New NY State AW Ban on the move... Please get involved!!!

Guys, as you may already know there is a move afoot in NYS to amend & strengthen our current AWB. Our gun-grabbing politicians are now looking to remove the "grandfather clause" in the current law, which would result in the instant criminalization of "pre ban" weapons, and would require the owners of these weapons to destroy them, sell them out of state, or surrender them to the "proper authorities"!!!

Needless to say the stakes are quite high for those of us who can't or won't move to a "free state", so it's time to roll up our sleeves & get to work on crushing this legislation before it gains any momentum!

NY Gun Grabbing

Well I really feel for those people who will be affected by this. But I have to say I dont think your gonna get enough people together to make a difference. The reason I say this is because of the fact the state of NY spoke when they voted for one Hilary Clinton. My family originally came from NY and a good portion of my family still lives there. Why I will never know. My best advice to the folks who like there guns and live in NY is get the hell out of there while you still can. Everybody I know in NY said there is snow balls chance in hell Hilary would get elected well guess what she is now the Senator. So dont fool yourself by thinking this new ban will not get enacted. Hope it works out, but I dont have faith in NY no more. One other thing after having read the thread you linked to if you guys do somehow get this ban kicked to the curb I suggest you take note of the represenatives that are ramrodding this bogus extravaganza and be damn sure you dont cast any votes there way come the next election.

Thats sort of the point here.

More people WILL be affected by this if we don't nip it in the bud. You may not live in NY or have any contact with NY, but you need to get involved in helping to fight it. If this passes it will be a sign to other states to try to adopt similar legislation and the push will be on at the state level. Similar bans have been proposed in PA, MD, and FL. The antis have realized they lost at the federal level so they're taking it to the states. Its a strategy of divide and conquer. Go to the link provided by NYPatriot and consider a small donation to the New York State Rifle and Pistol Association PAC. Just remember, if we don't hang together, we'll most assuredly hang seperately.

PS - K80Geoff- don't feel too safe sitting in PA. I live in PA, but if this passes in NY, PA is almost certainly going to be next to go. We can't let NY fall - this cancer WILL spread if we don't kill it ASAP.

AN ACT to amend the penal law, in relation to the definition of an
assault weapon

The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:

1 Section 1. Subdivision 22 of section 265.00 of the penal law, as added
2 by chapter 189 of the laws of 2000, is amended to read as follows:
3 22. "Assault weapon" means (a) a semiautomatic rifle that has an abil-
4 ity to accept a detachable magazine and has at least two of the follow-
5 ing characteristics:
6 (i) a folding or telescoping stock;
7 (ii) a pistol grip that protrudes conspicuously beneath the action of
8 the weapon;
9 (iii) a bayonet mount;
10 (iv) a flash suppressor or threaded barrel designed to accommodate a
11 flash suppressor;
12 (v) a grenade launcher; [or]
13 (vi) a forward grip;
14 (vii) a barrel shroud; or
15 (b) a semiautomatic shotgun that has at least two of the following
16 characteristics:
17 (i) a folding or telescoping stock;
18 (ii) a pistol grip that protrudes conspicuously beneath the action of
19 the weapon;
20 (iii) a fixed magazine capacity in excess of five rounds;
21 (iv) an ability to accept a detachable magazine; or
22 (c) a semiautomatic pistol that has an ability to accept a detachable
23 magazine and has at least two of the following characteristics:

S. 2445 2 1 (i) an ammunition magazine that attaches to the pistol outside of the 2 pistol grip; 3 (ii) a threaded barrel capable of accepting a barrel extender, flash 4 suppressor, forward handgrip, or silencer; 5 (iii) a shroud that is attached to, or partially or completely encir- 6 cles, the barrel and that permits the shooter to hold the firearm with 7 the nontrigger hand without being burned; 8 (iv) a manufactured weight of fifty ounces or more when the pistol is 9 unloaded; 10 (v) a semiautomatic version of an automatic rifle, shotgun or firearm; 11 [or] 12 (vi) a second pistol grip; or 13 (d) any of the weapons, or functioning frames or receivers of such 14 weapons, or copies or duplicates of such weapons, in any caliber, known 15 as: 16 (i) Norinco, Mitchell, and Poly Technologies Avtomat Kalashnikovs (all 17 models); 18 (ii) [Action Arms Israeli Military Industries] UZI [and], Galil and 19 UZI Sporter, Galil Sporter, or Galil Sniper Rifle (Galatz); 20 (iii) [Beretta Ar70 (SC-70)] AR70; 21 (iv) [Colt] AR-15, Bushmaster XM15, Armalite M15, or Olympic Arms PCR; 22 (v) Fabrique National FN/FAL, FN/LAR, and FNC; 23 (vi) SWD M-10, M-11, M-11/9, and M-12; 24 (vii) Steyr AUG; 25 (viii) INTRATEC TEC-9, TEC-DC9 and TEC-22; [and] 26 (ix) revolving cylinder shotguns, such as (or similar to) the Street 27 Sweeper and Striker 12; 28 (x) AK, AKM, AKS, AK-47, AK-74, ARM, MAK90, Misr, NHM 90, NHM 91, SA 29 85, SA 93, VEPR; 30 (xi) AR-10; 31 (xii) Calico Liberty; 32 (xiii) Dragunov SVD Sniper Rifle or Dragunov SVU; 33 (xiv) Hi-Point Carbine; 34 (xv) HK-91, HK-93, HK-94, or HK-PSG-1; 35 (xvi) Kel-Tec Sub Rifle; 36 (xvii) M1 Carbine; 37 (xviii) Saiga; 38 (xix) SAR-8, SAR-4800; 39 (xx) SKS with detachable magazine; 40 (xxi) SLG 95; 41 (xxii) SLR 95 or 96; 42 (xxiii) Sturm, Ruger Mini-14; 43 (xxiv) Tavor; 44 (xxv) Thompson 1927, Thompson M1, or Thompson 1927 Commando; 45 (xxvi) Calico M-110; 46 (xxvii) MAC-10, MAC-11, or MPA3; 47 (xxviii) Olympic Arms OA; 48 (xxix) Armscor 30 BG; and 49 (xxx) SPAS 12 or LAW 12; or 50 (e) a conversion kit; 51 (f) provided, however, that such term does not include: (i) any rifle, 52 shotgun or pistol that (A) is manually operated by bolt, pump, lever or 53 slide action; (B) has been rendered permanently inoperable; or (C) is an 54 antique firearm as defined in 18 U.S.C. 921(a)(16); 55 (ii) a semiautomatic rifle that cannot accept a detachable magazine 56 that holds more than five rounds of ammunition;

S. 2445 3 1 (iii) a semiautomatic shotgun that cannot hold more than five rounds 2 of ammunition in a fixed or detachable magazine; 3 (iv) a rifle, shotgun or pistol, or a replica or a duplicate thereof, 4 specified in Appendix A to section 922 of 18 U.S.C. as such weapon was 5 manufactured on October first, nineteen hundred ninety-three. The mere 6 fact that a weapon is not listed in Appendix A shall not be construed to 7 mean that such weapon is an assault weapon; or 8 (v) a semiautomatic rifle, a semiautomatic shotgun or a semiautomatic 9 pistol or any of the weapons defined in paragraph (d) of this subdivi- 10 sion lawfully possessed prior to September fourteenth, nineteen hundred 11 ninety-four. 12 § 2. Section 265.00 of the penal law is amended by adding eight new 13 subdivisions 24, 25, 26, 27, 28, 29, 30, and 31 to read as follows: 14 24. "Barrel shroud" means a shroud that is attached to, or partially 15 or completely encircles, the barrel of a weapon so that the shroud 16 protects the user of the weapon from heat generated by the barrel, but 17 does not include a slide that encloses the barrel, and does not include 18 an extension of the stock along the bottom of the barrel which does not 19 encircle or substantially encircle the barrel. 20 25. "Conversion kit" means any part or combination of parts designed 21 and intended for use in converting a weapon into an assault weapon, and 22 any combination of parts from which an assault weapon can be assembled 23 if the parts are in the possession or under the control of a person. 24 26. "Detachable magazine" means an ammunition feeding device that can 25 readily be inserted into a weapon. 26 27. "Fixed magazine" means an ammunition feeding device contained in, 27 or permanently attached to, a weapon. 28 28. "Folding or telescoping stock" means a stock that folds, tele- 29 scopes, or otherwise operates to reduce the length, size, or any other 30 dimension, or otherwise enhances the concealability, of a weapon. 31 29. "Forward grip" means a grip located forward of the trigger that 32 functions as a pistol grip. 33 30. "Pistol grip" means a grip, a thumbhole stock, or any other char- 34 acteristic that can function as a grip. 35 31. "Threaded barrel" means a feature or characteristic that is 36 designed in such a manner to allow for the attachment of a firearm as 37 defined in section 5845(a) of the National Firearms Act (26 U.S.C. 38 5845(a)). 39 § 3. This act shall take effect on the first of November next succeed- 40 ing the date on which it shall have become a law.

In other words, say goodbye to your "post ban" models!

I was stationed at Griffiss AFB (when it was open) in Rome NY and up state is very beautiful and the people are just like those in the free states.

If only you could get rid of that cesspool that is called New York City then NY would be such a state (free).

I feel for you and I hope that you get enough in upstate NY to put this down but with the city and them having more people then upstate I don't know if it can be done.

Hey shaggy your right and Im more than willing to do my part. But when this is at the state level which if im not mistaken is, then really the only people that are gonna have enough pull are the NY residents. And they have shown there colors time and time again. I fear the Liberal anti-gunners make up the majority of the states population either that or our brothers in arms arent voting when they need to.

Sent a letter to my State Senator. My Assemblyman is a dem..I'll send him a letter too for all the good it will do. God I hate living in this state! :mad:
 
The bill getting Sponsored in the Senate is the best thing that could have happened!

SCHNEIDERMAN is the Deputy MINORITY leader. Him sponsoring that bill is sure death! Bill will never reach the floor. GUARENTEED.

Next Battle. (if you would like when I get a chance I can provide a long list of anti-gun bills that are circulating through the Assembly-most are relatively old bills that have just been re-introduced tho)

A968 seeks to expand ballistic imaging to shotguns and rifles too. But Schdeiderman picked up that bill in the Senate so its dead.

If you know how the Legislature works you'd know this bill is dead! Focus your energy elsewhere. Unless bill is sponsored in Senate by a Republican it will not reach the floor, it will just get stuck in Rules.
 
Camaro81 hope there is some truth to what you are saying for the sake of all New Yorkers, and quite likely many of the surrounding states. If these kind of Bills do get passed, NY is gonna turn out just like California and that wont be good.

As a registered voter and life long resident of New York, I am writing you in order to express my strong opposition to any amendment or strengthening of our state’s so-called “Assault Weapons” ban. Rather than further limiting the types of weapons that responsible, law-abiding citizens have the right to possess; I encourage you to focus your energies on toughening the consequences for those who illegally use firearms in the commission of violent crimes.

By standing in opposition to such draconian legislation as A.03371 & S.2445, you and your party will benefit by gaining the favor of countless New York gun owners who actively support their freedoms. I’m deeply passionate about this issue, and I know many others who take gun control into serious consideration when entering the voting booth. You Sir, stand only to benefit by supporting our right to bear arms.

Thus, I once again implore you to stand in opposition to any and all incarnations of a strengthened or amended “Assault Weapons” ban.

As an avid hunter and registered voter I want to encourage you to work against the passage of any & all legislation that threatens to amend or strengthening of our state’s so-called “Assault Weapons” ban. These unfairly categorized sporting guns neither cause, nor significantly contribute to violent crime in New York State, and recently introduced legislation aimed at further limiting their ownership (A.03371 & S.2445) serves only to erode & weaken every New Yorker’s God given and Constitutionally enumerated right to bear arms. Any elected official that supports either of these gun control bills will lose my support, and the support of my family and friends across the board.

Please understand that the frustration of New York’s gun owners stems from years of incremental erosion of our personal freedoms. The “Assault Weapons” ban is clearly an infringement of these rights, and as such, it needs to be cast upon the ash heap of history. Any political compromises, back room negotiations, or last minute concessions that result in the strengthening of the ban will be viewed as a rejection of our nation’s founding principals, and as a betrayal of the countless New York sportsmen who work, raise families, pay taxes, and most importantly…vote.

If you truly want to combat violent crime in our state, please support measures that are effective and that do not infringe upon the rights of honest, responsible, law-abiding people. I encourage you to focus your energies on strengthening the penalties for those who illegally use firearms in the commission of violent crimes. Go after the criminals who flout the law, not the citizens who obey it.

Hence, I once again urge you to oppose all efforts to amend or strengthen our state’s “Assault Weapons” ban, and I remind you that any attempt to pass A.03371 & S.2445 will be remembered none too fondly come next Election Day.

The usual anti-gun politicians in Albany are calling for a needless amendment of the current ban (in the form of S.2445 & A.03371) that would criminalize the possession of self-loading shotguns (a favorite of hunters), most detachable-magazine self-loading rifles (used by marksmanship competitors), and so called “pre-ban Assault Weapons” which are currently & legally owned without incident by countless New York gun enthusiasts, hunters, and collectors. Please understand that the unreasonable efforts of these freedom-robbing politicians should not be supported or tolerated in the least.

I feel compelled to also point out that in every major federal, state, & privately commissioned crime study that has ever been conducted, "Assault Weapons" play a statistically insignificant role in violent crime. The only thing accomplished by such restrictive legislation is the continued erosion of our Second Amendment rights. Rather than further limiting the types of weapons that honest, responsible, law-abiding citizens have the right to possess; I encourage you to focus your sights on toughening the legal consequences for those who use firearms in the commission of violent crimes.

Thus, I urge your vigorous opposition to any legislative effort to strengthen or amend New York State’s "Assault Weapons" ban, as well as to any other measures that effectively deny citizens the right to choose which ever means they deem to be appropriate in protecting themselves and their loved ones.

We have "Shall Issue" and Class III, and no NYC!


I seriously doubt that enough people in NY care enough to even try to oppose this bill. Most I knew were resigned to loosing their guns eventually. Even the gentlemen shotgunners believe they will have to give up their sport at some point in the future.

NY is far worse than California already, just look at the laws on the books already.

Wise up and get out...before they steal everything.

It is not just guns either.


At some point when you find yourself standing naked in the street, holding your family jewels tightly in your hands and waiting for someone to come and take them it will be too late.

If I may, may I copy your letters and put into my files? We here in Oregon are going to go through the same fight (to enact an AWB) and your letters would be great to be able to use (with some word and bill number changes of course).

Believe me, I wished that I could help in your fight but I don't think that any of the people that you mentioned would care less about what a person out of state would say.

Plus, we are gearing up for our own fight here. I wish you well :).

I hate to break it to you, but its already been proposed by the democrats several times. Fortunately its been shot down everytime too, but make no mistake the push is on for an AWB even in PA. State legislators from Philadelphia, Harrisburg, and Pittsburgh are the driving forces behind it and those are the main population centers in PA. True, we don't have a NYC in PA, but those three cities collectively create the same dynamic as in NY with NYC. The rural gun owners are getting steamrolled by the democrats in the major population centers. We ARE on shaky ground here. Sticking our heads in the sand and saying "it can't happen here" is the worst thing we can do. You are absolutely correct in that PA has a shall issue CCW, is generally NFA friendly, and has no AWB or magazine capacity restrictions. But the fact we have those things now is no guarantee we will continue to have them. Those favorable gun laws are the stakes we're playing for.

USP45usp brough up one thats been proposed in Oregon. The cancer is obviously spreading as HCI realized they'll never get another federal AWB while GWB is in the Oval Office. They're pushing at the state level now and we need to remain vigilant.
