N.I.C.S. is instant?

Every time i try to buy a gun this so called instant system screws me around every time I have never had nothing but a damn speeding ticket and I have a CCW permit If they say instant I believe it needs to damn well stay instant

I dunno. Last year I bought 3 guns, and the NICS system took less time to approve me than the credit card authorization to pay for the guns.

Anyone that has ever had a top secret security clearance in the military will be flagged. The system is deisnged in such a way that it automatically red flags any previous investigation by the FBI. Your information must then be looked up manualy. Hence if you have demonstrated you are trustworthy enough to have a high level security clearance you get to stand and wait in the gunshop for a few minutes or hours depening upon how busy they are. Hell of a system huh?

Gunslinger,

Without trying to initiate a "flame", my experiences do not correspond with your posting. In the last year, I have bought at least five handguns in Virginia. All were cleared through the NICS computer, and all took only a few minutes (<5). I have had an active compartmented TS clearance for 30+ years, which did not appear to impede any of the Virginia State Police/NICS approvals.

Could this possibly be a state-level difference?

Fellows, the wide divergence of experiences with NICS is exactly why the system doesn't work.

If it ran as described/intended, none of us would have any incidents to complain about, since we're the good guys, and the double-damned system should reflect that. Instead, we get denied/delayed for no good reason.

Of course, this is ignoring the fact that NICS is illegal, being a violation of the US Constitution, Amendment II...

In Texas, if you have a CCW (Texas calls it a CHL), you don't have to go through the NICS since you have already been through a thorough State and FBI background check. You said you have a CCW. This rule does not apply in you state?

Halffast,

In Virginia, a CCW permit does NOT eliminate the NICS check for handgun purchase.

RWK, no offense taken. That's why we're all here. To share information. I had been told that and it seemed to make sense. Well, that is to say makes as much sense as can be made of the NICs system. As Coin said this is the reason that it doesn't work. They used to have an expression in the service that I believe applies. It was called cluster something or other.....I just can't to seem to recall the rest right now. ;)

ATF has decided that a CCW license issued prior to Nov. 1,1998 eliminates the need for the NICS check. Any license issued or RENEWED after that date must have the check performed.

Every time I've tried to buy a gun since NICS was in place I've been told that I had to wait for them to call back.

One time a friend and just happen to make purchases the same day, at the same place. His went through mine didn't.

Normally they call back within 30 minutes with a proceed. However I am currently in my 43 hour waiting for a current check to go through.

This is the second purchase I've made within 30 days which leads me to believe the government is making me wait just because they can. Anyone else with similar situations?

I was told that the wait may have something to do with ones last name. That is if you have a common last name (Jones, Brown etc) the check will take longer. Makes sense to me. My name is not very common and I have never had to wait more than 5 minutes.

I don't buy the name thing. AFAIK, I'm the only Coinneach Fitzpatrick in the whole country, and I still get delayed.

TBeck,

"ATF has decided that a CCW license issued prior to Nov. 1,1998 eliminates the need for the NICS check. Any license issued or RENEWED after that date must have the check performed."

Are you sure?
- I renewed my CHL (CCW) in March, 1999.
- I bought a handgun Sunday with no NICS check. Company man said no NICS on CHL holders before he even saw my card (to check for a date.) ??

Dennis and TBeck,

Can you please provide some further information re pre 1 November 1998 CCW licenses obviating the need for an NICS computer check?

Every time I buy a handgun, I provide the sales people three IDs (in Virginia, they want two or more): drivers license, retired military ID, and Virginia CCP (dated 21 October 1998). They always run the State Police/NICS computer check (and charge the ~$5 for doing so).

I'm not whining; my experience with Virginia's "instant check" system has been uniformly good (see my prior posts to this thread). I've never had to wait even five minutes for an approval, although I certainly understand many others have not had such good fortune.

RWK, that may explain it right there. Five bucks to do the check??? I've not been charged anything by any of the dealers I've bought from some the instant check b/s started.

A while back, my purchase of a handgun under a state "instant check" system took 5 WEEKS FROM BEGINNING TO END. I had held a state issued carry permnit for about 11 years, at the time.

Renewal of my permit, last summer, also required the "instant check" routine, which took place in about 5 minutes or less, not counting the time spend filling out a form.

A few months ago, re the purchase of another handgun, the "instant check" took a couple of minutes. GO FIGURE. Perhaps, as with the manufacture of automobiles, where one is advised to avoid "monday cars", insta checks are better done some days, than others. Once again, GO FIGURE.

no eventhogh i have a permit i still have to go through that damn check its stupid i think they put me under the microscope enogh with my permit geez why crucify me more

The following might answer your questions, however it's just my personal take on things. Take it for whatever you think it's worth.

If you saw the film Jurasic Park, you may recall one of the characters asked about the propriety of cloning prehistoric creatures from the remains of DNA. As I recall, the question ran more or less as follows: Is the mere fact that we are able to do something, justification or reason for doing it?

Well, the bureaucrats have obtained the ability to make you, Mr. Law Abiding Citizen, jump through all manner of proverbial hoops, and they seem to feel that the mere fact that they can do something, is justification or reason for doing it.
