I don't BELIEVE this @#$% judge!!!

the judge followed the recommendation of the corrections dept.
The Judge is not REQUIRED to follow said recommendations...
He could still have made the sentence more realistic.


This rapist needs to be re-sentenced by another judge.
My understanding is that the Prosecutors can "appeal" to a higher court for more realistic sentencing.


He is considered to be low-risk and treatment starts only after he gets out of prison.
I have worked with sex offenders in the State Prison system...
The rate of recitivism is 97%. :mad:

Sex-offenders are carefully segregated and protected, from the general population of convicts, while in prison...

The Judges point of view is expected to comply with the law...
This one is creating law and legislating from the bench.

AND... harsher sentencing, prevents borderline pedophiles from becoming full-on offenders AND it most certainly prevents this pedophile from "offending" during the time he is incarcerated! :mad: :mad:

IMO All first-offenders should recieve a minimum of 5 years.
ALL second-offenders should recieve the death penalty.
 
i'm with you pointer on the last of statements!!! but if was up to me i'd be sure those child rapists were put into the general prison population!! WHERE IS THE JUSTICE????? for this poor little girl??????
 
I've seen some of the effects of this kind of thing on children first hand, and I'm talking 30 YEARS after the fact. It doesn't go away.

His prison sentance should be 19 milli-meters long and 9 milli-meters wide, and end up somewhere in the base of his skull.:mad:
 
i'm sorry in my previous posts i said the pinheads were MASS. pinheads but i meant vermont.... my mistake..... there were more idiots on o'reilly tonite tring to stick up for this travesty of justice...... i agree with putting a slug into the rapists scull but that judge should really lose his job and the parents of the child be allowed to sue the state of vermont..............

All he'd do is use substitute equipment,,broom handle or such.
The "problem area" lies between his ears, not his legs.
 
I do hate to point this out - since I disagree with the harsh-punishment folks - but hormone production affects these kind of urges. Specifically, testosterone.

Which is, according to Wikipedia, mostly produced in...

...the testicles.

Again, I DISAGREE with this kind of punishment.
 
I call bs on chemical castration. Just castrate them. Segregate nope, put them in general population and let the rest of the prisoners rehabilitate them.

If that was my daughter that was raped then thats about how long i would want the rapist in jail. That would give me enough time to sound proof my barn. To sharpen some knives or maybe dull a few. To dig the various holes in the woods i would need for desposal of rapist. To get the appropriate torture instruments and to brush up on various torture techniques. wouldn't want him to expire to soon now would we. Then once he was out it would be KATIE BAR THE DOOR!

This would be my first response as a father. This could/probably would leave the child without a father for 20 years. This is where vigilante justice by concerned citizens may be helpful.

PLEASE, Sir. I was going sort of in the direction of 'locked-up-in-the-loonie-bin' kind of treatment. The kind where they don't get to actually interact or threaten the public in any way, but yet can get treated for their sickness.

I believe it is as simple as follows:

If it is a given person is personally responsible for his own acts (and in any reasonable legal system, we operate from a presumption of sanity), the person should go to prison for them, in the case of child molesters, fora few nice decades. During this time the person would be entitled for medical care as all prisoners are.

If it is proven that the person in question is not responsible for his own acts (I.E., insane), the person should be locked up in a mental hospital for as long as it takes to get their head screwed on straight. All their lives if that's what it takes.

None of this is about PUNISHMENT. Punishment, and revenge - as opposed to self-defense and deterrence - is not a good concept to base a government on. Simply because the really harsh crimes can never be adequately punished, and the small ones are really easy to punish TOO hard.

This is all about PROTECTING the public from the sicko in question. If the sicko is in a high-security hospital for the truly screwed-up, it's as good as a prison.
 
A solution we can all live with

I think this perv and the "judge" that let him off should be castrated.:eek: The girl should be allowed to do it:D , and it would be a message to all sex offenders out there that their lifestyle is unacceptable and will not be tolerated. Further, the "judge" should be disbarred and ordered to spend time volunteering at a battered women's shelter. Lastly, the judge should seriously consider if that was his own daughter and if he would give the same sentence. Who knows, maybe a demonstration is needed?
 
What an interesting sentencing opinion.

There are several things in the opinion which (I wonder why) failed to make the news.

Things like:

The BG is a mentally deficient person with an IQ of 75-85;
The BG has an emotional maturity level of a child;
The BG will be this way the rest of his life.

Because of those factors, it's pretty likely that the BG will never truly understand the world as an adult. He certainly won't ever understand that he is an adult while those whom he most empathizes with and relates to are children. Thus, he needs guidance and counseling for the rest of his life so that someone can show him proper behavior as well as watch for improper behaviorial characteristics.

He will not get that in prison.

The sentence is lifetime probation with counseling. Pretty fair considering all of the factors and needs of everyone (including the victim). It's also apparent that prison would only victimize and torture the defendant who probably wouldn't understand why. A mental facility might be one answer but the court probably has no ability to sentence a criminal defendant who is not insane into that type of facility.

The judge may not be the most articulate person I've ever read an opinon from. But I think he was correct in his decision given all of the factors he had to work with.
 
Rob, that was why I posted that last posting here. I had read much of this in other news posts, but the links died within hours. So I didn't want to post this stuff without some form of reference.

We now have that, via the Judges own pen, enough relevant information by which to form our own opinions. I know that my own has changed from what it was when first reported.

Meaning, the situation is sad, all the way around. The Judge went out on a political limb (and it will cost him) to do as much Justice as the Law allowed.

Actually, I believe that Cashman dispensed as much justice as the law required and no more. Certainly the law allowed a much harsher sentence than what was given. However, that would no longer have been justice but would have been retribution instead.

What's ironic is that no one "likes" the outcome. Which is a pretty good indicator that the result is right smack dab in the middle of all the competing forces. Which is where it should be because that's where balanced justice is found.
