CCW in WI, quick question for other states

Many of the businesses that will be posting signs are doing it because of it is their right under Wisconsin law. As responsible gun owners we should respect their rights, just as we want others to respect ours. Pain it the butt to go back and remove your carry weapon? Sure, but I'm hoping as the folks get more familiar with the law and more comfortable with law abiding folks carrying more and more of these signs will be coming down. Folks just need to realize that they are safer with honest citizens carrying than they are with just the bad guys carrying.

If I have to return to my car to remove my weapon, I will keep it on, then go somewhere else. I may remove it, then go talk to the manager. My words will be something to this nature. I will return to your store if and when I hear you've come to your senses. I wall also tell all my friends, you want to deny my right to self protection. When he/she sees a drop in sales that can't explained any other way, those signs will come down.

I don't have my permit-----yet.(Application sent 11-2-11) But, I've been looking for the signs so I can go somewhere else. Gonna make up some no guns, no money business cards.

I'm not sure what the term is but basicaly the county cannot pass a law that is more restrictive than what the state says. This came when "some" countie were trying to make administrative offices, Gun free zones. This would include county sherrif's offices, county court houses and other places under the control of the city and county. It is currently being tested and agued.

Again, any merchant has the right to post anything he wants, on his property but there is no law to back it up. I will honor these to the best of my ability and as the Barbarian has stated don't tolerate or support it. It's our obligation to follow the law but make sure it's really a law with real teeth and not implied. .....

I believe the term you are looking for is "preemption"

In my state, Washington state, the State government has preemption of firearm laws. In other words, a municipality, county or other level of government cannot make firearms laws. Not all states have this. Not sure about WI, IA or IL
 
The fact that my state issues carry licenses doesn't seem to have percolated through to the attention of the unwashed masses, so the only places I see "No Guns" signs are the post office, the Social (In)Security Office (where it may or may not be legally binding), and the Veterans Hospital.

I think one of the malls may be posted -- in fine print, on a sign placed well inside the entrance in a place where nobody would ever see it. I say "I think" because I haven't read it, but a mall owned by the same company in another state was posted, so I am extrapolating wildly. But -- if it is posted, it isn't legally binding unless one of their agents spots me and tells me to leave, so I carry.

If the signs had the force of law, I would not carry. I would also endeavor to shop elsewhere.

What don't you understand? If the signs have "force of law," that simply means the law stands behind them, and if you ignore them you are committing a specific crime ... for which you can be arrested and charged. It means there is a state statute that specifically provides for business owners to post a sign prohibiting guns (or weapons, depending on the state) and making it a criminal offense to carry a weapon on premises posted with such a sign.

Other than in a few types of buildings in Kentucky, those signs are not law so I ignore them. For example, if I was caught carrying in Wally World, Wally World has the right to ask me to leave. If I don't leave, the police can then arrest me for trespassing but nothing to do with my firearm assuming I'm legal to carry concealed.
 
Pahoo, it is not city by city or state by county by county, Iowa has a state pre-emption. Some cities are trying so say they are private entities that are free to put up signs. This is destined to fail, flys in the face of common sense, and doesn't even pass the sniff test.. If they were then would they still have the right to tax me? Also cities and counties exist at the pleasure of the state, they have no consitutional rights not allowed to them by state statute..

The AG wrote a position in 2003 that is neither supported by a plain reading of the law or any case law, just the opposite.

Thank you and welcome to the the forum. The point I was trying to make is that some cities are trying to sort this "shall issue" and pass their own restictions. Some want to make parks, gun free zones. One problem is that some parks are county parks and they are trying to sort this as well. Some cities have taken a wait and see posture. As I posted before, we are all on a learning curve and they new states are doing quite well because good people and minds, are a constant. These are good laws and overdue, but not perfect... ;)

I sincerely wish the good people of Illinois success in their effort that will now have to wait till next month to vote again. It will happen sooner or later because it's right and they deserve it's passage. ..... ;)
