ACLU asks city to oust Boy Scouts from
park
Group's policy on gays protested; suit threatened over land
lease

SAN DIEGO -- The Boy Scouts are asking to stay in Balboa Park for 50
more years.

The American Civil Liberties Union wants them kicked out now because the
scouts don't admit gay boys as scouts or gay men as leaders.

And the dispute may soon erupt before the San Diego City Council and the
courts.

The Desert Pacific Council Boy Scouts of America has asked the city for an
early renewal of its 50-year lease on nearly 16 acres of land at the
northwestern corner of Balboa Park, near the San Diego Zoo.

The scouts pay $1 a year under the lease, which expires in 2007. They want a
50-year lease in place as they prepare to launch a fund-raising campaign to
upgrade the campground and swimming pool they operate.

Potential donors are reluctant to contribute without a new lease, said Dan
McAllister, president of the Desert Pacific Council Boy Scouts.

"If we are to mount any kind of reasonable capital campaign we have to have
some assurance that we'll be there," McAllister said.

The city's real estate assets director, Will Griffith, said he may bring the Boy
Scouts' request to the City Council in closed session this month. Initially, the
issue will not be discussed publicly because it involves property negotiations,
Griffith said.

If the council agrees to open negotiations on an early lease renewal for Balboa
Park, Griffith said, he will recommend the new agreement be for less than 50
years.

As a general practice, Griffith said, the city has been shying away from
granting leases for such a long period. He said 25 years might be more
reasonable.

Meanwhile, the ACLU is preparing to file a court challenge by the end of the
summer to the lease the Boy Scouts have on the Balboa Park land and
another lease with the city on half an acre they use for an aquatic center on
Fiesta Island, said ACLU spokesman Dale Kelly Bankhead. The Fiesta
Island lease, which costs the scouts nothing, expires in 2012 and is not part of
the request for early renewal.

"They should terminate these leases with the Boy Scouts unless they change
their discriminatory practices," Bankhead said.

The ACLU also will fight the lease renewal request when it goes to the council
in a public hearing, Bankhead said.

McAllister said Boy Scout policies are set nationally, not by the regional
Desert Council, which leases the city land. He said the Desert Council serves
about 25,000 to 30,000 Boy Scouts from San Diego, Imperial and Yuma
(Ariz.) counties.

"A national policy is not something we're in a position to change and therefore
we have to deal with the situation as it is and our goal is to get that lease
renewed and to move forward," McAllister said. "We have just as much right
to our place in Balboa Park as any other group."

City Councilwoman Christine Kehoe, the first openly gay person elected to
the council, said she would oppose an early lease renewal as long as the Boy
Scouts refuse to admit gays as scouts or scout leaders.

"There's no need to renew it now. The scouts should change their policy,"
Kehoe said.

She is less certain about the ACLU's demand that the scouts be kicked out
now.

A year ago, the ACLU hand-delivered a letter to council members calling on
them to revoke the leases, but the council never formally considered the
matter.

"I'd really have to see how that comes forward. There is no proposal right
now to revoke the lease. Even the ACLU's (next) action will be taking the city
to court," Kehoe said. "I'd want to know more about what the legal questions
will be."

Last year's letter said the Boy Scouts' anti-gay policies violated terms of the
lease, which bar discrimination. The civil liberties organization also contends
the scouts' policies violate the California and U.S Constitutions and the city's
Human Dignity Ordinance.

The group said the Boy Scouts' policy of promoting belief in God and
excluding atheists and agnostics also is unconstitutional and cause for revoking
the leases.

In November, Assistant City Attorney Les Girard wrote to Kehoe, saying
there was "no basis upon which the city may lawfully terminate the leases."

At the same time, however, Girard said there was nothing to prevent the city
from deciding against renewing the leases when they expire.

Girard, in his letter, said that under previous court rulings the legal provisions
cited by the ACLU did not apply to the city's leases with the Boy Scouts.

The ACLU didn't press the issue last year, choosing to prepare the court
challenge it plans to file this year, Bankhead said.

The effort comes in the shadow of a 5-4 June vote by the U.S. Supreme
Court, ruling that the Boy Scouts have a constitutional right to exclude gays
because opposition to homosexuality is part of the organization's "expressive
message."

While the Boy Scouts can ban gays under the Supreme Court ruling, that
does not mean that the city can lease public land to the scouts, Bankhead
said.

Moving the Boy Scouts out of Balboa Park would not be a simple matter.

The scouts have used the park since 1920 and have been on their current site
since 1940. They have had a formal lease since 1957.

Their Camp Balboa includes an Olympic-size swimming pool, an
amphitheater, a scout store, a chapel, eight camping sites and their regional
administrative offices. The Boy Scouts employ a full-time ranger who lives on
the site.

But Bankhead said just because the Boy Scouts have invested in Balboa Park
and on Fiesta Island does not mean the city should continue leasing public
land to them when some members of the public are barred from scouting.

"Boy Scouts may be free to discriminate," Bankhead said. "Government is
not."
 
Gee, It just goes to show you that the Left couldn't give a rats a** about "the children" when it interferes with their agenda. Yet they take full advantage of them when it forwards it.

The ACLU is perfectly willing to deprive 20 to 30 thousand kids from a greatly benefital experience to make a political statement.

The ACLU voices a concern about Christian values therby excluding Athiests and other undesirables . They say a lease under these conditions should not be granted . Question : Should grazing land be leased by the Fed. Gov't. to a Jewish rancher whose entire herd is Kosher killed for a Jewish market ?

Sounds like harrassment to me, Talk about a need for tort reform.......... I think the ACLU has completly lost it's way, My 2nd amendment rights get trampled daily and I do not see anyone from the ACLU jumping up to protect my rights,.......UGH....
 
Jack I was going to reply how lucky you are not to live in this commie state until I read your profile, sorry to hear you are one of those oppressed by kali, and its liberal socialists.

To bad they have to hurt the kids to try and get their way but then again that shows us how screwed in the head the aclu is. Where's the "big one" when we need it?

By no leap, twist, or stretch of logic (my logic, anyway) is the gov't discriminating against anyone by leasing land to a group that does. By Bankhead's reasoning, it would also be wrong for San Diego to lease a public building to VFW because they discriminate in their membership requirements. :rolleyes: #$%&#$%^#$%& numbskull...

This story makes me queasy. Talk about lawsuit abuse! It's remarkable how dangerous the ACLU is to civil liberties that don't conform to its politics. Quite a bunch of little tyrants.

I believe I would drop the term little in favor of increasingly well funded. The ACLU is generating enormous amounts of cash through these suits.

I'm so upset about it I can't see straight. For years I asked the question "Whats next for the Democrats, little boys?" because of their whole hearted support of gays getting into leadership roles in the Boy Scouts. It looks like the answer is "yes". So...
Now I have to ask the question, "What's next for the Democrats, little dogs?" because that's the next moral step down for those perverts.
 
IMO the ACLU is becoming increasingly corrupt with power--a power that it usurps through lawsuit abuse, as jimmy says.

This is part of a long established trend of legitimizing the practice of forcing us all through the “liberal” mold. If you don’t fit they feel justified in any action that leads to your annihilation. They use the courts to change the meaning of the Constitution and the Bill of Rights with out changing the words. This is accomplished through convincing the ignorant that the founding fathers had a vision and “intent” other then that of tradition. They labor endlessly to establish “new traditions” attempting to erase from the national memory what is true and genuine about our country and its intended cause.

George Washington himself, at the request of the very Congress which passed the Bill of Rights, Proclaimed a day of “… public thanksgiving and prayer, to be observed by acknowledging with grateful hearts the many and single favors of Almighty God.”

What are we to conclude … that the very drafters of the Bill of Rights did not understand what they were saying? Or perhaps that they were so uncommitted to the principles of freedom that they would disregard the highest law of the land albeit written by their own hands?

Non-sense. The only conclusion is that the ACLU and others like them have their own agenda for this nation and that agenda is in contrast to the freedoms so highly prized by our country’s founders. They would take them from us, at any cost, all the while pretending to be on a noble cause of defending the down trodden.

When in doubt the only credible commentary on the intent of the framers of the original documents is that of their lives and writings. Examination of such abounds with undeniable evidence as to what they intended. This assault on the Boy Scouts like the many assaults on our 2nd amendment freedoms is unjustified and should be held as intolerable.

I guess that, according to the ACLU, Baptist churches should be required to allow a certain number of satan-worshippers to be pastors, since after all, they have tax-exempt status, and isn't that a form of 'gov't endorsement'?

As ya'll may have heard, the United Way in certain left-leaning locales, has decided to deny funding to the Boy Scouts if they continue in their eeeevil 'discriminatory' ways. Since only a small portion of UW funding goes to the scouts anyway, the best response to this nonsense is to refuse to contribute to the UW and send a (polite) letter explaining why. This ultimately gets other charitable groups to lean on the UW, since they don't want to lose their part of the big feel-good slush fund. And you can always send a contribution directly to the charities of your choice.

The United Way carries a lot of clout, and you can bet they will 'see the light' (and quietly lean on the ACLU) if they see their food supply disapearing.

Yeah, the whole deal stinks and probably won't change anything anyway. They just can't shaft the Boy Scouts without public opinion burning them bad. But then gays have a powerful lobby. It all comes down to which side they are more afraid of.
On the bright side, what better way to educate the future leaders of this country than to have the legal system screw them at an early age. Think of the positions some of these boys may be in when they are 30. They won't forget this.

If San Diego takes this position, then I certainly hope they don't allow church groups to use any public facilities, such as parks. And, no ladies socials or men's clubs. No chess clubs in their parks either, since they'll exclude people who don't care to play chess ... ;)

The sad thing, IMHO, is that the gay community is simply creating hatred for themselves at this point. These attacks are wrong-headed, and counter-productive.

Attacking the Boy Scouts? Geez. What's next? ... going after the Make-a-Wish Foundation? Ooops ... I nearly forgot, they've been attacked as well. ;)

Rodney King was a jerk, but what was that he said? ... 'can't we all just learn to get along'?

I support extension of the Boy Scouts lease in Balboa Park. The Supreme Court has ruled.

(follow up email):

I suggest you get your friends and neighbors to writeand call the remaining
Councilmembers (done - Oatka). The issue will be before the City Council prior to Sept 15."

Well, that's 1 out of 9. One other guy sent an auto-reply that he was out of town but would reply on return. I would take it that any that don't reply agree with the ACLU and so I will badger them again.
