S&W Boycott- It's working; Layoffs announced

Al, I think you're wrong and PKAY is right. The text of the agreement says that it is indeed a contract. Surely there are some smart lawyers out there who would represent a new and revitalized S&W whose leadership said "OK, Cuomo, you didn't honor your part of the contract, so it's now null and void, and all bets are off." As I said, I'd be willing to contribute to a legal defense fund to help S&W fight that battle, and I bet millions of other gun owners would do the same.[/quote]

PKAY maybe _be_ right, technically. But the technicalities only matter if the courts are impartial. In practice, I'll stand by my position.

No judge who has hopes of rising in the judiciary branch is ever going to strike down this "contract". No judge who can be threatened with dirt dug up (or manufactured) by the feral government is going to strike down this "contract". No judge who thinks more and bigger government is the cure and not the problem is going to strike down this "contract".

I think that covers just about all of them.

I suspect that under a Bush Administration, this "contract" may either disappear or be amended (gutted) to remove the most onerous provisions. Given the tort reform Bush has supported in Texas, I can't imagine a Bush Administration would have anything to do with legal extortion.

If the company declares bankruptcy and its assets are sold, INCLUDING THE NAME, the agreement would NOT have any bearing on the new company. Since it would have a different charter, by-laws, owners, stockholders, etc, it would NOT be S&W for legal purposes, even if it was called S&W. This is a standard way to get out of debts, contracts, etc.

Shall we buy them?

What's infuriating is the press' continued misreporting:

"...Smith and Wesson announced lay-offs because of declining business. Gun owners have been boycotting S&W after it announced that it would provide trigger locks with the guns it sells..."

Either total ignorance or utter corruption by the press.
