Passing a law that removes any Federal Appeals Court and the Supreme Court from the judicial process is about as smart as putting a screen door on a submarine. That leaves the Supreme Court no choice. You can bet that they will probably err on the side that leaves the courts in the loop and the Supreme Court as the final decison maker. Thats one of the reasons they gave in the decision. Anti hit it on the head once again...
 
Hello? It's already included in the Constitutional law allowing congressional authority to create or authorize the creation of tribunals.
 
I was reffering to the DTA.......they left the Supreme Court little choice. The Supreme Court is one of the checks and balances in the Constitution. Its like wacking one of the legs off a tripod so it will work better.

Maybe I misunderstood this.


The DTA doesn't remove the SC. The DTA leaves the SC in the loop. The DTA gives the SC final decision making rights. All this through the implication that the DTA does not violate teh law that would allow the creation of tribunals.
