Need Help On CALI Arms Law!

I live in California and don't know what is legal and not legal no more since there seems to be a new gun law added every week. I was wondering what ype of rifles are legal to have? I have a Ruger 10/22 with all thepre ban stuff so I know some of that is illegal but I'm talking more into some serious rifles here. And the ones I like are assault type rifles and I know they are banned but don't know if there is any short cut of sorts. The ones I am really interested in are AR-15 or AK-47. Are there any types of these guns allowed in CA. Thanks for all the help.:mad:
 
You may only have two arms in the PRK!

The People's Republik of Kalifornia will only allow you to have two arms. I tried to get a third arm sowed on, but they made me removing it immediately.

Seriously, you can forget all of the AK's. Gone. The only AR you may buy is a new one they came out with that has a fixed mag or an AR without a pistol grip. Really your options are limited. I would recommend getting an M1A instead while you still can.

Sorry, we are just screwed. I got AR fever in February and I was so disappointed to not be able to get one. I ended up shelling out $900 on a 10/22 project instead. :eek:
 
I dont mean to fuss but 900 bucks on a 10/22??? I would have just kept saving the cash till I could get an M1A with a McMillan camoflauge stock... For me I think 200 is the max on a 10/22. But on a side note... i wanted to bring my AR home to CA for the summer and then found out that I couldnt register it... a big dissapointment. They will probably ban my Rem 700 PSS next. After that, they will probably ban spit balls and pea shooters because of the lethality of them. Damn Kalifornia...
 
If your going to keep the 10/22 in an illegal configuration, you might as well go all the way. Get an AK and an AR. Once you've broken the law, you have little else to loose. The judge will probably run all of the subsequent violations concurrent with the first one. Do yourself a favor and leave Kalifornia.

The short answer is no, the AR and AK

series weapons are not available for purchase in California.

The long answer gets a little fuzzy. The way the law is written is so confusing for DA's and local LEO's to interpret that even they don't know what a "Series" weapon is.

However, you'll be hard pressed to find a dealer who will be willing to utilize the current loopholes in SB23 and the RR "series" bans to sell you an AK or an AR. Most dealers won't stick their necks out for you even if you are within the limits of the law.
 
It is a good 10/22.

After putting together a nice Rem 700 VS in .308 with a nice Leupold 6.5-20 LRT and a HS Tactical stock, I couldn't stand my 10/22 if it didn't shoot equivilantly. I bought a new 10/22, scrapped everything except the receiver. Bought a Volquartsen THM 16.5" bull barrel, Volquartsen trigger group, Hogue stock, and the final touch, a Burris 4-12x32mm compact target scope. That .22 doesn't miss! Sure it was a lot of money, but now I can shoot that .22 cheap and as accurate as can be. Ground squirrels beware! Plus I already had an M1A too. I needed a mouse gun. :D
 
The only legal "assault type' weapons you can get are:
M1A
Mini-14
SKS, fixed magazine

FAL/FNC rifles are being sold with the pistolgrip completely detached to meet the "points", and while they're still being sold in CA ($2100 rippoff pricing), this is questionable and you may probably be setting yourself up for some jailtime if you get stopped, -it will be up to the judge to interpret the legalities.

I have also seen AR15s fully converted to .22LR which are legal to own.

FALS are legal in PRK WITHOUT pistol grips, period.

The law is clear: series weapons are banned, meaning ARs, AKs, HKs, etc.

M1As and FALs are NOT series weapons.

Non series weapons need detatch mags AND pistol grips to be illegal, ie the features rather than the name make them illegal.

M1As, as pointed out above, are NOT banned, nor are mini 14s. Why not? They do not contain enough evil features.

Neither does a FAL without a PG.

Entreprise is a local Cali company that makes FAL receivers and sells both the stripped receivers and assembled rifles minus pistol grips in Cali to residents of this state.

There's nothing ambiguous about this, DOJ has ruled, as if they had a choice, that this is legal.

Ent records every sale pursuant to state law. If is was somehow a grey area, doncha think maybe DOJ would pull the plug on this, since they're in there on a regular basis?
 
I just went to the Entreprise site ... looks like an STG-58 is certainly available without a pistol grip in CA ... but how do you shoot the crazy thing? The trigger looks to be a mile and a half in front of the neck on the stock! Do they sell 'em with one of those winter trigger extentions that sticks back behind the trigger guard? Just curious.

This is very depressing!

I hate it! I love California and would not trade this place for the world, but the gun laws here are ridiculous. No AK, No AR? This sucks! Is this true that there is a limit of 3 guns per person in Cali? So these rifles you guys have listed are my only options huh? I know quite a few people here especially in law enforcement that carry illegal guns like AK and AR's. They are LEO's but they hate this gun law thing also and just seems like they are losing their own rights for what they are fighting for everyday. They are out protecting us and this is their reward. How about any HK rifles? Any of them legal here? Thanks alot for the sad infos guys.:(
 
By the way guys, you guys have any site I can go to to check out the SKS and M1A? And how much do they usually cost? Forgot the exact size but what size ammo does the AK and AR use by the way. Thanks again.

For the purposes of this guide, assault weapons are divided into three categories. These are: Category 1 - Penal
Code section 12276 subdivisions (a), (b), (c) (Roberti Roos Assault Weapons Control Act of 1989); Category 2
- Penal Code section 12276 subdivisions (e) and (f) (Kasler v. Lockyer, AK and AR-15 series assault weapons);
and Category 3 - Penal Code section 12276.1 (SB 23 - generic characteristic assault weapons). A combined
listing of Category 1 and Category 2 assault weapons can be found on page 82.
Category 1. The Roberti-Roos Assault Weapons Control Act of 1989
This was California’s first assault weapons act. Under this act, any firearm on a list specified in Penal Code
section 12276 is considered an assault weapon. Such assault weapons are controlled (i.e., may not be legally
purchased, kept for sale, offered for sale, exposed for sale, given, lent, manufactured, distributed, or imported)
after December 31, 1991, and were required to be registered as assault weapons with the Department of Justice
no later than March 31, 1992. In addition, the Roberti-Roos Assault Weapons Control Act controlled AK and
AR-15 series assault weapons (Penal Code section 12276, subd (e) and (f) - see Category 2). These assault
weapons are controlled regardless of whether they have Category 3 (Penal Code section 12276.1 - SB 23)
characteristics.
Category 2. AK and AR-15 Series Weapons
The California Supreme Court upheld the constitutionality of the Roberti-Roos Assault Weapons Control Act of
1989 in Kasler v. Lockyer. This decision took effect August 16, 2000. Effective August 16, 2000, firearm
models that are variations of the AK or AR-15, with only minor differences from those two models, are assault
weapons under the original Roberti-Roos Assault Weapons Control Act of 1989. AK and AR-15 series weap-ons
are controlled as of August 16, 2000, and must be registered as assault weapons with the Department of
Justice on or before January 23, 2001. The only alternatives to registration are permanently removing from the
state, rendering permanently inoperable, destroying, or relinquishing the weapon to a law enforcement agency.
These assault weapons are controlled regardless of whether they have Category 3 (Penal Code section 12276.1 -SB
23) characteristics.
Category 3. Generic Characteristics
As of January 1, 2000, Senate Bill 23 (Chapter 129, Statutes of 1999) provides that firearms that have character-istics
falling under any of the categories listed in Penal Code section 12276.1 are also considered to be assault
weapons. These assault weapons are controlled as of January 1, 2000, and must be registered as assault weap-ons
with the Department of Justice on or before December 31, 2000. As an alternative to registration, these
weapons may be permanently removed from the state, rendered permanently inoperable, destroyed, relinquished
to law enforcement agencies, or have the assault weapon characteristics permanently removed before December
31, 2000.
CONFIRMATION OF REGISTRATION (Law Enforcement Agencies Only)
A Law enforcement agency may verify an assault weapon registration by consulting the Automated Firearms
System (AFS), which is accessible through the California Law Enforcement Telecommunications System
(CLETS). Each AFS assault weapon record includes the date of registration, information identifying the regis-trant,
and information identifying the weapon.
Punishment
• Possession -- Felony or misdemeanor -- (Penal Code § 12280(b))
Infraction under limited time and conditions -- (Penal Code § 12280(c))
• Manufacture, distribution, transportation, importation, sale, and transfer of assault weapons -- Felony.
(Penal Code § 12280(a))
Law Enforcement Exemption – Police departments, sheriffs’ offices, and other law enforcement agencies
specified in Penal Code section 12280(f) may purchase/possess assault weapons. Peace officers can
not purchase assault weapons and must have registered their personally owned Category 1
(Roberti-Roos Assault Weapons Control Act of 1989) on or before March 31, 1992, and must
register their Category 2 (AK and AR-15 series) assault weapons on or before January 23, 2001,
and their Category 3 (generic characteristics) assault weapons on or before December 31, 2000.

Yep, welcome to the PRK.

I love living up here by Bakersfield. Hunting is great. I can shoot all the time and anywhere I want. The only thing that makes California completely suck is the gun laws. It is depressing.

M1A is .308 Winchester/7.62x51mm. AR's are usually in .223/5.56x45 with the Armalite AR-10 being an 7.62x51mm. SKS and AK's are 7.62x39mm. Some AK varients are also 5.56x45 or 7.62x51. However, you aren't allowed to have AK's anymore so don't even worry about that.

There is no three gun rule in the PRK. If there were I would be in violation by a multiple of three. Any HK centerfire rifle with a pistol grip and detachable magazine is illegal in the PRK. So I guess the answer to the HK question is they are all illegal as far as you are concerned.

Sure looks like we live in the badlands with no guns for us,lol. I checked out all the sites and the M1 starts around $1200 so never mind. I was looking at some SKS and they range from $650-$800. These are made here in US in Nevada actually. The site is SKSMAN.com. Do you guys think these SKS's are any good? And are they legal for me to get in Cali?
 
SKS $600-800! Don't do it!

All those who think buying an SKS for over $200 say aye! Now I know I have demonstrated my insanity on spending $900 on a 10/22 recently, but I know that thing is accurate. Can there be SKS's that accurate? Please oh please don't buy an sks for that much. You should still be able to get nice Romainian SKS's for as little as $150! The SKS is not notoriously accurate and most people who scope them only become disappointed because the scope mounts aren't all that great and your point of impact ends up changing every other shot. I guess I better go check out that website. $600-800 SKS's sound like the $1700 FAL. Your money would find more use somewhere else.
 
Why do people bad mouth the .44 mag carbine?

I just recently bought a 1894P. I have had numerous people say "It only shoots a pistol caliber. You should have just got a handgun". This attitude does not make sense to me. Sure, I can see the argument against pistol caliber carbines in a 9mm or .40 caliber setup. A .44 mag is not your typical pistol caliber. It is a pistol caliber on steriods that really shines in a short barreled carbine. You gain several hundred feet per second in a carbine and really get the cartridge to reach it's potential. Out to 75-100 yards, it performs better than a 30/30. It cycles faster. And it holds twice the capacity of the 30/30.

Could it be that some people just get used to repeating the "truisms" that they hear others say and never really think things through for themselves?

I have been reading the tales of woe from the PRK, and sometimes PRNY and other occupied states. My question to you good folks is: What are YOU going to do about this situation?
 
Very Little.

I donate as regularly to the CRPA (state association) as possible, way more than I donate to the NRA. I vote and I write letters. Other than that, I take it up the rear like a good subjects/comrads/slaves. Everyone says I should move out, why don't more of you move in and help us out at the polls?
 
Well, I have researched enough and found what I can and can't get as far as assault rifles go. I think I will just get me a Mini 14 or 30 and modify the sucker all out with all I can like my Dragunov Ruger 10/22, lol. The 10/22 looks wicked with the dragunov or folding stock, a shroud, flash hider, and hand guard, etc. Especially with the 30 round banana magazine I got. I will just get a Mini and turn that sucker out too. And as much as I love guns, leaving California is way out of the question and definitely not worth it. I hope to someday see changes for the better for gun laws here but for now, I guess we are all outlaws here then...
