Firearms confiscation is the goal of the anti-gun lobby. It has happened in New Orleans and it will occur next in New York unless all the new anti-Second Amendment laws are revoked. These new laws are only the first wave designed to punish all law abiding citizens by slowly taking away more and more gun rights every time some criminal or crazy nut commits a crime or murder with a gun. What happens next time when someone kills 20 people with 2 -10 round magazines? What happens after that when 20 people are killed by someone with 4 - 5 round magazines? I can hear it now "We should pass these new laws even if only saves one life" "Don't the families of these people deserve a vote"! One of my relatives kids was killed by a drunk driver. My vote is to ban all cars. Don't I deserve a vote? Cars kill many more people every year than guns!
 
What I find most repellent is the idea that this whole situation will dissuade people from seeking help when they need it.

I equate mental health with physical health. The two go hand-in-hand. If you've got the flu, I want you to go to the doctor and get treated. If you're having real doubts about your worth as a human being, I want you to go to the doctor and get treated.

Why is the treatment for one ailment considered routine, while the other is something to be stigmatized and punished? That's our problem as a society, and it dovetails into the occasional violent outbursts we see.

I somewhat disagree with your conclusion,KPB. This is not society taking "the easy way out", this is someone pushing an agenda.

If you are diagnosed with a mental illness, its a whole different ballgame. With whats going on in New York, and all around the country, even a history of taking anti depressants will now be branded to your name and your Second Amendment rights may be gone! This is the easy way out. Every person is different, every case is different. Not everyone thats had a mental issue is a mass murderer! Today, in the climate of anti-gun radicalism, I feel its BOTH a political addenda and a problem with the way society views mental health issues. Its just easier to brand everyone with mental health problems as dangerous or unstable. This is not right.

Very much like the history of a great many illnesses. Cancer and HIV spring to mind, in particular. I'm not quite sure what your illness might "do" to me, so I avoid and stigmatize you to make myself feel safer. Mental illnesses might be "worse" than a good many feared diseases in the respect that we are never quite sure if it's "gone" or if it might "come back", we very often have no idea how to treat it and, especially, it's the only disease that might make you hurt me on purpose, which is extra scary.
 
A Disservice to the general public

I was fully expecting something like this to happen at some point. I just didn't expect it to happen so soon.

This incident clearly violates the rights of many as it creates the stigma that anybody on mental health medication owning guns is a potential threat to anybody. Regardless if it was said to be a "mistake", this sends that message clearly. The next time some wacko goes on a shooting spree, they'll point out that he was mentally unstable, taking meds and that the shooting could have been stopped by banning all people taking meds from legally owning guns. Now all veterans with PTSD get stripped of their 2A rights.

Seeing how supposedly private mental health records can now be "leaked" to the media and authorities, the only thing this does is discourage people from seeking proper mental health care. Because mental health issues no matter how small = loss of rights.
 
Part of the SAFE Act here in NY is that medical care providers are now expected to disclose the information of anyone they deem is a threat to themselves or others. The government need not even see your papers or history or scripts, all it takes is the doctor or secretary to pick up the phone and make the call; and they are now expected, and encouraged to do so.

The VA has already made the statement it will not be turning in veterans who come in for aid that own firearms. Whether this will apply universally, who's to say; technically, the VA can say they're not, but if the doctor still chooses to do so, they are following the law.

The Act also extends to members of the household; so if your spouse or child is suddenly on anti-psyschotics or deemed a threat to themselves, the state police will probably be stopping by for your firearms. This isn't really a 'new' thing here in NY, as interviewing members of the household is already standard for a pistol permit, and there's been a history of weapon confiscation before if a spouse or child is deemed a 'threat.'

Pile on top of that a state tip line that promises rewards for tips leading to firearms-based arrests. So, **** of your neighbor/ex who knows you have a shotgun for hunting, suddenly the police may come to your door because he said you've got an an AK47 in there.

It is getting bad here. There was a case here this week with the police coming to a house because the school listed his kid as having 'aggressive behavior' at school, and a 'history of mental problems'; exactly what the school felt constituted these issues was, of course, not listed. These days, it could be anything from death threats to shooting an imaginary gun. He did have unregistered pistols on the premises, but the point is what brought the police to his door in the first place.

From an email letter from Sen. Jim Seward;

In the Long Island case, we have information not included in news reports.
Apparently, a ten year old had a history of aggressive behavior as well as
documented mental health issues. The father was asked about the safe
storage of his pistols due to the report on his son. Officials discovered
several pistols that weren't registered. His license has been suspended
while they investigate whether the son could have access to weapons in the
house - thus posing a risk - as a basis to continue to suspend or revoke
the pistol permit. No weapons have been confiscated. According to our
legal staff, at least in this case it seems that law enforcement acted
reasonably. With the report of threatening behavior from the school, if
they didn't make sure the weapons were secured, and somehow the child
gained access and hurt himself or others, they would certainly be blamed.
 
Seward is incorrect. This is a misinformation campaign being coordinated by Cuomo's office. There were no unregistered handguns in the house. you know from living in this state that if there were unregistered handguns in the house, the father would have been arrested and not just had his license suspended. also the child did not have a history of mental problems. This case is in the next town over from me. Seward got his information from the Senate legal staff who got it from the governors office if that tells you anything. can you say cover up?

I assure you, the whole thing smacks of BS to me, and it's not as though NY is being known for keeping its facts straight these days. But the point I was driving at is that they're going to use this 'mental illness' angle to invade homes and harass gun owners, whether they are personally the ones with the problem or not. I don't care if they showed up to the house and found a Howitzer out back, the reason they came, whether it's a smoke-screen or not, is ridiculous. In a time in our country when children are being suspended for pretend-shooting a pretend-gun, or throwing a pretend-grenade, the school can mean anything by 'aggressive behavior,' and it wouldn't surprise me at all that the kid has no medically-founded issues. They're going to start using this mental illness thing for all it's worth though.
