"Judicial review" isn't in the Constitution, and was deliberately left out by the founding fathers. The Supreme Court gave themselves the right to judicial review in 1803.

The words may not be mentioned but that was the intent of the founders. the courts actually officially adopted judicial review in 1789 I believe, but they were routinely already serving the purpose of making sure laws adhered to the constitution before this date. The doctrine was confirmed in 1803.

As for the intent of the founders, the Federalist papers by Hamilton and Madison, which most gun owners are so fond of, clearly address the topic. Hamilton clearly states "through the practice of judicial review the Court ensured that the will of the whole people, as expressed in their Constitution, would be supreme over the will of a legislature, whose statutes might express only the temporary will of part of the people."

Sounds pretty clear as to why the third branch of govt was deemed so important.
 
Except now they routinely set aside the will of the people and instead impose their own on us. The Supreme Court of today does not just interpret the Constitution. They look to other nations, and even to their own agendas when setting policy for the whole nation.

I don't see things through only the eyes of a gun owner. That is not the only issue I care about. And the Supreme Court in the past 50 years has grown more and more liberal, to the extent that some justices admit openly to using their own political views when imposing their will. They have even gone as far as to make up their own laws. I do not believe the Supreme Court of the 20th and 21st centuries does anything to further the democratic process, or preserve our rights. Quite the contrary, the Supreme Court of the 20th and 21st centuries is highly corrosive to the democratic process.

Perhaps they should not be abolished entirely. But I think a better solution would be to have their decisions sent to Congress to be ratified. The thought of 9 unelected individuals being the end-all to national policy is downright terrifying to me as an America
 
We will just have to disagree on the merits of the supreme court.

I will always feel the need for judicial review. Lawmakers tend to be too easily swayed by big checks and big mouths.

Yeah, but thats an argument for a change of people not process. With a group of right minded judges, judicial review works just fine.

I would start with the following;

Outlaw the lobby industry.

Limit campaign finance.

Change the legal system from the "jury selection for a predetermined trial out come" currently in place to a truely random system of selection.

Create term limits for the Supreme Court.

Restore the Bill of Rights.

Enforce the "Oath of Office" that our leaders, politicians, etc take.

Abolish gerrymandering.

Outlaw "dual citzenship" voting rights and return to the "one man, one vote" system that our founders envisioned.
 
Sombody mentioned a test for citizenship. On that teast have a section which tsts whether you support the country or would rather have Nazis or communists or others from a different nation annex the US and take control. (basically a patriotism section. Most liberals and hillary C would fail miserably. If they didn't lie)

less powerfull federal government more power for states.

blend between articles of confederation and constitution.
eliminate the absolutism thats going on.
fix the banks,corporations,intellectual property,copryright and patent system. credit will be due but you wont be able to sit on an invention for the 20-50+ years and profit from it keep working or let someone else advance it. if we cant no reason the chinese should be able when US idiots go overseas for business then just have the ip stolen from the business.

less greed and money more to community. no monopolies in media,internet,tv,newspaper.

no more constitutional rights for corporations that supercede persons rights. no more federal gun registration. ditch certain government agencies that are out of control.

make sure corporations and businesses dont forget the constitution or BOR. no rediculas rules repugnant to the constitution or BOR. business will be warned after 1 warning and no change business will be shut down.

Open Source Government and Agencies no more secrets or repression or oppression. way it should be.

mandatory service either in social services,LE,Mil. Less Globalism and foreign dependence. cut UN funding to about nothing and suggest they leave and make sure all US land and territory is held to US Constitution/BOR with exception to Native American Indians in territory.
no gray area's like school's and businesses.

see no class enjoys privileges or immunities others dont due to profession.
less divided citizenry.

reduce privileges and absolutism extend rights and freedom

better W2 system. better immigration system.

no more socialist or communist central style of government like the US is developing with strong controll. put a end to the socialism going on with strong campaign of what liberty,freedom,greed,tyranny and despotism is.

of coarse never happen short of nuke in D.C. or a very blood Civil War or a Revolution to get back to a more perfect union. need a revolution to get back to constitution but constitution needs changes towards articles of confederation. articles where dumped because they were found to not be strong enough federalist government due to shays rebellion. today we have ruby ridge,waco and other disasters total opposite situation and abuse of power. D.C. today is Britain of yesterday.

less laws and more enforcement. fix court system.
stop subsidizing everything and encourage businesses develope better planning and execution. make money worth something and make sure people know the damage of greed.

make sure history is taught in schools so its not repeated.
 
Sometimes I think we could tie up a loose end if we made the federal judicial branch subordinate to the State Legislatures ... for instance, maybe at the end of every year the State Legislatures could rate the SCOTUS rulings of that year, and then rate the Justices according to how they voted on these rulings, with the objective of finding out what justices consistently rule against the will of the States, and replacing them.
 
There is a reason the supreme court gets life appointments.

If they were trying to get re-elected they would be subject to the same evils as politicians. They would start basing decisions based on pleasing the people in power instead of adhering to the constitution.
 
The US Constitution is a compact between the States. If part of the compact is unclear, I think it should ultimately be up to the States to clarify what they intend their compact to mean. I do not see what is so great about having nine judges tell the States that their compact means things which they never intended it to mean. That is what the SCOTUS does. It is not as if they are upholding the Constitution ... in my view, since the "Civil War", the SCOTUS has stopped judging by the Constitution and has started judging the Constitution. And when the US wants legislation they cannot get they just legislate from the bench. It is corrupt. It needs to be checked. I do not believe that the US can check itself, I believe it is the role of the States to keep the US in check.

Appointments would still be for life, as long as the justices refrained from trying to subvert the Constitution, as judged by the States.

How about this, make lawmakers personally liable if the law causes harm to innocent citizens. This will pretty much make sure nothing ever gets done.

Pass a waiting period? Someone gets hurt/killed while waiting? Lawmaker held personally liable.

Or, use the Vulcan model for legislating. 2/3 majority to pass a law, simple majority to repeal. If it actually is a good thing, everyone would be in favor of it, and if it turns out not to be a good thing, easier to repeal.

Or, how about this, making it a crime for govt officials to accept anything from anyone during their service. Make govt wages the average US income. Provide govt housing (dorms/barracks) that they must live in. and so forth.

And above all, do not let them control their wages or benefits. Make recall a simple easy expidited process.

AND, make every ballot with a space marked "NONE OF THE ABOVE" at the bottom. If that one wins, hold another election in 30 days, with none of the previous candidates being allowed to run.

Abolish all laws against property and only have laws against acts. revamp the legal system to put victim's rights ahead of criminal's rights. Hold administrations personally responsible for the acts of their subordinates.

Reinstate and uphold the concept of personal responsible for actions.

and anything else you can think of. It wouldn't work, but one can dream.
And, and, and, take us back to the days of our childhood, where the world was a better place for all. Ah, dreams.....

the booze, meals, trips and bribery for special interest votes is disgusting.
The squeaking wheel gets the grease especially if its free meals, liquor, parties, and in Texas, trips to the beaches in Mexico, everything prepaid including the prostitutes.

America has the best politicians that money can buy, and it often does........
 
#1 - I'd establish a rule that would disallow family members from running for office. Say something like 3rd cousin as a limit. No more father/son brother/brother grand father/grandson - something like that.

Something so there wouldn't be Al Gore, Bush II, Jeb Bush, the Kennedy clan, FDR,, etc.

Way too many of these people..

Should have been done way back with Adams. I'm kind fo surprised the FF'ers didn't think to include something like that.:confused:
 
Ladies and Gentlemen, for your well being, we propose a progressive policy , procuring power by placing politicians in the proper place and rendering a preferred perspective of the people through...politician control. Power to the people.

When they just won't listen. Politician control. For the children , for the future. Turn in your evil politicians at our buy back stations. Clean efficient disposal is the only option. Make the world a safer place, get rid of yours today. :rolleyes:
 
A short version to the right start.....

My proposal is fairly simple.

Propose and pass a law that requires all politcal campaigners to debate for all elected seats state and federal, and require the debates to be between all canidates who meet the requirements to get on the ballot for their state or federal requirements, and that if canidates "refused" to debate their opponents, they would not be eligible for office, and removed from the ballot. Also, require the FCC to enforce the law requiring all stations who air the debates (all media covered by the FCC), to show all of the debates from beginning to end with equal time given to each canidate.

Propose and pass a law that allows only individual persons(and dependents), to donate to political campaigns, and simultaneously outlaws any corporate, special intrests, lobbyists or private groups, or any other entity besides a single individual(and dependents) from donating.

Propose and pass a law to OUTLAW lobbying elected officials with anything other than information, expressly forbidding gifts of any kind, or exchanges of goods or services for special political treatment. ( our officials are to be lobbied by the public, when the public feels a new law is needed, or a bad law needs addressed. )

Then, I would address the voting problems with requiring all states (by some date) to initiate an Instant Runoff Voting system, that has verifiable paper ballots that allow you to check your own ballot receipt, with the "countable" ballot as it scrolls through a visible plastic window the voter can see.


That is what I would do, first. Once the election process is equally accessible, realisiticly checked and balanced, and coverage is equal, there is no more "lesser of two evils" theory to rely on, and we can end the 157 year monopoly on politics by the two corrupt parties who hold all elected and appointed seats.

Maybe then we could see the re-emergence of Tom's "Common Sense".
 
Lawyers should not be allowed to serve in the legislature. They are officers of the court, and allowing them to be legislators is a violation of the separation of powers. Allowing shysters to write the law gives them the right to create their own gravy train. All lawyers should be banned from the legislature while they are officers of the court, and forbidden to be officers of the court for the length of time they were in the legislature after they leave it. Lawyers make work for each other and the legal industry produces nothing of value. The job of the legislature is to serve the People, not to create busy work for ambulance chasers.
 
In no particular order:

FairTax.

Range voting.

Very strict separation of church and state. Either appeal to every religion on the market or none at all (since the former is impossible, the latter wins by default).

Abolish the Department of Education and let the states handle it. If it must remain it would remain limited to ensuring proper nutritional guidelines and making sure the only thing that belongs in science class is science.

The right to bear arms shall not be infringed. (hey that's a good idea, maybe someone should have put that in the bill of rights a long time ago....oh wait).

End the war on Americans who use drugs.

No more corporate welfare.

Start dismanteling private welfare. If you want a check from Uncle Sam you need to do more than fill out a couple applications a week. Work for it. No more multi-generational welfare families.

Enforce international trade regulations. Stop coddling businesses that take jobs overseas.

In whatever state I'm in Uncle Sam stays the hell out of my bedroom.

Uncle Sam also has no business interfering between a pregnant woman and her physician.

The military exists to defend our country, not liberate others or nation-build or secure our financial interests.

Stop the ethanol crap that only farmers will profit from and start focusing money on real energy solutions.

If I buy land I own it from the surface to the core of the Earth - adjusting for geometry, of course.

Government should never be allowed to discriminate but private entities should have no such restriction. But they should also have zero privacy and must publish employee records as well as policies of discrimination to allow the people to decide whether or not they want to shop at Jimbo's Racist Appliance Emporium.

I'm sure there's more I'd do but that's off the top of my head. If I think of more I'll add to the list. :p
 
I'd outlaw withholding of taxes from paychecks for both the state and federales. I'd require each and every taxpayer to write a check or hand over cash to the goverment each and every paycheck.

60 days max before open rebellion spills into the streets.:D
