Is it legal?

My understanding is that here in my county in Colorado the permit would cover backups and primary weopons.

I just finished a personal protection class and the police officer who taught part of the class said.

If you are involved in a shooting tell the police that you were there and you were involved and thats all you'll say untill you speak to an attorney.

He also said that you will most likely be arrested and held, but I think thats likely no matter what you tell the responding officers.

All depends if there is "a legal controlling authority." Had to get that in for all my Democratic Party friends. ;) Tis the season!

Miranda only applies in instances of "Custodial Interrogation". Custody is defined as the officer not allowing you to leave, for whatever reason. Let's face it, cops don't want anyone to leave the crime scene! It's up to them to try and gain an immediate handle on what did, or may, have happened.

Interrogation is the other part. Those are Q's designed to elicit an "incriminating" response. The cop's Q of "Does anyone know what happened here?", is not interrogatory! If you belt out,"I shot the SOB!", that may be used against you. If he asked you,"Did YOU kill this guy?"; THAT would require Miranda. Now, if you're standing there with the smokin' gun in your hand, it would be rather obvious, and he'll probably commence with your warnings.

This should be on another thread, and I apologize. Any other LEO's care to comment?

Miranda has changed recently. A key factor is if you THINK you are under arrest. Many "in custody" situations find the police contending you were free to leave and they were just having a nice chat with you even with a cop standing in front of the door and you in a corner with two more facing you.
Even if you ask if you are under arrest they won't give you a response. They ask more questions like, " do you think you are under arrest? or why do you ask?" This leaves you with the option of walking away. If you can't you are under arrest. It is legal and lawful for a police officer to lie to you except about your rights.
This is the key area citizens get into trouble with gun issues. They like to talk. they think they can talk or explain thier way out of things. If you think a shooting for example is legal you may think you can end the concerns of the cops by talking.
Go to any prison and ask how many got their from brilliant police work? You can take those two home with you in a car. The rest are their because they talked. If criminals didn't talk you would find the jails empty and lawyers working in gas stations.
Organized crime figures have paid lawyers tens of thousands of dollars to be told, "shut your mouth." You got that here for free.
Each state has its own way of allowing concealed or open carry. Get a COPY OF YOUR state laws. Don't rely on bartenders, gun store clerks or cops for that information. You have to much to lose.
