Open carry legal in Oregon.

I used to think there'd be no way I'd open carry but I've slowly come around to the point of view that I would prefer it. I'd get a really good retention holster and a smaller gun such as the Kahr PM40 and take it with me everywhere if it were legal here in the PRC. Also, I'd learn some good retention techniques and maybe carry a short fixed blade knife on my belt right in front. That way I could grab the knife and slice the hand of some bozo who was trying to take my gun. :eek: The reason I've changed my mind on the matter is because I do believe criminals avoid a person who is obviously ready to handle trouble. They prefer an easier target. HOWEVER, there is that very small per centage of the criminals who take something like open carry as a "challange" and think they just have to try and get the best of somebody, thus the knife.
 
I have no idea about gun laws in Oregon, but my question is, if it is technically legal to open carry a firearm in Oregon, why do the police stop this man and question him?.

Because people get scared. Also the cop doesnt seem like he supports people carrying openly. He might just be a jag off looking to harass someone.

I can understand people getting scared at someone openly carrying, but again, if it's legal, isn't it the police's duty to know their Laws and rules, and to inform the citizens about them if necessary?. It's about helping and serving, as far as I know.

To be honest, this should have started by the Officer responding the phone at 911. OK to dispatch a couple of Officers to find out who is causing alarm, make sure he's not intoxicated or crazy, but once that has been done, his job is done.

I'm a cop myself, but I'm sorry to say I can't approve of some attitudes. Whether you like them or not, rules are rules, you have to be abide by them. And some of the basics of this job is not bothering anyone who isn't doing anything unlawful.
 
Nordeste; It is perfectly legal to OC in OR, WA, MT, ID and a lot of other states in the US, especially in the western part. I have open carried for over 40 year, with only one (two word) interface with a Deputy Sheriff, and this was years ago. He was really more interested in informing the lady that made the 911 call that it was perfectly legal for someone to OC in WA. I think my problem was my carry was semi concealed by my coat. The Question the officer asked was "hunting" my answer was "yep"... even concealed that is perfectly legal here without a permit..I do have a permit, but he never asked as for the purpose I was carrying it is not required...I was leaving a grocery store after purchasing supplies.

Why does the police officer stop and question this man? I am not sure. I know where I live in Central WA (and I know this is so in other parts of WA state) the 911 operator would first ask the caller if the man with the OC was doing anything more than just walking down the street or shopping in the store. If the caller answers in the afirmative, the OC is doing nothing unusual, the caller will be informed that OC is perfectly legal in WA, no permit required.

I also know, that unless you are in a public building (in OR) the police cannot just ask you for your permit. OC does not require a permit in OR either. It could be the officer did not know the law, it is possible the officer did not like the law and wanted to do his own thing, (it happens) it is possible the officer actually came from some place like California, moved to OR, and still was thinking California law??? Who knows.

So, lets say someone that does not know OC is legal calls the 911 dispatch center. 911 dispatches an officer to check it out. This officer has been told (department policy) that he has to make contact, if possible, and write a report on any 911 call. Let's also say the officer does not know Oregon's OC law (or should I say lack of law prohibiting such) because OC in OR (WA, ID, MT ETC) is not based on code, it is based on the STATE constitution and court rulings based on that constitution...

Should the man have been stopped? No. Does that mean you can OC here and never be questioned? No, there are some officers that do not just drive by and note the person was legally OC in his report. Some officers do not like the idea the a non-LEO can carry, (usually their juristictions get to pay for that mistake if the OC decides to take it to court).
 
Anyone can OC in OR. Just be careful about Portland Metro, Salem, Astoria and Independence. They have a prohibition on LOADED OC.

When Oregon wrote their preemption, they allowed local government to restrict unlicensed LOADED OC. Portland, Beverton, Salem and Astoria all have restrictions on loaded OC without a CHL.

Interesting thing happened a few days ago. A guy from WA has his OC sidearm confiscated while watching a parade in Astoria. The new article did not say if he had a WA CPL, but did say he did not have an OR CHL.

The way Astoria's law on loaded OC is written, it is possible, if he has a WA CPL, that he can beat this. Astoria's law does not require a license from OR, it only requires a license from "lawful authority"????

Anyway, yes, you can loaded OC without a license anywhere in OR, including in your vehicle, except those places listed above (and maybe a couple others, check first) www.opencarry.org has an Oregon forum, first sticky has a quick reference card (.pdf) to OR OC rules. about post #20

OR will issue a CHL to neighbor states that gets rid of all these silly local restrictions. Sheriff Palmer in Grant county is very 2A favorable and will make it easy for you to get a OR CHL if you want (I noticed you live in CA)

Yes indeed I do live in the PRC and on my next trip north I'll be stop'n by Sheriff Palmer's place of business to get my OR LTC, you bet yer bippee Bubba!!:D
 
I've heard multiple reports of police "investigating" people who were lawfully open carrying in California when it was legal there.
