FBI Agent Ruled Immune in Idaho


SAN FRANCISCO (AP) -- The FBI agent who killed the wife of white separatist Randy Weaver during the Ruby Ridge standoff is immune from state prosecution in Idaho, a federal appeals court ruled Wednesday.

Sharpshooter Lon Horiuchi shot Vicki Weaver in 1992 while she held her baby. At the time, federal agents had converged on the family's cabin to arrest Randy Weaver on a weapons trafficking charge. Horiuchi said he did not see Vicki Weaver when he fired at an armed associate of Randy Weaver.

Idaho prosecutors pursued a manslaughter charge against Horiuchi, but the charge was dismissed by a federal judge.

A three-member panel of the 9th U.S. Circuit Court of Appeals upheld the dismissal, ruling that Horiuchi was acting in his official duty as a federal law enforcement officer.

The Weavers' 14-year-old son and a U.S. marshal were also killed during the standoff.

So let me get this straight.... if a fed is doing as ordered... even if it entails murder... they are immune to prosocution? Whoaaaaaa Nellie.... there is something wrong here. I'll give you ten to one odds that Judge Cynthia Holcomb Hall was on the three Judge pannel.... I thin maybe our reps, after the next election, ought to look into impeachment proceedings for a few judges in the 9th circuit. Between this and Hickman vs. Block...

No big surprise. The real question is who gave the "shoot to kill any armed male outside the cabin" order. THAT was the real crime, not that Horiuchi isn't guilty as well.

Nobody's 'fessin up to that one, though.

I'm honestly interested in the opinion of some of our resident, LEO friends on TFL. I too am troubled by this ruling.

Between this kind of thing, the so-called 'War on Drugs' (i.e. the war on the Bill of Rights), and asset forfeitures / seizures, I really wonder where to find America these days.

Yes, fascism can indeed happen here. Matter of fact, I think we're watching it, day by day.

Amazing. Not surprising, but totally amazing. It is now established as a matter of law that the agents of the government can murder innocent civilians provided that they are "just following orders".

As to the question at hand, I do not believe the agent should have immunity from prosecution by the State. The crime was committed within the jurisdiction of the state in question, and should be tried there. After all, the feds have a vested interest in the case....

Don't forget, boys and girls, that the Ninth Fed. Ct of App., is THE most left liberal appeals court in the nation. It is led by Judge Reinhart(sp?), who wrote the opinion finding that the Second Article did not guarantee an individual ANY Right to own a gun. The communistnazis use his finding constanntly to "prove" their point that we have no Right to own a gun.

Reinhart is also married to Ramona Ripston, president of the ACLU (Kalif.), and the ACLU hates anyone other than their Gestapo and Spetznaz and personal bodyguards, owning firearms. ACLU has long said that the 2nd grants only the military and police the Right to own guns (and establish a police state).

I expected nothing less from the Ninth. J.B.
 
The Supreme Court has reversed the ninth circuit more than any other. Hopefully Emerson will come down on the side the individual citizen.

There is no official immunity for perjury. Horiuchi testified that he didn't see Mrs. Weaver. His shooting diagram (showing exactly what he saw and where his aiming point was) showed that he had aimed directly at her head. He committed perjury. Nail his a$$.

Now, THAT was truly offensive; NPR just ran a news report on the ruling, and followed it up with about 5 minutes of James Bond music. "A license to kill". Whoah, really funny, guys!

I think that pro-gunners tend to be solid supporters of LEOs, but I don't see how this ruling can be a good thing for anybody, and I suspect that most LEOs won't like it any more than civilians will.

My understanding is that LEOs and civilians operate under fundamentally similar principles governing the use of deadly force, even though obviously there are instances where LE can use deadly force and civilians can't. But the ruling tells me that this sniper is able to operate outside the principles because he cannot be held accountable--representing, to me, just about as raw and dangerous an abuse of government power as it gets around here.
 
Remember that all Gestapo officers who rounded up the Jews in Germsny were Federal LEOs and that everything they did was legal under the current German laws.
 
Note that, should a police agency be found guilty, the *taxpayers* of that town and NOT the guilty individuals pay up. Oooops...
