Trespassing

Contact Fish and Wildlife or the State Police. Sounds like they should be there opening day with a bunch of citations. Word of this will spread also. :)

If you do find stands take them down most are getting pretty $$$$ they should get the hint. You might also put a no trespassing sign on the tree you found the stand. Good luck

Trespassing

In Mississippi we have a law that to be on anyone's land at any time you have to have written permission from the landowner or leaseholder. NO SIGNS, NO HASSLE!!!!!!!!!!!
Maybe your state could pass such a law.

Sell all the gear they leave behind. That way you can profit from them trespassing on your property.

Friends of mine had a similar issue with people trespassing on their property in the Summer Months. They began to spend a huge amount of time on their property when they knew people would be around.

Eventually people stopped going there apart from a minority of incidents that occurred in the months after.

Many years ago on my father's property in North MS I was out on walkabout and found a pickup truck that had come across the fence (cutting it) parked well out of sight of the house. I left a note on the windshield telling them that they were trespassing and that future trespasses would be dealt with. found them the next day and took the valve cores out of their tires. Tow truck shows up that afternoon seeking permission to cross property to assist a disabled vehicle. Dad started to say yes I told tow truck driver no. Told him to go in the way the truck had gone in. Dad asked what was going on. Thought I might have damaged the truck. I handed him the valve cores and he grinned understanding. Fixed the fence the next day and that crossing became the new sight of a big brush pile. No more trespasses by the truck. Have claimed some deer stands in the intervening years though. Funny how getting to them financially seems to be the best deterent.

They have to catch them there tho. Not always that easy. A stray bullet thru a 4 wheeler or pickup engine works wonders.:D

that's not a smart idea, while you meant to miss them and hit their vehicle, in court they are going to swear you were shooting at them so they shot you in self defense.

in my state, armed trespassing F.S. 810.09(2)(c) is a third degree felony which carries a $5,000.00 bond. no citation or ticket, you go directly to jail as long as it's properly posted or the subject(s) has been for warned.

That "stray bullet through the engine block" may be satisfying to your soul, but it's still a felony-level damaging of private property. Priced engines, lately? The guy pays $200 for a simple trespass fine, while you lay out $3,000 plus legal fees.

Who wins that trade?

It all depends on the state laws. In New Jersey, The law reads Land need not be posted to enforce the trespassing law and its quite effective and has very stiff penalties. If your caught poaching in NJ, they take your gun, Vehicle and any other property you have with you at the time. It is then forfited to the state fish an game and auctioned off and the money from it is put into a wildlife preservation fund. I border state land where their was a problem with poachers and they were all caught eventually and arrested and had all their property seized. The law we have has had a major impact on poaching and trespassing and it had dropped to almost none. Their are still a few that poach im sure but when caught their going to agree that it would have been cheaper for them to buy lobster and fillet mingnon. I foung a few stands on our farm and went back with a can of roofing tar and bearing grease and put a nice ammount on the steps and seats. I saw where one guy had tried to climb it(Guess it was dark) and had tar and grease prints all over the tree where he tried to wipe the tar off his hands. I stood there laughing to myself and put on a fresh coat again. I have found that a pile of dog crap on the seat works well also. LOL, phew, whats that smell.:barf:

They've got to prove it and admit they were trespasing. It works Bubba.:D

Okay, now you promoting committing a felony and claiming knowledge that you know that felony acts are effective recourse against trespassers.

Such discourse is hardly "dedicated to the discussion and advancement of responsible firearms ownership."

I'm just telling you I know it works. Whether you or anybody else does it is up to you or whoever is involved.

Howdy Hawg,

What some of these city boys dont understand is that in these small rural counties, everyone is related. You can drive out from town and do your stuff, but you are never going to get a charge against a local person. Everyone in the area is related. They are not going to charge family or neighbor nor will an outsider ever get a conviction. It just wont happen, no matter how much you quote the statutes, the local jury is all related too.

At home, both the County Attorney and Sheriff as well as the Magistrate Judge are all cousins. And, cousins of mine. So........bring it on.

I mentioned in another thread that there is often hostility between the state wardens and local sheriffs. In our area, about 7 counties have told fish and game to just stay out, that the local law enforcement will take care of enforcing local laws. Explanation of that gets into political wrangling, the state thugs being environmentalists wanting to charge all the landowners with some crime and the local sheriffs protecting their tax base and wanting to charge the outsiders who are abusing the hunting rights and trespassing.

So, for most effective results you need to post your land according to state statute, and then file the complaint with the local Sheriff, who will ultimately enforce things. However when seconds count, your local sheriff is usually only hours away. We do a walk through of our property a few days before season and we take down all the hunting stands. We consider them a donation, and we resell them as a management fee. Some of them bring some good money. We have not had anyone come complain about not being able to find their illegally placed hunting stand yet.

Don't take matters into your own hands. Notify the authorities and let them do their job. Confronting them personally could turn into something very nasty. I had a similar problem and took pictures of the vehicles showing the license plates numbers. Turned them over to the LEO and the problem was solved.

Well bubba, that all works until the person you mess with is meaner than you. I have met people who are. You shoot their engine block, they got a pretty good idea who did it, and while they may walk home that day, they got a pretty good idea that someday you or your wife, or your kid, is going to take the next one.

The worst thing we have ever done to a poachers truck is cut two valve stems off, so that they were still there with flat tires when the GW showed up. It was going to get towed anyway. One thing about poachers or tresspassers, they carry guns too, and getting into a shooting war on my property with my wife and kids around is NOT something I think highly of.

I would much rather have them believe they got caught by bad luck than to think I was the one who called them in. Let them get pissed and angry with the GW's rather than with me.

Besides, how do I know its not the judges city cousin showing up out here. I might have cousins, but poachers and all have cousins and brothers too.
