1. Rove and others have been using a www.gwb43.com email account for the majority of their official white house communications.
2. Under the Presidential Records Act this is illegal. Presidential communications are required to be archived and kept under this act, which was created following Nixon's presidency.
3. The House committee on oversight requested the emails on the RNC server for use in their investigation of the ongoing GSA scandal, which concerns an illegal violation of the Hatch Act.
4. White House says whoops we deleted them our bad.

I don't know what to think of Leahy in general but here are some comments of his comparing this to the Nixon tapes.


Having worked in IT for a while and having been interested in computers since before puberty I can tell you with absolute certainty that those emails are recoverable. I've seen data retrieved off hard drives with bullet holes in them, there is no way those are gone. They are flat out lying

Not at all. They could have willfully destroyed evidence. Regarding this administration's ability to lose documents: Glenn Greenwald goes through the many times this has occurred.

Lost documents in:
- USA Firing paper trail
- Jose Padilla interragation video
- Memos to and from the CIA and FBI after 2003 regarding torture
- 2,000 pages missing from congressional report regarding Abu Ghraib
- Gaps in Bush's Air National Guard

An anonymous lawyer's opinion (we'll see how well this stands up when this scandal gains momentum):
As an attorney who deals with subpoenas and requests for electronic documents on a regular basis, I can tell you that if a private entity--particularly one subject to legally mandated record keeping requirements--were to inform government investigators seeking such documents that they had been "mishandled" and were now "lost," that entity would immediately find itself in a world of hurt and would be lucky if it survived the aftermath.

No amount of talking would be enough to convince the authorities that there was an innocent explanation for the missing documents. They would be absolutely convinced that the "mishandled" documents were intentionally destroyed in order to cover up wrongdoing.

Here's an article from the Christian Science Monitor discussing White House email in 2000. Note that it underscores the fact that White House staffers are intently aware of their legal obligations.
 
True. :o No one can accidentally run one of the numerous applications that intentionally wipes and rewipes a hard drive of it's data, including the latent magnetic traces.

If they willfully destroyed evidence then they're still lying. If they accidentally deleted the emails then as long as the drives themselves are intact they are recoverable.
 
Worse than Watergate. I'm really amazed that dubya is still in office and the bait and switch continues to work for him. Yellow cake, 9/11, gay marriage and "sorry, we'll try to find the lost emails for you" must push buttons for some one. Global dimming is in full bloom.

Obviously, it does not matter that the President can fire any and all US Attorneys just because he didn't like the way his fried eggs were prepared. There is no scandal other than the behavior of the House democrats.

Just because something is legal does not mean it's proper. And just because he's allowed to do it does not give his staff the authority to circumvent the law, which they have clearly done. There is plenty of scandal from the Bush administration as well as House and Senate Republicans in addition to House and Senate Democrats. None of it is excusable.
 
Not even sure if it was legal. If it turns out they fired us attys to obstruct investigations or prosecutions, that's like, really really bad.
 
Don't get me wrong---I do not blindly approve everything the Bush administration has ever done. On the other hand, I see the democrats fishing for anything and everything they possibly can to avenge the impeachment that Bubba Clinton brought upon himself and to regain political ascendancy. There is hardly a thing the democrats are doing in order to regain power that is not extremely harmful to the country. They do not care one whit what kind of country America becomes---as long as they are in control. But then again, marxists are pragmatic to the extreme, now, aren't they?:D

Seems to me like evidence is mounting that the act of firing them was possibly illegal due toi the fact that it was done for the reasons to either prevent the indictment of republican law breakers or promote the indictment of democratic law breakers.

Add the fact that they have been willfully breaking the law regarding the exchange of secret information via a private e-mail service and then deleting information and it starts to look even worse.
There is hardly a thing the democrats are doing in order to regain power that is not extremely harmful to the country.

For my part, some NBC/ABC/CNN "journalist" and James Carville won't get away with pissing on my leg and convincing me that it's raining.

My daddy's a Republican, and I still say this whole thing stinks to high heaven.

The question I have is if the president had the authority to fire attorneys for any reason, and there's no way that misconduct could have been involved, then why all the effort to obfuscate the issue on the White House's end? You'd think they'd have nothing to lose by just being straight, no? Not like they're up for re-election...Cheney's not even running.

When Clinton was in office, I thought he was a disgrace. Dubya has forced me to re-evaluate. G. Dubya has done more to improve Clinton's legacy than any Democrat.

Carl Rove can't be touched because he knows where the bodies are hidden. :p

I'm a leftist because I don't like it when my president and his staff break a law that was specifically designed to retain those checks and balances the founding fathers intended when they wrote the Constitution? :confused:
 
I guess I qualify as a leftist too. Years ago I mighta been called a Goldwater Republican but those halcyon days are long gone. By todays right-wing standard Goldwater would be called a liberal, just as he himself predicted. Let's face it, we've watched a six year criminal rampage and it's time to put some people in jail.
