Eric Holder to resign -

Yes, saw this earlier. I can’t say its bad news, but not sure it really changes much as far as Second Amendment issues go.

It doesn't really change anything. The multiple long gun reporting requirement still stands. The DOJ is still withholding the evidence we subpoenaed in the matter of Fast & Furious. Holder is still in contempt of Congress, though there appears to be no forward motion on that.

It will be odd for his replacement, who will likely be serving for less than 14 months.

If the Democrats retain the Senate it will.

Odds are that one of our Conservative leaning Supreme Court Justices will need to be replaced before Obama has completed his second term.

If this happens Obama may indeed Nominate Holder for Supreme Court justice. With a Democrat controlled Senate he will be confirmed.

Let's steer away from the partisan Democrat v. Conservative stuff.

The scenario is unlikely. Justice Ginsburg recently went on record stating she has no plans to retire any time soon. None of the others have voiced any desire to do so, either. It's unlikely we'll see a vacancy before 2016.

Furthermore, there are simply safer and less controversial choices for the nomination. Holder doesn't have the sway of someone like McReynolds, so I doubt a future administration will feel compelled to do him any favors.

I the Senate were to change hands, the next two years would have not been pretty for him. I almost wish he stayed for it.

The Washington Times and NPR weigh in on Holder.

This was from the Washington Times piece:

“I don’t think it’s any coincidence he’s resigning as the courts are ruling the Fast and Furious information has to be released,” Mr. Fitton told The Washington Times.

IIRC, the DOJ has until Monday to release those records. The timing of his resignation is certainly convenient.

From what I read, he's agreed to stay until his replacement is confirmed.

So unless there's some weird loophole, he's still going to be the AG on Monday right?

If Holder resigns now, it will help take the pressure off the White House and the Department of Justice if any embarassing matter comes to light. It may not completely alleviate all the problems which may arise from dubious decisions under his watch but once the fast and furious debacle blows over, I'm sure he'll get a less high profile position that he can continue doing what he was doing before...

Holder is resigning as of January next year. It's not a good thing, not bad either. He most likely off to advisory roles in the Clinton campaign and is leaving due to scandals and a possible GOP takeover next in November. He is announcing his resignation now because the President can appoint his replacement before he loses the senate, he knows if the GOP wins big they will never let his nominee through. Deval Patrick is his likely replacement, and your not going to like him any more than Holder.

One of the more astute political commentaries ever can be found in the lyrics of the Who's Won't Get Fooled Again....

as to Holder resigning....

"meet the new boss...
same as the old boss..."

Without going into gory political detail, it would be an understatement to call Patrick a controversial choice. He has, however, been very emphatic that he's not interested in the job.

I imagine Solicitor General Verrilli's name will be in the running.

Kamala Harris is also a possibility, which concerns me. She instituted California's ballistic fingerprinting system, supported Proposition H (a total ban on handguns in San Francisco), and signed on to an amicus curiae brief in the Heller case in which she argued the 2A does not protect an individual right.

Can he still appoint her after that best looking lawyer controversy?

Harris isn't a scary appointment, she's a sad one. You listed some of the things she's supported. They're almost all losers. She jumped into Peruta, and she's likely loosing that one.

She may be striking out in California, but if she gets the appointment, she'll be in charge of the ATF. They can make a great many problems for us without legislative oversight.

Timing.The F+F ruling matters

But the way Senate rules are right now,if I'm not mistaken,51 votes and no filibuster for confirmation.

So,for the current admin, the time to make the change is now.

If it gets stretched out till the new Senate, potentially a GOP majority would make a critical difference in the sort of AG that could be confirmed. But that's not till January.
