is it loaded?

got stopped today for an expired tag (my oversight). the Deputy was polite but when i declared i was carrying he tensed up. he asked me "Is the gun loaded?" before i could think it popped put of my mouth. "They are not much good if they are not (loaded)." then he says "Mister that permit gives you the right to carry that gun nothing else!" this time i bit my tounge and i thought well thats all i need. he then proceded to take my gun, unload it and give me the rounds. he put it in his pocket and proceded to take 20 minutes to run my tags, permit, gun serial number ect. when he came back he gave me a ticket and that was that.
what kind of question is "Is the gun loaded?" who carries one unloaded. i thought about asking him was his gun loaded.

Why did you even bother telling him you were carrying? What right did he have to know this information. Sometimes I think some of you are stupid for volunteering this information. It's almost as if you are wanting to brag about carrying your firearms. What he doesn't know, won't hurt him.

was it a revolver or did he thumb rounds out of a mag?

does your state require that you inform cops that you are armed?
 
Anyone that would ask if your carry is loaded has to be an idiot.Write it off to a meeting with a stupid person and forget about it.

The Riddler raises an interesting question. In N.C. if you have a permit you are supposed to place both hands on the steering wheel and inform the officer you are armed. I've often wondered about that because in most cases when they run the tag they know you have a permit and are hesitant to pull you over in the first place. Gotta wonder what might happen if you didn't announce and they decided to search you. Could pull your permit for not announcing, then one wonders about the ammo..... I'm tired of the games and trying to remember all the freakin rules, heck at any given moment I'm liable to forget my own name, let alone if I'm in a safe zone, etc. I am beginning to see the wisdom of my old WWII buddy who carries conceiled without a permit and says the heck with it! I sure hope I never have to deal with such a nitwit who says it doesn't include the ammo! I don't even let my wife touch my carry toy, why should I let Barney!
 
Of course this is minor stuff, but I am continually amazed by the number of reports on this board of concealed carry permit holders who get stopped for small auto related infractions and then have some sort of unpleasant interaction with the police.
Of cousre, its up to you guys and is your right, etc., etc. But if I had a concealed carry permit (we don't have them in Mo. yet) I would make darn sure I didn't carry it and commit misdemeanors at the same time. Its just asking for trouble.
 
look i don't "brag about carrying to anybody. my concealment is a great advantage to me. N.C. law requires me to inform an LEO if i am armed when i am in his/her presence and i know that they are LEO's. also in N.C. our plate numbers are crossed refferenced to our permits, so i am sure by the time he finished running my plate and registration he would have come to the car wanting to know if i was carrying that gun i am permitted to carry. this guy was an A$$HOLE but i could tell he was trying to keep it down to a minimum. first of all he was a deputy sheriff. in our area they don'y usually do traffic stops for routine stuff. this was a Saturday afternoon and i was in the car with the wife and kids. not only did he ask the boner about "Is the gun loaded?" he also wanted to know where it was. when i told him it was in a holster behind my left hip he wanted me to draw it (cross draw style) from the holster while i was in the car (Toyota Tercel) and hand it over barrel first. now i have too much belly to pull that off, so i offered to draw it with two fingers. man i thought he was going to stroke out. this guy was wound too tight i think.
no i did not use a "pissy tone" when i told him that a gun was no good unloaded. it was matter of fact and to the point. like you would say "Your shoe untied." most of these guys are quite nice. i have ended up in half hour discussions with some of them. when i would get stopped or have to approach an officer for some reason i declare my CCW as a curtesy more than to comply to law. and most take it that way. they are either...
1. not interested, inspect permit ect. and move on.
2. are fellow gun guys, inspect permit i.d. ect. and converse with me on hardware ect.
3. are nervous nellys and get REAL anal fast.

Ok, so why are some cops real a$$holes about it? Has any cop ever been shot by a CCW holder during a routine traffic stop?

Why would a coward go into police work? If you're scared of guns, why the heck would you choose a line of work wherein you're constantly exposed to them?

This isn't an anti-LEO comment or a flame, but a serious question: any LEOs on the board want to tackle it?

I'm not sure about that. I know my CCW permit # is the same as my driver's license #. If I'm driving a car registered in my name there may be a link on the computer.

What a maroon. Actually, the state Constitution acknowledges the right to carry, but specifies that the state retains the power to regulate the carrying of concealed weapons. Thus, all the permit does is allow you to carry concealed.

Search on 14-415.10. to find the relevant section... it's at the bottom of a long page.

The statute doesn't address directly whether or not the gun can be loaded. The deputy sounds like a range Nazi, making up rules to suit him as he goes along.

My "Ted kennedys buick has wiped out more families than my gun" bumper sticker just about says it all when I get pulled over. Then again since placing it I haven't been pulled over.
 
Guns are ALWAYS loaded, until they are checked clear.

And your answer that it wouldn't do you much good if it weren't was right on the money. I am quite sure that HIS was loaded, and for just that reason. He has no more right to defend himself by stopping a perp than you do.

And people wonder why there are occasional anti-LEO tirades on this forum!

This reminds me of the story where a police department was rejecting officer candidates if they scored too high on an IQ test...

Heck, in CA the fact that you own any guns is tied to your license plate.
 
Lawdog, I work in NC as an LEO. I have run the operators license # and that has told me if the person has a CCW. Crossed referenced in that fashion, lets us know quickly. Not that that is a problem, most CCWs I run into are quite on top of the game, a lot friendlier than most folks I run into. Down here folks can drive around with it in plain view. The last two times I hold onto it for the duration of the stop, unload it, and hand it back to them unloaded at the end of the stop. The one time I turned it in so she could pick it up the next day, since I arrested her for a warrent. The city I work in has a bad rep, so I cannot blame a citizen for carrying when they are around town.
