Besides, what jurisdiction does a court in California have over another nation. That court doesn't have any.

I absolutely agree. However this was not a judgment against the Iraq Government. It was a judgment against 1 Billion in Iraqi funds held in US Banks. Our own government prosecutes such cases against US Citizens daily. They're styled as US Government vs $XXX US Government funds. As the owner of the funds, you're not even a "party at interest".

So this is simply a judgment in favor of "US Citizens vs $1 Bill US Government Funds". They won it; they should collect it. And the Patriot Act should not stand in the way. The Bush administration either believes in the Courts rights to bank account assets or they don't. But they can't "take" on the one hand while refusing the ultimate authority (citizens) the same rights.

I still don't get it, but I understand what you are saying. My question would then be in regard to who actually owns the Iraqi funds here in the US. Is that Iraqi government funds or funds belonging to Iraqi citizens (individuals) or businesses own by Iraqi citizens? If the funds are of the Iraqi government, then the notion makes sense. If the funds belong to individual Iraqi citizens or businesses, then the concept falls apart.
 
They are (were) Iraqi Govt funds.
I don't like the concept of civil forfeiture....it started in the famous "War on Drugs", but has now grown enormously in all LE sectors. However, since the laws are on the books, American citizens should have every right to avail themselves just as does the Government.

If Bush wanted to do this right he could have easily settled with the families for just the damage figure ($600+ Mil....or less) and drawn it out of any budget he chose. But to place these funds beyond reach, in defiance of a Court Order, is simply indefensible. If he wanted to fight it, he could have entered on appeal. It's a Court issue and neither Homeland Security nor the Patriot Act should trump that.

Plain and simple.
