What he did was call the police back and they said no do not discharge your weapon but they would not come out to either kill it or move it.
This scenario/question is often posed to our county DNR officer and that is his standard answer. ... :)

Sadly there are times when things like this happen and that's about all you can do... .. :)

Be Safe !!!

I guess it all depend on where you live. Here in rural Colorado many of us just drag the 22 from under the seat and take care of them. No use letting them suffer till an officer arrives.

Besides the issues with legality, shooting at point blank range using concrete or asphalt as a backstop is a serious safety hazard.
I guess the "safe thing" to do in this case would be to back the car up and finish the job...

#1 just because an LEO says its unlawful does not make it so. Many are very knowledgeable of the law many more are not at all.

#2 morality dictates my actions much more often then laws. I'm the one who has to live with my actions.

The location of the original incident isn't clear. But first and foremost, I think using a gun is a bad idea, unless you're way out in the sticks. I live in an area where many deer are hit by cars and I recently posted the story of one such case that wound up in my own back yard. As I mentioned in that post, I live in an area that is "thickly settled" and shooting would be considered dangerous. Just that same, that's what the animal control officer who takes care of such things did and with a .22 rifle. This deer, which I'm pretty sure had two broken legs, still managed to get itself off the road, through my fence and when the officer approached, was still trying to get away. According to the officer, there was no objection to my killing the deer provided I didn't use a firearm.

I just waited until the idiot behind me hit it. He had a big 4x4 and kept going. Wasn't sure if it was dead before, but it certainly was afterwards.

the road we were on was not a highway or anything but sees its fair share of traffic. if the deer (which could not get up) was left there another motorist would have hit it for sure plus it was at dusk so then comes in the copmplication of visibility.

I stand by my friends choice and would have done the same

Does Kentucky not have Game Wardens that can be called instead of the local Police?

Around here, you could easily spend 20 minutes of phone time before you get to speak to an actual living human cop; or more likely receptionist.
If you are being raped, mutilated, AND murdered, they may send someone over that evening, but it will take awhile.
Injured deer in the road--- or most anything else, you better take care of business yourself. jd

My grandfather was a tightwad when it came to hunting bullets. Came from living thru the depression I suppose. Always bawled me out if I used a bullet to put down a wounded deer that could be walked up on. He taught me how to come up from behind on a injured deer and put your foot on their shoulder while grabbing their ear/rack to cut their throat. No way they can reach you with their feet or horn without throwing you safely off first. Since he died(about 40 years ago) I have always used another cartridge. Sorry Gramps.:o

Sometimes when you kill things, it doesn't go well. I put two bad shots on a forked horn buck one time, one of which broke his back. He was bleating like a wounded goat, and I wanted to kill him quickly without shooting again.
I was able to straddle him from behind, and got ahold of his left horn with my left hand. I felt that I had him in control, but as soon as my knife touched his neck, he jerked his head back and almost stuck the right horn in my eye.; and I mean CLOSE!! I fought with him a bit, and got a better hold, and got the job done, but DAMN, that was close.
Be careful with these critters. They are unbelievably strong and quick. jd

This situation is exactly why a truck/trunk gun is useful. CCW worked though. I think your friend did the right thing and I'm glad the cops agreed.

we have DNR officers that respond if called by the police. They wont come out unless it is requested by an officer.

The deer I have mentioned had two broken legs (the hind legs), yet managed to get around. I don't know where it was hit (it wasn't in front of my house) but it somehow dragged itself a fair distance. Even a rabbit will do that, only I think there are more deer than rabbits around here.

I've always plunged a knife into the heart, they don't jerk around or fight as much as they do when you cut their throat.
