The issue pendulum swings...for a long time it was perfectly acceptable and unactionable by the employee if the boss wanted to take a feel every so often.

Quitting your job because the boss is an ******* is not an "action?"

That's been my problems with sexual herassmeant laws, at least until Monica came along. There was this theory that employees are actually slaves with no choice and no recourse.

Of course, President Clinton helped many promoters of these laws to see that a 50-something chief executive and his intern could actually have a consensual, adult relationship.
 
So because he made a stetement during a fight, he deserves a greater sentence that someone else who committed the same physical crime? I don't think go.

Then what you need to do is oppose aggravating and mitigating factors as part of the law, or at least some of them. Good luck.

In Florida:

775.085 Evidencing prejudice while committing offense; reclassification.--

(1)(a) The penalty for any felony or misdemeanor shall be reclassified as provided in this subsection if the commission of such felony or misdemeanor evidences prejudice based on the race, color, ancestry, ethnicity, religion, sexual orientation, national origin, mental or physical disability, or advanced age of the victim:

1. A misdemeanor of the second degree is reclassified to a misdemeanor of the first degree.

2. A misdemeanor of the first degree is reclassified to a felony of the third degree.

3. A felony of the third degree is reclassified to a felony of the second degree.

4. A felony of the second degree is reclassified to a felony of the first degree.

5. A felony of the first degree is reclassified to a life felony.

The statutes go on to explain (hunt it; I didn't copy it) the REASON why sch factors are considered. The legislature concedes that it harms the state when a minority has to live and work in fear because society gives harming them a wink and a nod.

As for a robbery being a hate crime because he hates those with money, that is the most stupid thing I have ever heard. He may or may not hate those with money, but he primarily wants whatever money they have ($40 from those monied folks) and he wants CONTROL.

Committing a crime against someone because of their race or other feature that you hate has nothing to do with freedom of speech. Your motive is usually determined by what others testify about what your proclivities are, and that testimony is probably protected as free speech.

Don't get in fights while drunk so that your prejudices are likely to come out, don't brag about who you hate and then get in a fight or worse with them, and you'll never have to worry about being convicted of a "hate crime".
