Has anyone seen this about Reds ?

I hate to have to say it, but this is typical behavior for the minions of the State.
Dare to stand up for yourself and we will find violations even if we have to invent them.
The regulation are so byzantine and complex that it is almost impossible to reasonably conduct business without some sort of petty violation and this is what they count on.

On Wednesday June 6, 2007; the BATFE has submitted a letter to Judge Edward Lodge requesting the termination of the preliminary injunction that was granted to Red’s Trading Post on April 30th by Judge Lodge. The ATF is alleging that Red’s Trading Post “willfully” committed three violations. The ATF conducted an audit on 5/23/2007 in which 2 Agents John Hansen and Kylie Williamson and Area Supervisor Linda Young, who specifically came down from Spokane, WA. One of the employees documented Young stating to the other Agents during the audit, "We'll do this again and again and again until this is done. I mean done. Sooner or Later it will be done, something will be found." The Violations are listed below:

· Violation 1: Was a sale to a resident alien who has lived here for 11 years. The customer received a proceed from the NICS (National Instant Crimnal Background Check System), provided a valid Drivers License and proof of residency going back 6 months prior showing the customers last name and social security number (this number matched the social security number on the 4473 form). One of the Agents stated that because it did not have his first name, it could have been a brother or a cousin. The ATF stated that we did not show 90 days CONTINUOUS residency and stated that he could have moved outside of the state, despite the fact that he had a Valid Idaho Drivers License. A call to his employer revealed that he had worked there up until just recently

· Violation 2: It states name and address in the book. So we have ALWAYS written it up as:

They are saying that we have not been writing up the street address in the Acquisition area. We also keep record of this in our paperwork and pawn records on all acquisitions. I pointed out that this was not mentioned in any of the previous 4 audits (3 of which were performed under by Agent John Hansen) and Agent Caleb Rushing specifically told us that it was how it was supposed to be written, especially due to limited room in the A&D book. I informed Linda Young that all firearms that come in we keep the full address, scanned copy of the individuals Drivers License, Fingerprint and various other information that is also sent to the Twin Falls Police Department which is ran through NCIC (National Crime Information Center). I offered to show Linda Young this information which is backed up each night, but she refused stating that she could not consider it.

· Violation 3: Our 4473 forms have always been placed into folders that are designated alphabetically. In our 2005 Audit, Agent Caleb Rushing suggested that in each of the folders that we continue to keep them listed alphabetically but in each folder we list them chronologically with the last transaction toward the front for quick easy access. He informed us that another Dealer used this method and it was very efficient. Linda Young informed me that Agent Rushing was incorrect and that she would let him know. I pointed out that in during the last 4 audits the agents were completely aware of our system but none failed to cite or even warn us on this.
I will say that the three FFL's in the Mini-Cassia are, where I live, are scared that this will spill over to them. One dealer in particular is going over his 4473's and filing system with the proverbial "fine toothed comb," in an effort to comply with what seems to be the current modus operandi of teh BATF&E.

The more Red's fights back, the harder the BATFE is coming
down. They are desperate to shut this business down, because
every day that it remains open is a threat to their authority.
Worse, other firearms dealers might begin to believe that THEY
can fight back, and where would that leave the BATFE?
Remember, there's 2300 agents and 100 million gun owners.
The BATFE rightfully fears those numbers.

I could be entirely wrong here, especially since I have not read extensively about this particular case. Also, I'm located a significant distance from the "scene of the crime", whosever crime one might reference. Finally, I do not hold BATFE in especially high regard, and never did.

Having stated the above, and mentioning that I have read of other instances of BATFE operations and methods, it strikes me that there is one ongoing problem, a problem that seems quite serious. BATFE appears to "make it up as they go along".

Anyone feel free to correct me should they see where Iam or might be off base.
 
I've known a couple of local FFL's who tell me that anytime a BATFE agent suggests a procedure (such as filing alphabetically but then chronological within each letter) they ask if the agent will "sign off" on the suggestion. Very few will do so.

Strangely, an FFL I know in Nevada says his "ATF lady" is quite nice, knows her stuff, gives him tips about what could trip him up. She's complimented him on his records, in writing, saying that the only errors have been due to legibility of customer's handwriting.

It's interesting that one local gun shop was told by the government that he HAD to hire a really nice older man with 70% hearing loss (service-connected disability) to work in the shop as they could not discriminate against his age or his disability as long as he could otherwise do the job. Yet BATF presumes that clerks can hear their conversation in a noisy shop or with their backs turned. Go figure.

It's also my understanding that BATF needs to complete the sale of the gun to make a case. If this is true, then why shouldn't the agent be charged with perjury for indicating he's the end user of the gun on question 1 of Form 4473?

I don't know about the ATF (the government) telling a dealer he had to hire a hard of hearing elderly gent with a service connected disability, (hearing loss)but as to Bill's last, regarding charging or prosecuting the "agent" (BATFE'r) with making a false statement on a federal form, the 4473, who might it be that would bring charges, possibly the BATFE, against one of it's own, or perhaps the DOJ, pardon me while I become hysterical with laughter, as in Rolling on the floor, laughing my ass off.
 
Red's not alone

I understand that a Major gun manufacturer has also been the target of these Jack boots. The radio announcer would not divulge the name but if they went after gangs like MS 13 and others with the fervor they have shown to decent legitimate dealers and makers we wouldn't have many gun related deaths. But the high number of gun deaths keep them in business. These people should sue these individuals who are spearheading this harassment. ? How many gun crimes were committed by people who bought guns from RED's or the manufacturer? If they can't get them one way, they'll just bankrupt them with audits.
