I bet if you interviewed the guy who got shot he would say he never advanced toward the woman. Some lawyer must have gotten to her to ensure that she was "in fear for her life" before she shot.

Yep, total speculation. He could have been attempting to disarm her. His reaction after having been shot suggests that he wasn't agressively desirious of harming the little old lady.
 
Well, why would you make a statement that amounts to total speculation?

Why would you suggest that a lawyer "got to her"? Or that a LE told the lady what to say? Why would you post something like that?
 
I don't know how people can buy a gun and never even fire it, boggles the mind. For an old woman I'm more sympathetic. Since the gun had enough recoil to knock her to the ground I wonder what kind and caliber it was?
 
Fremmer, just trying to make all the pieces fit. The guy was clearly not aggressive or he might have hurt the little old lady after having been shot. I don't doubt that the lady "believed" her life was in danger, I just doubt that her belief was consistent with the facts of the situation. In this case, whether by accident or because of good advice, she said the right thing. A lesson to anyone who might someday be a similar situation. It would be interesting to read the homeless guys statement about what happened.

An old lady who needs a walker is generally a pretty unstable creature. Breath of wind knock 'em over type unstable. Couple that with not knowing what to expect when the gun is fired, and it's no real wonder she went down -- and wouldn't be a function of caliber, not really. A .22 might have done it!

My Va CCW instructor told the class that the average man had the strength to break the average woman's neck with his bare hands. Couple this with the Tuller Drill and the lady's age and I can see an argument being made for her being in fear of her life.

I know if I were the DA she would not be indicted, but there is little chance of that ever being the case.
