pacers shooter gets charged!

I was on a rifle range at Fort Benning during the Army matches. Somebody made a boo-boo and opened a 9mm range before the rifle range we were having lunch on was closed. Some of us were on the RH berm having lunch when we heard strange noises that turned out to be 9mm bullets. A couple of guys laying down on the berm got hit by the expended 9mm bullets. They got some pretty good bruises but no serious injuries.

A human weighs much more than a chunk of lead and therefore has a greater ability to "push through" the air resistance. It is like the myth on myth busters about dropping change from a tall building. Worst case scenario is a small cut. Now if you are talking about shooting at an angle then it is an entirely different story.

I'm not justifying the shooting by pointing the quote out. I am just tired of hearing uneducated people talk about subjects they know nothing about. People think a bullet (shot straight up) hits the ground as fast as it left the gun and that just simply is not true. Not even close to true in fact.

NONSENSE! Mass is mass - period. The vastly larger surface area of the human body in relation to its total mass means DRAG - and a LOT of it.

Moreover, the lead bullet is far dense than the human body, with far less drag. The issue is mass as a function of drag; not weight alone. The bullet will drop far faster than a human body, even in the "cannonball" position.

That said, terminal velocity remains the point at which drag equals acceleration, which is far less than a bullet's fired velocity. As has already been noted, an angled shot will be much more dangerous than a vertical, or near-vertical shot.
 
Humans are deffinately less aerodynamic than small rounded pieces of metal.

Were you are talking about transsonic pressure buildup on the leading edges of a rocket-assisted falling human's shoulders, Savage10FP308?

If not you must need to read your high-school physics books again...

I am just telling you what I have seen with my own two eyes! On mythbusters, a penny had a terminal velocity around 60 MPH. I agree that a bullet would probably travel faster than a penny but how can you prove that it would travel faster than a human? Think about it. If you are skydiving (which I have actually done before) and you have a bullet in your hand do you think if you let it go that it is going to out accelerate you to the ground? Or, does it seem more likely that the "wind" sensation would pick the bullet up because it weighs much less than you!

edit:300fps is terminal velocity for a 150g .30 caliber bullet. That is roughly 204.5 MPH. Terminal velocity for a human is about 125 MPH which means you guys are right and I am wrong. Since I am man enough to admit it, can you please quite mouthing? Also, I know a 9mm bullet would have a different terminal velocity, but I could only find the 150g .30 cal.

wouldn't bullets falling from the sky (at any angle) be considered some form of assault.... or at least reckless, dangerous behavior.

don't we agree you don't pull you gun until you intend to use it to defend yourself, not fire warning shots which i think most of us agree is reckless. please correct me on this if you don't agree.

I believe this guy was just playing gangsta and did not fear for his life or he would have defended himself instead of just posturing and brandishing his weapon.. at least that is my take on things.
 
Assault requires that the victim sees it coming and experiences "reasonable apprehension or fear".

Being hit by a falling bullet would probably be considered battery ("offensive touching") as the person would not see it coming, and they would not have consented to be touched by said bullet.
 
I personally don't think he was justified in using warning shots. I don't know anyone who teaches warning shots as an acceptable means of self defense. Assuming he was a law abiding gun owner, the only reason to discharge your weapon should be to stop an attack, not wildly firing five shots in the air in the hopes you scare away the one or two specific people who are attacking you, never mind the thirty or so bystanders. And I don't know about all that terminal velocity crap, but we have had cases here in New Mexico where people have been killed by falling bullets. It's on the books, they even caught some of the new years celebratory shooters in one case. So yeah, they can kill people, end of story. I think he should be prosecuted right along with the guys who attacked him.:cool:
 
"Assault" is not a crime in Indiana. Battery requires a knowingly or intentionally mens rea. The great Internet crime "brandishing" does not exist in Indiana.

"Recklessness" is conduct done in plain,, conscious, and unjustifiable disregard of harm that might result and the disregard involves a substantial deviation from acceptable standards of conduct.

IIRC, warning shots are taught in the Indiana Law Enforcement Academy and there is a General Order (IIRC--may be a Use of Force Order, mostly crowd control/riot situations) regarding their use at Indianapolis Police Department. Let's hope Mr. Volyes sends a subpoena duces tecum and crams those policies sideways up the IPD detectives at depositions.:D Wait and see.

From the R. Brothers, Barnum & Bailey precedent (elephant took a dump on a audience member) I thought that even unintended "offensive touching" could be considered battery?

Assault and "brandishing" are not crimes in IN? Wow. I'll have to remember to threaten to punch someone and pull my piece randomly a few times the next time I'm up in the corn :)
 
Yes, the crime of battery requires intent, it is not an infraction (no mens rea required for speeding or running a stop sign). Battery is knowingly or intentionally touching another in a rude, insolent or angry manner.

Note that battery, the crime, is distinct from a civil lawsuit regarding negligence of a circus animal and breach of duty.

Assault does not exist in Indiana. Brandishing, the great Internet crime of gun nut boards, does not exist. Be advised we do have "Intimidation" and "Pointing a Firearm".

Keep your hands to yourself and your pistol in your holster here during visits to the Hoosier state, especially around election time, and you will be fine.:D

Mike Tyson, at the height of his boxing career, was convicted by Indiana prosecutors and sentenced to prison by an Indiana judge.

Jackson is not being prosecuted in California. However, Mr. Volyes should motion the court to transfer his case to California.:D
