Stopped and Searched by LEO on the way home from the range last weekend.

I'm in with CMOS on that idea. I'd dump some cash to offer defense for e legit brother.

I also agree, for the most part, with others' posture on the search business.

I make it a point to carry a camera with me nearly anywhere I go.
This stems from working with a company who sees fit to intimidate, and harass their employees. And for that reason, I've taken to "carrying" everywhere.
I know it's easy for me to say, but I'd have had that camera out, and documented a roll or two. Including the officers profile, patrol car #, guns, and general location to show geographic detail to prove location for complaint.

I think you were stripped of a Constitutional Right there. I would also file a complaint as well.

Havent posted here in a long time, but re-reading this, I have to post.

This tough guy cop had NO RIGHT TO SEARCH HIS CAR. This guy was a little too drunk on his own sense of power.

Kalifornia "AWs" DO NOT have to be registered UNTIL THE END OF THE YEAR. It is NOT a felony to have an unregistered "AW" right now. Enforcement will NOT start until 1-1-01.

This search was TOTALLY illegal. This cop needs to get his as* taken to court. F him.

Get his name and badge number, and file a complaint RIGHT NOW.

What he needed to say was "Sir, may I please search your car?" NOT "gimme the keys, get out! (paraphrased)"

Thanks for the support everyone.

I just want to say I hold LEO's in the highest respect, always have, always will. However, this went too far. It's officers like these that are making a bad name for those who perform their job with the utmost honor.

Therefore, I think it's my duty to make sure this "bad apple" among officers dosen't remain anonymous.

On Friday, I will go file a complaint against the officer. I have also taken the suggestions of some at AR15.com and am sending a letter to the ACLU. True, they dont like guns, but they sure HATE these kind of things.

I am going to call Bruce Colodny, the attorney aforementioned, among others, to get their opinion as well.

I really am getting scared of taking any of my military pattern guns out to the range anymore. And surely I am not going back there, something fishy is going on.

KaliGunner, I gather he simply gave your firearms back to you, although I didn't see that detail in your account. Also, you stated 'Especially now that my AR15 is considered an "assault weapon", I can only shoot it at established ranges.' - is that a legal requirement, or just a wise move from your perspective. And, if just a wise move, why is that better?

A lot of good advice above, and I share the sentiments. From an individual standpoint, I'm certainly glad I live in AZ, and I would never move to CA under my own power. However, the rest of us in the U.S. are obviously watching your state closely. I believe we'll see more and more civil disobedience over there, and elsewhere. The only optimism I have is that if Californian's make clear that they're not going to go along with this crap, then maybe we can slow down the anti-self defense movement. Hopefully reverse the course, for that matter.

You guys are on the front lines out there. I too would contribute funds, but that's fairly easy to say and do. I'm sure it's a lot tougher to have to live in the growing fascist state of CA.
 
Gee, why is everyone so upset? This is just another of the "compromises" we must make "for the children".

There has been no coup, no overthrow of the government. All our current leaders were voted into office to represent us. So you were inconvenienced for a moment or two. So what? If it saves the life of just one little child, isn't it worth it?

While purchasers of shotguns and rifles receive the "background" check, all that is given to DOJ is that the check is for a long gun. Only pistol serial numbers are recorded.

The only way a rifle or shotgun serial number will show up on DOJ records is if it was registered under Roberti-Roos. Or, if it was reported stolen/lost.

There is nothing wrong with asking why you are being detained. If the officer refuses to give you a good explanation, you are justified in asking for his supervisor.
 
Folks, I'm from Mississippi myself, this sort of crap just isn't done. I don't think you should move just yet, not before rampaging on this LEO. Get Internal Affairs in on his butt. Tell the elected Sherrif that if this matter is not handled to your satisfaction then a complaint will be registered with the FBI.

As for the comment, "if these stops save one child then isn't it worth it?"

HELL NO! How many adults should be sacrificed to save one child?

Yeah, I overreact but my temper properly channeled gets tons of results. Dance on this fools head, but use the proper channels. After he's bleeding from suspension, formal investigations from IA, FBI and the Sherriff, I'd taunt him. But I'm utterly intollerant too.

for those of you who wonder, no, I don't respect LEO's or any profession because of what they do. Each person earns respect alone.
 
Something just occured to me.

We are all familliar with trolls, people who come to forums and inflame the passions of others antagonisticaly then leave.

Could it be that this is the same thing but rather inflaming passions sympathetically?

This type of case is a civil rights attorney's wet dream.

I'm suspicous.

Hunt up the website FindLaw and get to United States Case Law: Supreme Court. Look up Brown v. Texas, 443 U.S. 47 (1979) and also Delaware v. Prouse, 440 U.S. 648 (1979).

These concern searches during routine, minor offense, traffic stops. Basically, they say NO SEARCH is legal, and no evidence found thereby is admissible.

A similar case was decided by the Supremes in May (I think) of last year.

I printed out the two cases, and carry them with me when I travel. After I say "No, sorry, Officer.", I plan on showing just why I'm refusing a search. Dunno how much good it will do, but it's better than having nothing but mouth-music...

I took a handgun class awhile back from Greg Block (Channel 9 was there that day filming and I got my 3 seconds of TV fame shooting my SOCOM!). He had a guest speaker, Bruce Colodny! Bruce said one thing about 5 or 6 times. NEVER GIVE CONSENT TO SEARCH YOUR VEHICLE. He mentioned that this makes his job much harder and is the most common mistake made by INNOCENT people.

BTW, the class was given at the Rio Hondo Police Academy where a whole bunch of Southern California agencies train. Since we were at an active training facility, the cadets were required to stand at attention whenever we walked by. I think they assume that anyone not in uniform is an instructor. Kinda neat having the MAN stand at attention for you. Greg has since swithced his classes to Burro Canyon!!!!

buy ammo from the ranges if they sell it
clean up trash at the range
be an upstanding american citizen
attend the PTA meetings
take other PTA people out shooting

maybe we are blending in to far.

Kaligunner, I am very sorry to hear this happened to you. let me start off by saying you did the right thing. Regardless of what the law says, the police can do whatever they want. As long as you are not breaking the law, its better to let the officer make an illegal search and then report him. I had a similar experience that got out of hand. Lets just say that I was out for a walk with my dog, an officer wanted to search me for NO apparent reason. Because I did not have an I.D. on me I ended up getting peppersprayed (seriously). I didn't resist at any point during the altercation, it was simply a case of some Barney Fife wannabe looking for something to do. His defense in court was that I was "intimidating" which in the state of California apparently is a grounds for search and seizure. The pepperspray was the least of it. I lost my job, spent $20,000 on a lawyer, $5,000 for bail, $1,000 in fines and worked a road crew for 20 days. All this because I didn't have an I.D. on me and because I asked the cop "Why, whats the problem officer ?" Which the jury found to be undermining the officers authority. I swear to God this happened, and if it weren't for the fact that I was 20 at the time, and the jury had an average age of 65, I probably wouldn't of been convicted. By the way, 4 cops took the stand and I have never seen better liars in my life. Do they take a course in "Bulsh*tting" at the academies ?

Oh yea, as I was being cuffed and put into the car, some old yuppies on horses were riding by and congratulated the cops for doing such a good job. I know how frustrating that must of been when the old timers did the same in your situation. Screw 'em I say !

Kaligunner is NOT a troll... I know him from the Ar15.com site... The AR site has been having problems for weeks, and many of us have found this site, and others to get our fix...

Now... Most everyone has hit the mark here... You were violated on the 4th, without a doubt, AND the LEO was completely shooting wildly when he said that they needed to be registered...

As was posted, you have until 12/31/2000 to register anything classified by SB23. Do not let any LEO try to intimidate you into thinking otherwise.

Best response... Cooperate while the LEO is conducting a reasonable investigation of material information, but when the LEO becomes unreasonable, maintain your position, remain composed, and demand a supervisor on scene ASAP. Document name, badge #, and time / location.

Comply as necessary to remain out of custody, but don't hesitate to file a grievance NOW!

I too live in the PRK, and dread the thought of this very same thing... I just know that my ducks are in a row, and the city / county will feel my pain ($$$) should this happen to me.

The ACLU has a card you can print out that tells you how to deal with officers and it explains your rights. Goto the ACLU homepage and look it up. Sounds to me that you were subjected to an unreasonable search!
 
Just think of how many criminals would be caught if LEOs were allowed to shoot people down in the streets and then say they were criminals. I know a few LEOs who would love the idea.

Too bad you couldn't get the license number of those nice concerned citizens driving by. If they were coming from the same direction they were probably the ones who called you in.

"Hello, Sherriff? We just heard GUNFIRE up on road 18!"
"Folks, that's an approved range. They're allowed to shoot there."
"Yeah, but uh . . . . two of those guys looked suspicious and they were shooting big black MACHINE GUNS!"
 
I would call the department and find out the procedure to make a formal complaint. There must be a Civilian Complaint Review Board or something. The idea of contacting the NRA is a good idea too. I would be willing to contribute $25-$35 to a fund. Wonder what would have happened if you were alone and black? This LEO is a loose cannon.
