NRA Wins Restraining Order Against Confiscations

(Fairfax, VA) -- The United States District Court for the Eastern District in Louisiana today sided with the National Rifle Association (NRA) and issued a restraining order to bar further gun confiscations from peaceable and law-abiding victims of Hurricane Katrina in New Orleans.

“This is a significant victory for freedom and for the victims of Hurricane Katrina. The court’s ruling is instant relief for the victims who now have an effective means of defending themselves from the robbers and rapists that seek to further exploit the remnants of their shattered lives,” said NRA Executive Vice President Wayne LaPierre.

Joining LaPierre in hailing the U.S. District Court decision was NRA chief lobbyist Chris W. Cox. “This is an important victory. But the battle is not over. The NRA will remedy state emergency statutes in all 50 states, if needed, to ensure that this injustice does not happen again."

The controversy erupted when The New York Times reported, the New Orleans superintendent of police directed that no civilians in New Orleans will be allowed to have guns and that “only law enforcement are allowed to have weapons.” ABC News quoted New Orleans’ deputy police chief, saying, “No one will be able to be armed. We are going to take all the weapons.”

The NRA also pledged that it will continue its work to ensure that every single firearm arbitrarily and unlawfully seized under this directive is returned to the rightful law-abiding owner.
 
Great post and thanks for the good news. Now I hope all 50 States get something meaningful passed to insure this does not happen again.

I want the mayor, the police chief, and whoever backed this action to make a public apology...ON TV DAMNIT!! I want to see you beg for forgiveness.

Maybe this will put some legislation about securing the right to protection on the federal level...

I'm so furious, I should be happy though....WE WON!

Until all 50 states recognize the 2nd Amendment and allow folks to carry, we still have yet to win.

Next on the agenda should be going after the N.O. superintendant of police who issued the confiscation edict, which he had NO constitutional or lawful authority to issue. At the minimum, he should be fired from the job he used to abuse his authority.

I hope all the lawful citizens who were forcibly disarmed get together and file a class action lawsuit against this socialist powermongering bottom-feeding bureaucrat. He is a disgrace to police officers everywhere and an enemy of We The People.

It is truly a sad commentary when the NRA has to file lawsuits to get "the Government" to honor the Constitution and Bill of Rights, but that's life in America in the year 2005.

We must continue the fight within the courts, or we will one day be fighting socialist tyranny in our front yards.

I'd much prefer the LA or US AG bring them up on charges ranging from Malfeasance in Office to Criminal Theft to Civil Rights Violations.

I agree with Wild. This is the most significant ruling since Emerson. At this juncture, it would not be too far-fetched to rule out prosecutions.
 
Hmmm, prosecutions, unlikely, but potential contempt of court actions would make me happy! :D

Expect it to happen Rich. We do like our stuff hot& spicey here in Louisiana, and this will be one of the better ones since Edwin. :D

If I may, I would also like to encourage anyone working with Louisiana evacuees out of state to go here, request a petition and gather a few signatures to send in. If Kalifornia can get Mr. Davis out of office, Mrs. Blanco's days are numbered!

You mean that lazy, worthless NRA that never does anything for gun owners and just rolls over when our gun rights are violated? The one that's so ineffective compared to the real RKBA organizations? That NRA?

Interesting that the suit was filed jointly by NRA and SAF, but NRA gets all the credit in their news release and SAF gets left out.

FEDERAL JUDGE HALTS NEW ORLEANS GUN SEIZURES

BELLEVUE, WA The U.S. District Court for the Eastern District of Louisiana this afternoon issued a temporary restraining order on behalf of the Second Amendment Foundation (SAF) and National Rifle Association (NRA), bringing an end to firearm seizures from citizens living in and around New Orleans.

District Judge Jay Zaney issued the restraining order against all parties named in a lawsuit filed Thursday by SAF and NRA. Defendants in the lawsuit include New Orleans Mayor Ray Nagin and Police Chief Edwin Compass III.

"This is a great victory, not just for the NRA and SAF, but primarily for law-abiding gun owners everywhere," said SAF founder Alan M. Gottlieb. "We are proud to have joined forces with the NRA to put an end to what has amounted to a warrantless gun grab by authorities in New Orleans and surrounding jurisdictions."

"Over the past three weeks," he continued, "residents who had lost virtually everything in the devastation following Hurricane Katrina had also essentially been stripped of something even more precious, their civil rights, and their right of self-defense, because of these gun seizures.

SAF and NRA had no alternative but to take action, Gottlieb added. If these gun confiscations had been allowed to continue without challenge, it would have set a dangerous precedent that would have encouraged authorities in other jurisdictions to believe they also could suspend the civil rights of citizens in the event of some other emergency.

"What must happen now, and quickly," said Gottlieb, "is for authorities in the New Orleans area to explain how they will return all of those firearms to their rightful owners, and do it promptly. What this ruling affirms is that even in the face of great natural disasters, governments cannot arbitrarily deprive citizens of their rights. Thanks to some great teamwork between SAF and the NRA, this sort of thing will hopefully never happen again."

So SAF acknowledges the assistance of NRA, but NRA won't acknowledge SAF's role in the victory. :(
 
Blues Man, some of us have taken to writing the NRA, hopefully to rectify this "oversight." It great that something was finally done, but credit should be given, in all announcements, where credit is due. The 600 lb Gorilla can afford to share the limelight.
 
I'm renewing my NRA membership today but....

it's bloody well time for all the RKBA organizations to sit down at a table together, grow up, quit squabbling, set some common goals, and kick a$$.

United we stand, divided.... you know the drill.

Could it work, or are there too many egos and too much money involved?
 
Kinda knew it already, but one can voice a wish out loud every once in a while.

and Bobshouse, maybe Mr. Compass should be assigned a job, like in the prison laundry for a while?
