The citizen arrest

This is where everyone needs to know their states laws on the matter. If you are legally CCW and come across a situation where you or someone else is in immediate danger of death or serious physical harm. Do what you can to stop it.

From there it gets real sticky. Someone gave the example of a man dragging a screaming and terrified 5 year old girl across the parking lot. How do you know it isn't the girls father and she is throwing a temper tantrum? So what do you do? Draw your weapon and try to detain the man? Do you know that in many states deadly force can be used to stop an illegal arrest. So if you do draw on a little brats father, he can legally shoot you. And you have just put yourself in a lose-lose situation. If you shoot him you go to jail, if he shoots you, you go to the hospital and then jail or straight to the morgue.

If, using this situation, the girl is not in immediate danger of serious physical harm don't confront the man at all. If you have a cell phone call the police and follow the man until they can get to your location and let them confront him. If, at anytime during this, the situation escalates to where her life is in imminent danger then step in, but not before. If you create a situation where none really existed you are going to be sorry for the rest of your life.

My ex-wife sent my 'replacement':rolleyes: to prison because she ran out of vodka. It was a bizzare situation that unless you know her you wouldn't believe it. The point is when you walk up on something it may not always be what it appears.

Discretion is the better part of Valor- does that sound familiar to anyone? Unless you are absolutely sure of a situation, you can still be involved at a distance until the situation is obvious or someone with the authority and training to deal with it can take over. And trust me, you would be appreciated a whole lot more.

My first thought on this subject is that for me to perform a "citizen's arrest", I better be in a very, very similar position as I would be to have to pull a concealed carry weapon.

In other words, I'm witnessing firsthand and am certain a forcible felony is being committed that I can prevent.

As a citizen, there is no margin of error for me. That is why the police were given the legal protection they enjoy.
 
I'm pretty sure that detaining a suspect @ gunpoint, ordering the suspect to lie down on the ground, under threat of experiencing the wrath of the gunholder would, in fact, constitute a citizen's arrest.

I don't believe it's necessary to run around like Gomer on The Andy Griffith Show, shouting, "Citzen's arrest, citizen's arrest, citizen's arrest!"
 
I dated a Girl once who thought it was "funny" to yell out the car window to old people..."Help I'm being kidnapped!" Let's just say that relationship did not last long. Police officers are trained on what is legal or illegal, and how to make an arrest. Civilians with weapons are not, and will most likely cause more harm than good. In almost all cases its better to call 911 then to get involved.

Perfect example is trying to break up a very one-sided fight. You may think your helping the person getting beaten, but what if the crowd watching the fight turns on you and now your dealing with a dozen people coming at you, what if the victim suddenly turns on you (which happen in some domestic abuse cases), what if somebody gets behind you and disarms you, now this person (and you) may die because of your gun. You have no uniform, no training, and no way to radio for backup.

I'm armed to protect me and my loved one. I will only act to help other only if someone will surely die if I don't stop the BG right now.
