turning firearm to Peace Officer on traffic stop = Part 2

From what I've read up on in Colorado, the "Game Wardens" have as much "search" powers as anything else on the planet.

I've two takes on this whole bit ...

1. As ex-LEO, I can fully ubderstand the "everybody" (& that includes me as "just" a citizen) & you (the LEO)) goes home tonight mindset & fully agree.

2. That there are some who would disarm me to satify their "safety margin" for no cause other than that perceived "safety margin."

But & too, I still haven't had the answer to the question of how.

Scenario: I get pulled over with an out-of-service tail light, dome light's on/hands on the wheel, LEO at driver side window w/"strong-side low" ;) officer covering me from low, right rear (standard practise) "Yes, sir, I am a holder of CCW & have a BHP/strong-side holstered, chambered round & cocked/locked. How would you like me to proceed?"

If LEO is "uneasy" with me at the moment (for whatever reason) ...

1. Will LEO have me hand it to him/her?

2. Will LEO have me exit the vehicle, I get to assume the position to be disarmed?

In #1, the "initiator" (me) has the initiative & could engage driver's side LEO with (a great degree of) impunity & then engage the "low-side" LEO under cover of the vehicle.

In #2, I would be absolutely offended! for such a "simple" traffic infraction & most all reasons.

In all seriousness, how would an LEO perform the "remove the weapon" bit while preserving his/her own life & still providing that essential "protect & serve" (not to mention the public trust & "Officer Friendy") attitude?
 
Good question!
Must remember that not all LEO's are gun nuts also!
Add in the factor that not all who come out of the academy nowadays have a firm grasp of the nomenclature of the various handguns found out on the street!

As for me, I've always had that nightmare of having the phrase "DROP THE GUN! DO IT NOW!" screamed at me the day after I pick up my new Les Bauer Monolith, or some other such high dollar toy....."but officer...can't I just lay it down nice and gentle???"
 
No one so far has answered Paul Revere`s question on the 4th amendment. As a NYC cop I made hundreds of "routine" traffic stops. Yes, even in NY, people do have valid licenses, up to date registrations and ins. It still doesn`t mean they`re all good drivers. I can never recall asking a person to step out of the car, pat him down and put handcuffs on on for "my safety" because a taillight was out. I had to have a reason to take it any further. If the bracelets came out, you`re goin! That constitutes an arrest, period. Mucho paperwork to unarrest someone and you need permission to do it. Then I`ll search the car because I`m going to voucher it for safekeeping and since the arrestee could have valuables in the car, including in the trunk, they must be returned to the owner. Even if the driver is mouthy, I could write longer than he can yap.
Shows like COPS make me laugh sometimes. While you see that every time a LEO does these things he comes up with guns, drugs etc., what about the video you don`t see. Some people get the impression every car stop is an arrest. It`s good tv but not really indicative of the job.
If I myself were stopped at a DWI checkpoint and the officer thinks he has a legitimate reason to ask for my paperwork and if I`ve been drinking, I have no problem with that. I`ve worked checkpoints myself. If after I produce all the proper paperwork, convince him I don`t drink or do drugs he then asks my consent to search my car, I would be highly suspicious, if not insulted. I`m not going to fight with him but I would ask why. If his answer didn`t satisfy me, and why should it, I`d probably still let him just so there`s no hassle but refusal doesn`t mean guilt. What if the car is new and I don`t want him (or his four legged **** factory) scratching it? I would probably ask his superior if this was normal and necessary and where he got his reasonable suspicion from. Long hair or beards or color of skin is not reasonable if all your other criteria is met.
Don`t get me wrong, if I stopped the truck that was used in the WTC bombing and let him go because all his paperwork was in order, I`d still be kicking myself in the ass but we still live in an America spelled with a "C", not a "K".
 
Ive been through 2 road blocks and have been pulled over twiceand in all cases i let the oficer know i have a gun on me or in the car.In only 1 case did the officer ask where the gun was and he did disarm the the gun ,That is county policy on stops thoer and he told me to not be alarmed that it was standard procedure.After he checked my license and permit he let me go with a warning for cutting a redlight to close!
In the other cases the pfficer just said thanks for letting them know ahead of time and were not concerned at all.One f the stops was o the way to a local range in a small town and when he looked in the backseat and saw all the gun cases and ammo he just said yall must be going to the range,Have fun and tell Tommy hello.And said have fun .Course i dont think they would of had the same attitude if id been stopped in Atl. though
