President Bush today nominated a Texas lawyer who serves as White House counsel, Harriet Miers, to replace Justice Sandra Day O'Connor on the Supreme Court – a pick that apparently was pre-approved by Senate Democratic leadership.

In choosing Miers, Bush tapped a person who has never been a judge and therefore has no judicial record for opponents to criticize.


"She has devoted her life to the rule of law and the cause of justice," Bush said, announcing his choice from the Oval Office with Miers at his side. "She will be an outstanding addition to the Supreme Court of the United States."

Added the president: "She will strictly interpret our Constitution and laws. She will not legislate from the bench."

The Miers choice will likely be a disappointment to conservatives who hoped Bush would choose someone with a stronger "originalist" record.

"It looks like he flinched," commented Fox News analyst Bill Kristol. "It looks like a capitulation."

If Bush had nominated a jurist with a long "paper trail" of decisions and conservative writing, he would have faced a much tougher confirmation fight in the U.S. Senate.

Miers, who has never been a judge, was the first woman to serve as president of the Texas State Bar and the Dallas Bar Association, the Associated Press reported.

If confirmed, she would be the third woman to serve on the Supreme Court, after Ruth Bader Ginsburg and O'Connor.


"If confirmed, I recognize I will have a tremendous responsibility to keep our judicial system strong and to help insure the court meets their obligations to strictly apply the laws and Constitution," Miers said.

Miers apparently had the pre-approval of Democratic leaders.

AP reported Senate Minority Leader Harry Reid, D-Nev., had urged the administration to consider her, two congressional officials said. There was a long list of staunchly conservative judges that Democrats were poised to fight, Miers not among them.

The president reportedly offered the job to Miers Sunday night over dinner at the White House. He met with the attorney on four occasions during the past couple weeks, White House press secretary Scott McClellan said.

Wait until she is painted as a "Born Again". Those are fighting words for the left. Personally, I don't particularly like people that want their religion to be my guide, but I'd rather have "Born Again" than some other flavors that want me dead. So, if she is indeed a Bush B.A., I sure hope that also includes a person that strictly interprets the word..and I don't mean the bible. As far as I know, Jesus was somewhat mute on the U.S. Constitution and the right to bear arms. In fact, I don't think that he had a position on arming bears either.

I'm suspicious that she'll wind up being Souter in a dress based on the support of Reid and Durbin, among others.
 
It is my opinion, worth what you paid for it, that Bush was simply overwhelmed by the problem and brain-farted for some crony. I think he is a man of limited comprehension and initiative.

While not conservative, I might respect a competent one and that's not George.

He's doing a heck of a job.

In 1988, Miers, then a lawyer in private practice, donated $1,000 to Gore, the Tennessee Democrat then seeking the party's presidential nomination, according to Federal Election Commission reports. Gore eventually bowed out and Michael Dukakis secured the nomination.

I think I'm somewhere between Reg and Will on this one, or maybe on a different plane altogether, but Reg's take seems very much worth considering:

Another thread said a brother gave her a .45 revolver. Great choice for a first gun for a woman. Anyway, predictably, she shot it on one occasion, couldn't hit anything, and put it away. Might have been on THR.

But characterizing her as "gun toting" based on the above is not as bad, IMHO, as asking us to trust him, she'd get Kelo right. Sorry, I don't. I see Souter in a dress.

Yes, but by the same token and, assuming she truly does reflect her Boss' views, she obviously would NOT know what the practical impact of using US Troops to control law abiding US Citizens will be.

Look, the defining qualification for Ms. Miers seems to be that she is trusted by GW and "reflects his views and faith". That's fine when it comes to the Chief of Staff, Press Secretary or Chairman of the Joint Chiefs. But for a SCOTUS Justice? I'm sorry, but Bush's track record when it comes to US Citizens, US Civil Liberties and States Rights is really troubling. Roberts looks like an open book compared to Miers. I can only take GW at his word.....she is he.

The President has no moral prerogative to appoint a personal clone to the bench. Neither does he have a moral imperative to appoint someone who "won't legislate from the bench"....I'm dizzy trying to figure what that means anymore. A President has a simple obligation...to the Constitution of the United States of America. His obligation is to appoint someone who will read, view and interpret that document in the manner that is was meant to be. Strictly as to .gov powers; liberally as to the Rights of the People.

Miers once owned a .45-caliber revolver, a gift from a brother who was worried about her safety when she lived alone in Dallas, says Judge Nathan Hecht of the Texas Supreme Court, who has known Miers for 30 years and has dated her.

"It's a huge gun - he wanted to be sure she stopped the guy," Hecht said in a telephone interview. The judge recalled one Sunday afternoon driving out to the country, setting up tin cans on a dirt road and trying to teach Miers how to shoot.

How was her aim?

"She was terrible," said Hecht, who added that she kept the gun for a long time but said he was unsure if she ever fired it again.

The title of the article seems to try and make Miers out as a member of a fanatical religious group. The body of the article is much more tame. Typical sensationalist propaganda. :barf:

As to Reid, Durbin and Chucky boy, their opinions on anyhting are meaningless to me as I consider them to be little more than yappy windbags with the intellectual capabilities of carrots....

Glenn: Your expertise, I believe, is in psychology, not politics or the law? ;) I don't have a clue whether Miers will turn out to be as conservative as most of us who post here would like, but I do know that political chronyism (did I spell that right?) is probably more prevalent in those who've previously received judicial appointments than those who haven't.

Not having worked as a judge isn't a real issue as to whether Miers is qualified. If she's too closely alligned with the religious wacko fringe of the Republican Party, then that's a problem for me.

I'm going to be optimistic and think of this appointment as a "screw you, see what you can dig up on this one" smart move on the Prez's part. Maybe he really knows her well enough to know that she really is conservative. I doubt if her feelings about the Second played much of a role in the Prez's decision. Unless we get Wayne LaPiere elected Prez of the U.S., we're probably not going to get the kind of appointees who'd think that the Second was much more than a pimple on a gnat's ass.
 
Wouldnt it be totally ironic if the Dems backed her while some of the Republicans didnt and she gets the seat....

What I get chuckles form is those conservatives who beleived they would see abortion overturned in Bush's terms. Silly Rabbit why would the majority of Republicans do that and take a campaign issue off the table :eek:
