I'd say if small claims refuses the case b/c it is firearms related you probably have a lucrative suit against the court. You might even find some back-up as a local court finding involvement of firearms as property nullifies equal protection under the law has to peak some ears. The basic idea that an integral part of an incorporated right is not eligible for protection afforded under almost every other circumstance boggles the mind. If you had replied you were in CA, MA, NY, IL, etc., I wouldn't have been surprised, but in AZ? I would certainly support SAF using my money to fight. I'd be grinning ear to ear if in your situation.

Ummm...no. I've never heard of anyone successfully suing a "court" for damages in any context, let alone refusal to hear a case.

Calles the shop yesterday to ask them for a possible eta there response was they'll call me when it comes in, basically don't call us we'll call you so I called clerk if the court's this one told me its up to each Iindividual judge if they want to take case and to be prepared for a lengthy process 1st is filing fees then serving fees then wait for response (answer) she said they have cases dating to 2005 that are still in dispute but ot looks lik my only recourse at this point thanks for I put ill have to wait untill I get paid to file.
 
I live in Lake Havasu AZ. I would like to know what shop it is too. I travel west side of the state from Flagstaff to PHX.

If your feeling feisty... tell them you'll call the local TV stations and news papers and allllllll your friends all over the internet and even protest in front of their shop if need be.

What would happen if the shop suddenly got a large amount of phone calls asking about the availability of. G20'S?
 
You can't sue a judge (or a prosecutor) under any circumstances; they have what's called "sovereign immunity". (it's good to be the king) You can file an ethics complaint and try to have them disbarred, like Nifong. Good luck with that. Or in some cases, a criminal complaint -- that is even less likely to be successful, especially when Eric Holder is in charge of the [in]Justice Dept.

I'm going way out beyond my expertise here, but there is also something called a "writ of mandamus", ordering a govt official to do his job. You'd have to get that from a superior judge.

In theory, I like the "tar and feathers" approach. Not sure it works in real practice anymore.
 
How much business do you think you could cost the shop by picketing just before the start of hunting season? A few thousand dollars worth?

Cater to more of the tactical crowd A/R's longuns suppresors tactical wear etc.. no Winchester model '94. Or Marlin lever guns wheel gun muzzloaders , single shots or blackpowder guns.

Are you sure you're dealing with Small Claims Court?

I don't know how they do it in AZ, but it's usually file the papers, pay the fee, serve the defendant, get on the schedule within a couple of months. The whole point of Small Claims is fast food justice. Cut and dried, in and out.
 
If the OP wants to know about the particular FFL who runs the shop he's dealing with, he might want to ask over on Sturmgewehr.com in the General Forum. They use that forum over there to mainly expose scammers, bad dealers, and rip-offs; and a number of folks over there know the "good guys" from the "bad guys".
 
You might call the local BATFE office and find out who the agent is that oversees that shop... let them know what's happening and see if they have any advice.
 
I did try

ATF. They said they didn't deal with that ATF told me call local pd and they told me they told me its a civil case and they wouldn't touch it!

gun shop just called a week of this post being public my Glock 20. Is in thank youEDIT:I Just walkes in the door my G20 came In after 51/2 months but ut here thank God I was getting very worried!

Yeah, fellas, that Judge IS immune generally..........but he is NOT immune from a carefully crafted complaint filed with your State's equivalent of a Judicial Qualifications Commission.......or what ever your jurisdiction may call it.

I can think of several instances here in Florida wherein the complaint issue was so egregious that the sitting magistrate was publically reprimanded by the Florida Supreme Ct....and others that resulted in removal........so remember, you DO have alternatives.

I know, it still leaves you out the bucks or item, but at least it's some "git back" satisfaction, you ought to try filing and see if the matter gets rejected and by whom......might just be a lazy clerk blowing smoke.
 
Glad to hear this was resolved, even if it took longer than necessary. As such, we're going to go ahead and close this one down.
