permit after being arrested for assault?

so i want to get my permit in ny.. 12 years ago i was arrested for an assault 3rd (misdermeanor). charges were acod (dropped under the condition that i didnt get in any trouble for 6 months). well needless to say i didnt get in any trouble after that.. so my question is has anyone else with this situation had any problems getting their permit in ny state? i hear it can be tough if you were arrested for an assault.

If I understand how "ACOD" (Adjourned in Contemplation of Dismissal) works, you should be fine. You haven't been convicted of any crime and the records might even be sealed. I would recommend that you first get acquainted with the shift key on your keyboard ;) and then contact a qualified attorney to find out for sure as your local laws may differ from state or federal law.

"When a case is adjourned in contemplation of dismissal, the adjournment indicates no admission of guilt or innocence. The case is essentially put on hold for six months and the charges dismissed if the defendant doesn't commit an offense."

if the record reflects a dismissal of the charge you should be fine.
you may want to ask about whether this may be "expunged"...this would
remove the record of the charge. My home state also permits expungement of the arrest record in some instance..so this is worth a look in your state. You may also want to take a look
at your state CCW law...note the language..does it say conviction or some other lesser thing such as "charge"?
 
thanks for the replies guys.. (as far as the shift key goes i ripped those suckers off the keyboard ;) ) supposedly according to my lawyer back in 1993 everything was supposed to be completely erased and my mugshots and fingerprints were mailed back to me. yet the court clerk dug out my file in less than 2 minutes.. so it still exists. not exactly sure whats up with that. anyhow, i appreciate the help.
 
You need a lawyer. They will ask the cort to expunge your record, like it never was. If an average clerk found it in 2 minutes flat, you are still a convicted misdemeanor offender. The reason is that it would pop up if your record is run during a background investigation or possibly even a investigatory field interview. Unless I am greatly mistaken, you are forbidden a CCW with a violent assault conviction. You need a lawyer.
 
sounds like i need to contact the lawyer that handled the case years ago since they said it was completely erased from my record.. :mad:

if going to contact the lawyer ask him if the prosecution AND arrest record can be expunged...often under 2 different statutes, so he may have to double-check instead of giving an off-the-wall answer.
 
Hi All-

If you address any correspondence to the court, you'll need to reinstall your shift keys for typing important phrases like "The Honorable Judge Smith" and "Your Honor" and even ones like "Sincerely" in your letters...

Met a guy in Albertsons market in Kingman AZ that told me that he had an AZ CCW even though he had the same conviction in CA .
 
for anyone interested im not worried about using comma's, periods, quotation marks, and caps when typing questions on a message board. if i happen to use them then so be it, but im not going out of my way. hows that bluejay.. :)

I poked a little fun at bmfgsxr for not using caps. I even put a winking smilie next to it. He seemed to take it in the spirit it was intended: not mean-spirited, but in fun. His retort showed that. Unfortunately other responses were either not intended or not received in the same vein.

Perhaps we'd better keep this discussion strictly on topic from here on out. Take any comments regarding punctuation, spelling or capitalization to email. Mkay?

rarely does anyone use all the proper grammer on a message board.. i may be new to this site, but i help run the largest motorcycle website on the net with over 40,000 members.. ;)
 
I would file for the permit first, if you get rejected then contact a lawyer and persue it further based the grounds you were denied on. To open up a can of worms and bring everything out in the open is not in your favor.

rojoe, thanks man.. i dont let it bother me too much.. but it does become annoying.. this isnt english class so who cares. im just hoping i dont get a hard time trying to get my permit because i got arrested (in a self defense situation in a small town when i was the out of towner) when i was 19.
 
Pretty much the only time my punctuation is correct is when I'm trying to write something to someone that I need to look intelligent for. Other than that, if it comes out right good, but if not then I dont care. That said, Kenny's advice sounds like the best Ive heard. That seems to be the only way our legal system works, you can't effectively challenge something until it has happened to you.
 
just another tid bit of info..

this was supposed to be completely erased as per my lawyer in 93.. they even mailed me back my finger prints, and mugshots..

so my question is, would there still be info in the records on me even if this was exponged (so to speak)? im going to call the lawyer to see what they have to say, but i thought id ask here too..
