CPHV.COM just recieved their certified letter from HCI/CPHV.org

I am not a lawyer and don't know that much about trademarks, but I do not believe that you can trademark sounds or strings of letters that are not words. HCI could stand for HCI's Crappy Information. CPHV could be Citizens for the Protection of Home and Virtue. Just because your org and their com HAPPEN to have the same letters does not mean that you are infringing on a trademark. If there was a logo involved, that would be another story, but we are talking about an anacronym. I would look into their 'trademark' papers carefully.

Try telling NSI that they are your property. IIRC NSI now basically claims that all domains registered through them are their property. Not to mention they are hoarding domains that have expired. John/az2 may want to transfer them to someone like register.com because in a situation like this NSI would love to screw him over.

register.com's contract does not specifically state that you actually own the domain name.

The registrar that cphv.com is registered with, specifically states that the domain name is owned by the one who registered it (company or individual). It is not a rental or leasing agreement.

It strikes me that domain names are easy to transfer. Assuming the C&D order is addressed to you, couldn't you just sell the domain to a friend ? Then in 60 or 90 days when HCI catches up with the new owners, sell it again ? It would be an interesting game of cat and mouse. But I am not a lawyer

As I read it the "cease and desist" is only a letter from a law firm. It's a bluff letter to provoke the transfer of the domains they want to their ownership. It's not a court order. Nothing has been filed, as of yet. They gave us 20 days to respond.

Once a domain goes into dispute, it is my understanding that it can not be transfered or changed in any way until the dispute is resolved. So playing "ring around the domain name" is not an option, and not one we want to take. This is a fight, not a chase.
