Elian's gone!

There is no age stipulation for aliens seeking political asylum. I mean no disrespect, but anyone who has dealt with INS knows that even top-ranking officials are ignorant of many obscure parts of immigration law. I moved from Canada and initially dealt with INS on my own (a complete nightmare). After getting false information from immigration officers who insisted that they "knew" the law, I finally studied the statutes myself and got my companie's immigration lawyer to help me out. He confirmed that INS had lied to me on several occasions and got me permanet residency in no time flat.
 
This will probably upset a lot of people but here it goes. I have worked with INS for the past few years and worked with Social Services workers for 10 years as an investigator of child abuse cases. SS workers are some of the most liberal, illogical people I have ever met and frightened me at times with their willingness to violate a person's rights. INS agents are here to simply enforce the immigration laws, period. If you don't think we should prevent people from crossing our borders, then take a long hard look and do a little research into the illegal immigrant problem in this country and what it is costing you, the taxpayer, every year. As far as Elian goes: I have yet to hear anyone (news media-government) condemn the mother for nearly drowning the kid. Nor do I hear anyone wondering at what point and time we developed the right to tell a parent where he could raise his/her child. Elian's father has that right and if you want the rolls reversed, well some of those Social Services people will gladly tell you that you can't spank your child, there should be no weapons allowed in households with children, you should not home school your child, etc. and if you do any of these things we'll come and take him away and place him with relatives, if we can maqnipulate the system and convince the courts this should be the case. Also take a cold hard look at that photo, the gun is not pointed at the child or the fisherman, the finger is off the trigger, and while it may have frightened the child the relatives are to blame for wishing to impose their will on the father and the child by refusing to return the child to his dad. As to thiose who say they should have done it differently, would you have been willing to walk through the crowd around that house and try to peacefully take the child. If you want to scream about freedom and rights, Gonzales came to the U.S. to get his child and most of you would deny him that right to chose where he lives and raises his family. You have to look at the situation for what it was, mainly something blown way out of proportion and which should have been quite simple. Dad has custody.
 
jimpeel, I don't think the International Maritime Law applies to anyone other than official agents of the state. Private citizens, such as the two fishermen who pulled the kid and other from the water, are not bound by its rules.
 
Just because the 11th Circuit issues an opinion does not mean that it makes sense or will stand. The 9th Circuit has long been noted for screwy opinions and has a long track record of reversals at the Supreme Court level. As to age for an asylum application, I am a little rusty as to 18/21/whatever, but if the court decides in its wisdom to entertain an asylum application against the wishes of a compentent parent, we are all deep into wonderland. But since courts have determined that a fetus is not necessarily a human being, depending on the current political climate, nothing is certain anymore.

If you think that INS law is complex, you are right--worse than the IRS. That's because EVERYONE an ax to grind and wants their special interests catered to. Everybody is permanently mad at everybody else and it remains that way because the people in this country like the crazy-quilt system and will never change it significantly.

Fortunately, I no longer have to deal with all of that, so enjoy.
