Glove Compartment Carry?

This is probably an obvious question that has been answered before but I dont like how this site complicates the use of a search function.

Here is the question: What is the legality of of carrying a handgun in the glove box of a car? Do you need a CCW Permit? Does it have to be cased? It is a good idea?
 
Depends on your state. In Texas, no CHL is needed, it doesn't need to be cased and it can be loaded. As for the good idea, I think it depends on where you live....I keep one in my truck 24/7.
 
Here in Missouri I believe it is legal to have a gun in the console or glove compartment WITHOUT any type of permit. I also believe that it may NOT be legal in other states.

Disclaimer - I've been wrong quite a bit lately so take my input as a guess until further info is posted :)
 
If you do it, keep all your info OUT of the glove box. The last thing you want is to open the glove box to get your registaration and have a gun fall out.
 
It is illegal in Ohio,without a permit anyhow.With a permit it much be locked in the glove box,on you or in a closed bag/box with a closing lid.

Im sure my info is 100% accurate on what type of box it is,but its close.
 
Keep in mind that if you are stopped for a traffic violation it's probably not a great idea to have a gun anywhere that you also keep items that you will need to retrieve to show/give to the officer.

I'm not talking about hiding things from the officer but rather saying that things will probably go smoother if you can get through the traffic stop without having to handle the gun or reach towards it while the officer is watching.
 
In Utah, with no CCW, you can keep it in the glove box provided it is unloaded. With my Utah CCW permit, I can keep a loaded firearm in my vehicle, and not on my body, as long as I am in it. Utah considers my vehicle an extension of my self while I am in it, and it is not required that you keep your concealed weapon on you, but you do need to retain control of it, so somewhere in the passenger compartment would be ok, but a loaded and concealed firearm in my truck bedbox.....not so good.
 
Here in Oregon, my understanding is, from what I've read, and from what I've heard from a couple of instructors is, that if you want to keep a gun loaded in the glove compartment, you do need a CHL. Here's the other part. If you have a passenger in the vehicle in front seat, they actually have easier access to the gun than you do as the driver, so even if you have a CHL, if your passenger doesn't, then they're concealed-carrying without a license and could face consequences.

In Washington a CPL holder must be present in the vehicle to have it loaded and kept anywhere in the vehicle. Without a CPL it can be kept anywhere in the vehicle unloaded, so long as it is not concealed on the person.

In UTAH in 1985 I was pulled over in my 74 chevy luv pickup... 18 years old... 24 pack of budweiser behind the seat....

Reached over in front of my buddy and opened glove box, and out next to my fingers falls a SUPER gorgeous stainless steel Ruger .22....

One millionth of a second later the officers sidearm (both officers) were pointed at the only part of me they could see (my friggin eyeball...), and I think I pooped just a little bit... :)

Suffice it to say that I got a ticket for having a CONCEALED WEAPON while not licensed to carry a concealed weapon, and the ruger was confiscated until my court date. I paid a $75 dollar fine, because I did not place the gun there and the law did not require me to check my glove box for weapons prior to driving the car, thus I only paid the $75 bucks because my father told the judge that he'd put the gun there while out shooting and on his way back he went in to a store for a coke he popped it into the glove box and forgot about it. The judge fined him $75 bucks for contempt for speaking out when the judge was speaking to me asking why I had the gun in the glove box....


So when in Utah if you are NOT a CCW or LCC holder, please keep weapons visible to anyone casually walking past or it is a conceal weapon violation that they can get you for.

My dad was so ****** at the judge that he paid the fine and gave me the .22 :) :)

P.S. The beer was never discovered because my Mexican blanket seat cover hid the seat release lever and they never got it to fold forward... Thank God :)
 
Like others have stated, it depends on your state's laws.

It's legal in Arizona without any permit as long as it's in a holster or pistol rug.

Not in a holster or rug, and no CCW permit would be illegal here.

In Il, the Il Supreme Court, it seems, is in the process of allowing us to carry an unloaded weapon in the center console. According to our laws, the center console fits the description of a case and we can keep the gun and ammo in the center console. Just waiting for the case to finish up to hear the actual verdict.

I would point out that the ILSC case hinged on the definition of "case", and they decided that the it was fairly obvious that a center console was indeed a "case" for the purposes of the UUW act.

However, the center console does not meet the additional requirements of a gun case found in the wildlife code so you could still get popped for that.
 
In Colorado you can carry a pistol loaded and chambered in your vehicle or on your person without a permit. A long gun can not be chambered.

I think there are better places than the glove box, personally.

Even in Utah, it is no longer 1985. Laws change. Your advice is not valid.

76-10-504. Carrying concealed dangerous weapon -- Penalties.
(1) Except as provided in Section 76-10-503 and in Subsections (2), (3), and (4), a person who carries a concealed dangerous weapon, as defined in Section 76-10-501, including an unloaded firearm on his or her person or one that is readily accessible for immediate use which is not securely encased, as defined in this part, in or on a place other than the person's residence, property, a vehicle in the person's lawful possession, or a vehicle, with the consent of the individual who is lawfully in possession of the vehicle, or business under the person's control is guilty of a class B misdemeanor.
(2) A person who carries a concealed dangerous weapon which is a loaded firearm in violation of Subsection (1) is guilty of a class A misdemeanor.
(3) A person who carries concealed a sawed-off shotgun or a sawed-off rifle is guilty of a second degree felony.
(4) If the concealed firearm is used in the commission of a violent felony as defined in Section 76-3-203.5, and the person is a party to the offense, the person is guilty of a second degree felony.
(5) Nothing in Subsection (1) or (2) shall prohibit a person engaged in the lawful taking of protected or unprotected wildlife as defined in Title 23, Wildlife Resources Code of Utah, from carrying a concealed weapon or a concealed firearm with a barrel length of four inches or greater as long as the taking of wildlife does not occur:
(a) within the limits of a municipality in violation of that municipality's ordinances; or
(b) upon the highways of the state as defined in Section 41-6a-102.
 
Don, did I not just read that it's against the law to keep a concealed gun in the glove box?

Is that not more or less consistent with what I wrote?

I did say that if you have a firearm in your vehicle that you should have it in view and not concealed or you must have a CCW or License or Cary Concealed whatever your state calls it...

Read the RED, then tell me where it says that you may not conceal carry a firearm if you are a CCW holder?
 
I'm just not seeing where it's illegal to have a gun in your glove box if you are a CCW holder. I see TONS of "you can't have" if the holder is NOT a CCW holder or if the holder is a felon etc...

I support that you can have a gun in your car or truck in plain view, as much as it's an open carry situation for the most part, but that it be unloaded (no brainer) unless you are a CCW holder is logical. How else would you get your gun to the firing range or to the hunting grounds?
