I guess they (the LEO's) didn't wait because this was an "armed criminal" call so they didn't know if he was still a threat, going to become a threat again, etc.. And I'm sure that they didn't know that he had company at the time (assuming that the LEO's couldn't see inside the place due to closed blinds, second floor, etc.).

You might be sure, but you'd be wrong. ;) According to the story, they were told that he was in the company of another person (the apartment's owner), and given the lack of indication he had a partner, they had to operate under the assumption that the other person wasn't involved.
 
A tragedy, but I think probably a good call on the part of the DA to call it justified.

On the other hand, comments that come up from some LEO's on this board sure disgust me -- you might as well call in an artillery strike, since your only criteria is your own saftey and you value the safety of bystanders not at all. :confused:
 
Just for the record.... I have to read and say what I think, I'm not becoming a sheep or such, just trying to think these things out according to the replies:

They were told that he was in the company of another. By the apartments owner or with the apartments owner? As for the partner and the lack of indication, what would you think? That the person wasn't involved or was there to share the "profits" of the night? Too many variables and some LEO's do wish to get the scum off the streets, when they have cause, before they can harm others (of course, I just wished the law would allow the people to do the same when confronted with a BG without having to worry about their future).

I've tried to look at this from all sides, and I'm still hard pressed to blame the LEO's on this one. I place the blame on both sides, the stupidity of the mother, the really stupid acts on the male, and the thought of why a child was even present when she should have been in bed, that is debatable on the why.

I'm not finding the people in the apartment as being "law abiding citizens", they all knew something was up, with maybe the exception of the child.
