Thanks for the info. I'll make sure to never live anywhere run by an "association." Sound like a mob term. Like another poster said, fly the Jolly Roger one day and the PRC flag another. Take pictures of the other people that dump their trash in plastic bags. If they're not being fined then you've got a case for discrimination.

Thanks for "taking one for the group". I know it's of little comfort at this point, but the knowledge of what type of crap these associations get away with could forewarn others. I have some serious doubts that most of the rules would stand up in court in most States. Problem is, most people aren't willing to push it that far.

Me? I am a complete a$$hole. I'd paint my garage door to look like a big flag. ;), get a tank of helium and fill up a hundred plastic garbage bags and sail 'em through the neighborhood at random times of the day and night ;) cut "crop circles" in my grass ;) buy a used beat to crap 4x4 and put a car body on it and park it in the drive ;) In short, I'd be the perfect neighbor ;)

Hmm...I don't have a beat to heck 4x4 yet but would my '71 Impala do? I call it the "Land Junk" :D My consulting fees are low for this type of work :) Just food, tranportation costs and a case of ammo for one of my guns ;)
 
I thin an "Association" could be a good idea if run by the right people, rules requiring ownership of guns, or to fly the U.S. Flag, and many other things.
 
Is it any wonder we had a HOA shooting here in the Phoenix valley last year?

Sorry, FUD, but you were aware up front that an HOA was being put into place. You should not have signed nor paid without seeing the rules up front. You're now paying the price. Move.

And to think that some people actually like living in places where they tell you how to live.
 
OK, I've mentioned this before, and my interpretation is based on VIRGINIA law, so Florida law is probably very different, but...

1. When you bought property in the association, you were informed that there would be an association governing it. By continuing with the purchase, you agreed to abide by the associations covenants, rules, and regulations, even though they were not yet set down.

2. The election process that has been described to you is ILLEGAL in Virginia.

3. In Virginia, you cannot be barred from flying an American flag. The Association has to ban ALL flags, not specific ones.

4. Wanting the garbage in cans, as opposed to plastic, is within in the association's rights.

5. Florida's HOA laws, as established by the state, are likely posted on the states' legislative website. Give that a try.

6. For more information on the HOA, you need to get a copy of the documents of incorporation. This will tell you EXACTLY how the board is set up, the election procedures (if you have a yearly meeting, nomination methods, etc.) This SHOULD be part of your HOA CRR book.

As for the garbage, you've already said that you have problems with gators. It might not be such a bad idea to have the garbage in a container that the gators might have a harder time with.

As for the access gate, hum... That COULD come under the heading of "special assessments."

Find out EXACTLY WHO will own those cards. If new people move into the development, will THEY be charged $147.50 for the gate? There could be a BIG problem with how the board is doing this.

It looks like the laws governing Homeowner's Associations in your state can be found on the Legislature's Web Page (sorry didn't get the address, used google), and are found in Chapter 2000-302.

Start your search there.

This HOA is well funded with your fees and everyone else's, and it sounds like it's run by jerks with too much time on their hands. They've also apparently hired an aggressive manager who loves to get additional revenues through fines.

FUD, I'm a lawyer, although I don't currently play one on TV. I'm afraid Meiji Man is right and these rules are binding. The HOA can change them anytime by majority vote of the directors (not the residents) and your only recourse is to move out or vote in other directors. This is much more power than many city councils have. You should try to find a Florida lawyer to advise you whether the circumstances of your sale constitute an exception under Florida law.

I lived in one of these and hated it. I couldn't wash my kayak on the lawn, the drapes had to be a certain way, on and on.

Ask a lawyer whether proxy voting is valid and then get proxies in the proper form from your neighbors who are also tired of the aggressive enforcement and new fees.

I'm not a lawyer, but I've studied these things a little. It seems to me that after you consult an attorney, you have a choice of one or more of the following:

1. Take over the Association. Do you like politics. This one sounds FUN! Reform it after the US Constitution and change the nomination procedure right before you leave!

2. Sell the house, take the loss and consider it the cost of a political/legal education.

3. Civil disobedience, just to make a point. Maybe pay the fine with Confederate money! :)

Dennis, Mike Irwin and Ledbetter have given good advice. Follow it, and your attorney's.

$147.50 for an access card is INSANE! COMPLAIN LOUDLY!

BTW: If you have Bachelor's degree, there's a community college in Sheridan, Wyoming (in the next county east from Big Horn County, remember that thread?) looking for a CS instructor. (I ALMOST sent them a resume.)

I gotta tell you though, even though this really sucks for you, it helps me to remember: 1) avoid HOAs like the plague, and 2)ALWAYS have MY OWN attorney present when signing a legally binding document! Thanks.

Where were ya when I needed ya? :D

Bear in mind that, some twenty years ago, I was new to the civilian world. A
neophyte. I was new to Texas and anticipated a social structure where deals
were agreed upon with a handshake and a man’s word was his bond.

I found I didn't need an attorney for simple transactions. I could save
$200-$300 by "doing it myself".

Well, I ended up "doing it TO myself!"

Saving that $300 cost me more than a year's income in one giant slap!

But I had a good job as a manager of a $3 million/year computer store. The
owner promised me the job for as long as he owned the business so I bought
a nice home (in the middle of a “boom”) - with $1400/month mortgage
payments.

He sold the business. The new owners wanted to manage the store
themselves. I was jobless.

While searching for a new job, we were forced to use our emergency fund
and a chunk of our retirement fund. When you’re not working, those “easy”
monthly payments hit pretty hard. And, with two little girls in school.....

Finally I found a job with a computer software research and development
corporation. I worked myself up to the position of comptroller. Once again
we were financially stable and beginning to recover lost ground.

Then the oil crunch hit and the entire corporation closed. With only a small
income, we used the rest of our retirement fund for living expenses. We sold
our home (at a loss) to rid ourselves of the $1400/month mortgage
payments.

Each problem caused one or more subsequent problems - like the "domino
effect" - and caused extreme financial and emotional distress and problems
for myself and (worst of all) for my family.

That $300 I "saved", wiped out our emergency fund. Then when two
“emergencies” hit, we wiped out our retirement program (and most of our
financial future.)

Only now are we recovering from the sequence of burdens which destroyed
our financial security because I "saved" $300.

The only reason I survived this mess is the support of my wife. She's the
"Rock" of this household - always was, always will be.

So I’ve learned the hard way. If you need a mechanic, get a mechanic. If
you need doctorin’, go to a doctor. And, for the sake of yourself and for
those whom you love, listen to the voice of one who lost - BIG!

Never do legal work without the advice of a competent attorney!

Thanks to everyone for their comments, suggestions and support. I realize that part of this is my own fault for moving into such a community without first demanding to see a copy of the regulations and not accepting the excuse that it wasn't available but I never lived in one of these "artificial communities" nor have I had any experience with them. So, when I was told that it was "only a few" reasonable regulations designed to keep the community nice, I didn't read too much into it. As others have said, live & learn -- what might be reasonable to one might not be to another. Regards,

Well here's one thing you can try to do also. And this is really going for the throat. Take a copy of the contract to your local state representative and play up the whole unpatriotic anti-American flag BS (This is if you have a good state all American rep) Have them introduce legislation making these sorts of "UnAmerican" HOA's illegal! At the very least have them pull their ability to charge fines and absolutely pull the ability to have a lein put on your home. Talk to the local papers and tell them all about the unpatriotic bastards who made you take your American flag down "On the 4th of July!" Maybe go to the local news media nerds and hand them the story all set with the spin you want put on it, make it so they don't have to do any work. In other words, hit these monkeys over the head with a combined assault from all corners and go straight for the throat. Drop a couple of annonymous tips with the State investigator about illegal use of funds by the HOA, maybe tell the IRS that they have been using HOA monies to lobby or that they are diverting them to private hands(they probably are). MAKE LIFE SUCK FOR THESE JACKALS. Just some ideas. Semper Fi...Ken
