms.

The key point is simple: Bureaucrats subsist from legislative appropriations. Accordingly, they must be cooperative with members of the Florida legislature (both chambers), or risk budget reductions (which translates to less influence).

That sucks. If you got you CCW permit before Nov. 98, you are exempt from the FDLE unconstitutional bulls**t. It says so right on the back of the 4473 yellow form. I made the dealer not charge me the 8 bucks last time I bought one. I have heard of some dealers sticking that money in their pockets. Anyway, good luck.
 
In Arizona, if you have a CCW, you do not need to go through the background check. It doesn't matter when you got it.
 
One other, less nasty possibility, is that the store employee made an error in submitting the request? Or that the system was busy? Twice in my last 3 purchases, I have not been able to get an immediate reply from the system. Was told tht meant they had 3 days to DISAPPROVE me, otherwise I was automatically approved. One time, near Christmas/Y2k, they never got back to the store so I got the gun by default. The other time, the approval came in the next day.

So maybe that's what happened, but the store employee was too dumb (or in too much of a hurry) to explain that whole situation.
 
I'm not sure if Illinois uses the national database or our own, but here it's common to be denied and then approved with a second call a minute later. I've had this happen myself, and I've seen at least a dozen others go through the same thing. The most common response to a denial in Illinois is just to call again. Since they don't give a reason for denying the purchase, ( :mad: ) I've never found out what changes from the first phone call to the second. I'd say go back and try it again when you get the chance.
 
In Indiana we also don't have to do the NICS when we have a CHL I bought one the weekend of the MMM and walked out in about 5 minutes. I would write a letter ot get the name of the person who denied you maybe you can sue for defamation?

The store clerk did not make a mistake. He has done this many times for me personally.
The store manager called back a few minutes
after it happened and told them that they had
made a mistake and he vouched for me personally. He even asked to speak to there manager which told him "sorry, he has to appeal it" The incompetence and error lie solely with the idiots at FDLE. The person who disapproved me is probably as incompetent as they come. When quitin time is near they
would probably dissaprove the governor.

Have you moved recently?

I bought many guns with no problems until i changed my address. About a week after i moved i went to buy a rifle and was disapproved. I had to wait the 7 days (Maryland) and since NICS never got back to the shop with a yes or no, they were forced to give me the gun. A friend had the same problem.

Silly laws. As if im going to become a criminal because i moved.

A few weeks ago the Tennessee Bureau of Investigation's computer was down so I had to wait for a few days until I could pick up my Glock 35. On the fourth day I showed up at the shop and though my approval had not come back yet the law says that after three days the shop can use it's discretion to let the purchaser have the firearm. I have purchased about 12 guns from these guys and BSed with them a lot so they were comfortable with letting me have the pistol. That afternoon I take off for vacation. When I return a few days later, there were several messages on my voice mail asking me to call back ASAFP. When I call back on the next business day, they tell me that everything is cool now but the day after I had picked up the gun, TBI had DISapproved me. The guys knew it had to be a mistake as I was a recent recipient of a Carry Permit and I had purchased so many arms from them before. TBI called back right before the close of business that day admitting that they had indeed screwed up and I was good to go. Must be someone out there with a similar name and social that is bad news as it always seems to take me longer to be approved than most others. Aren't "instant" checking systems wonderful?
 
I don't see why you were turned down. It should have been approved with no NICS check due to CCW permit. At least that's how it works in AZ and ID.

At least that's how it works in AZ and ID.[/quote]In Florida, if the CWL is issued on 12/98 or later, you still have to go through NICS -- I know because I midded it by only a couple of days (I applied for it in 10/98 and the actual issue date was 12/98 -- missing the cut-off by only a few days). Although, with a valid/current CWL, I don't understand how the NICS could turn somebody down. If there was a valid reason for the reject, then the CWL would have been revoked as well, Since that didn't happen, I can only assume that there was some screw-up somewhere. What would happen if you went back there and tried it again?
 
If you were issued a CCW in FL after 12/98, the only thing you're getting out of is the waiting period. You still have to do the FDLE background check and pay the $8.
 
Yeah, I used to live where a carry permit equated to no background check. Pain in the butt now. Seems like if I went through all the hassle of obtaining a permit for my Constitutional rights, there should be some extra benefits. > :(
