Delaware sucks

Well Delaware does't suck, Delaware is an open carry state, and I have seen ONE person doing so in the years I have lived here. Whats worse is that the police will tell you it is not an open carry state and charge you with disturbing the peace or some other ludacris fabricated charge.

I had to contact the attorney general to find out it was an open carry state and even they were reluctant to tell me the truth. Why do the Delaware police do this? It's not like they are hard on guns around here, we have quick check ( walk in/walk out with rifles, shotguns, pistols etc.) no limits on volume of guns bought, and the CC permit isnt hard to get, you just have to jump through some hoops and have a reason.

This frustrates me to no end, and Pennsylvania is in the same boat. They are an open carry state as well and the police REALLY look down on it. I could see maybe in Philly or Pittsburgh but Delaware???? I am just at the end of my rope with this state, and even though I love it, I am looking at Florida. Nice weather (most of the time) better use of force laws, (mine suck) and it's a shall issue state. Anyone else feeling mad at thier state lately?

End rant.

If they charge you with disturbing the peace then go to court and make them prove the charge. If you win the case then counter sue with a harassment charge. No agency like to see a lot of those charges brought against them.

If you do that, make SURE it gets in the papers, even if you have to buy space to get it printed. They hate the publicity even worse than the actual charges.

Dan - did you get in a rub with the local LEOs for open carry? I asked a friend of mine in the DE State Police and he definately confirmed the open carry - he's a big time pro 2A guy but he lives in SE Penna right over the line.

To be honest I'm scared to open carry, the last thing I need is to be harassed for excercising my rights. I wish that more people did it so I woldn't feel so out of place. The fact that I am on the younger side doesn't help either. Im just frustrated with this place sometimes.

Many if not most LEO's do not like seeing an average citizen open carrying. My friend had a 'conversation' with a couple the other day. They stated he had no reason to be doing so inside a 'family restaurant' and didn't want to get a 'man with a gun' call.

I later found out his supervisor...corrected...him on the issue.;)

Floridha is great

At least we got the voting thing right this election. No problem here with the state on my behalf. Good gun laws. Open carry is allowed in your place of business if you are the owner or the owner permits its, On your personal property. There are many more, here is the statute # F.S.790.25

Be careful with open carry... I recently read a Massad Ayoob article (sorry, don't recall which magazine it was in; I think it was a special issue just recently put out) where he noted that in some states, open carry is allowed in general, but then it is not permitted in specific situations, like at an alcohol serving bar or restaurant. It was (as always) a complex mess of laws (depending on your state), so be careful. The last thing you want is to think you can open carry anywhere in the state only to find out later that it's "everywhere 'but' where you were"... as you sit in a cell.

Still.. feel lucky. In NJ, I have to wait months for handgun purchasing licences every time I want a new gun. AND every time I do go through the process, I have to have two friends respond to letters about me AND they call my place of work. Every time. Forget about a CCL here.

Quit crying, at least you're not in NJ, Md, NY,Mass, or CA. Even here in Texas we don't have an open carry law.
BTW...thanks a lot for Biden :(

You have little to be quibble over - yea it's stupid, but here in Wisconsin I cannot CCW at ALL, plus I'm pretty sure only but the weakest maces are outlawed and batons are illegal as well. We're all sitting ducks around here. Now THAT is something to be P.O.'d about! My blood psi just shot up typing that - no protecting yourself or loved ones in this rotten state.

The Massad Ayoob article I referred to can be found in the current issue of "Concealed Carry Handguns" issue #57 ($9.99 cover price, ouch). He has two different articles in there regarding concealed carry, the first of which is just past the table of contents and refers to the states and the oddball rules that can come into play.

Florida can be a pain in the butt too. I ordered two Pistols on Oct 30 went to the FLL to do the 3 day cooling off thing last Thursday, the state decided they wanted to do a more thorough background check. I will find out tomorrow at 5 pm if they approved it, then it will be another 3 day cooling off period. So with some luck I will get my Pistols on next Tuesday morning. Only will take 20 days to get my guns  . I will be getting my CWP ASAP so this will not happen in the future.

My point is the grass always seems greener on the other side.

Yeah you guys are right, I do need to quit my bitchin, it just gets me worked up that we have this right and we are prolly gonna loose it beacuse no one exercises it. I would love to OC but I'm no martyr. Sorry NJ, WI, CA, CT, MA, etc.

Wisconsin has Open Carry, the Gov Doyle recently publicly acknowledged the fact. He is the reason, the last attempts to legalize CCW have failed.
Some around here thought Pres Obama might give Doyle the nod, get him outta here and maybe the state will finally go CCW! ;)
Run around the capital city carrying open, and you will learn fast what harrassment is about, unless you enjoy talking to cops that is.

Just because other states & cities SUCK, such as my NYC, it doesn't mean the man shouldn't complain & not try to change things for the better.

Otherwise we will always say "Oh, well I am lucky that at least yadda yadda yadda" every time until all of our rights are gone!

The only problem with OC is that the LEOs will get calls from the sheeple about someone terrorizing the public or brandishing a firearm. Then they have to respond and find out what the deal is. I don't think the police are thrilled either about approaching someone that is armed.
