Whether we're talking about Souter or Ginsburg, we're still talking about the same vote on Raich and Kelo.

Why seems pretty self-evident.

A president Gore or Kerry would have nominated two left-wing anti-RKBA activist judges. And even worse, Ginsberg and Stevens are old and sick, and would have retired so that they could be replaced by suitable left-wing candidates. Which can still happen if a democrat wins in '08.

Then when the next 2nd amendment case came up, your guns would be gone forever. All nice and legal like.

Such judges would probably be aware of the conflict between the 5th and 9th circuits on the second amendment, and want to resolve it in favor of the 9th.

Roberts was unaware that the Supreme Court last year refused to hear the Silviera case, thereby refusing to resolve the conflict between the circuits. The word for that is "indifference." Miers just seems like Souter in a dress. The word for that is "mushy."

I agree that indifferent and mushy beats actively hostile, but wouldn't say it makes me feel "much better." I think the phrase I'd use would be "less nauseated."
