Same here and 12 of mine were as the investigator for a Prosecuting Attorney. Of course all that exposure was to Criminal Law and not Civil.
 
The answer is: nothing will save you in civil court if you hit the dogwalker (or not...court can go either way). Don't mess up and it won't be a problem. The long story is try to know what's around the target and change the angle if you need to and have the opportunity. You may just have to take the shot--we cannot dictate the fight and stuff happens. Would you rather die on the street NOW or *possibly* be sued into poverty later? Why carry a gun if we let the fear of court paralyze us when action is necessary?

For many years I have lived in a very gun friendly part of the US and will not change that. Nothing will absolve you of negligence or recklessness, however, my current home state (North Dakota) offers civil immunity in cases of self defense.

We're I to use a .44 Mag revolver for self-defense, it would be loaded with .44 Special ammo.

Sight picture retention is crucial. Recoil & massive muzzle flash greatly harm sight picture retention.

Well I am one of those guys that actually shoots my magnums. I reload by the bucket. I would hate to think how many tens of thousands of rounds of magnums I have fired. I have given up on the ScTi revolvers for heavy use. I actually shoot magnums in IDPA, It is hilarious to watch the other shooters take 2 steps back when I shoot. I at least double up on my hearing protection when shooting. Even though my hearing is shot from growing up shooting with no hearing protection (1960's) and the Army.
